About this opportunity
The State of Utah Division of Purchasing is seeking to amend Contract 256157 to award $80,441.25 to QIAGEN for a QIAsprint Connect laboratory instrument and three-year service plan without engaging in a standard procurement process, with notice posted July 27 and an August 3 challenge deadline. The procurement is justified as sole source under Utah Procurement Code based on QIAGEN's exclusive patent, manufacturing, and intellectual property rights for both the instrument hardware and specialized chemical consumables.
The Utah Department of Health and Human Services seeks one QIAsprint Connect instrument (Catalog #9001234) priced at $57,827.25, three QIAsprint Connect Full Agreements at $7,488.00 each, and $150.00 freight under the QIAsprint Connect Early Adopter Program for Public Health Labs. The award will increase the total contract amount from $178,543.10 to $258,984.35. DHHS currently maintains two EZ systems under contract with QIAGEN and seeks to consolidate procurement under the existing agreement.
The QIAGEN quote, valid through September 1, 2026, includes significant incentives: 20 percent discount on the instrument, three years of complimentary service, waived installation and training costs, and a $5,000 starter consumables package. Additional items — installation, training services, essential kits, prep covers, pathogen prep sets, prep plate inserts, elution plates, and PowerBead Pro plates — are provided at full discount. Payment terms are net 30 days, FOB Destination prepaid. The original solicitation was numbered AA25-36 and classified as sole source.
Interested vendors may contest the sole-source determination by August 3, 2026, by submitting documentation demonstrating alternative comparable or equivalent systems and cost comparisons. All respondents must certify compliance with Utah Code 63G-27 et seq., confirming non-engagement in economic boycotts or boycotts of the State of Israel. If no valid contests are received, the Division of Purchasing may award the contract without further competition.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
