About this opportunity
The Utah Division of Purchasing is announcing its intent to award an amendment to Contract 256005 without engaging in a standard procurement process, with a challenge period deadline of September 28, 2026. The original contract, established as sole source under solicitation CS25-1, is with Tourism Exchange USA LLC for a Business to Business tourism marketplace platform serving the Governor's Office of Economic Development/Tourism.
This amendment (AMD 2) increases total contract value from $210,000 (first-year funding only under the original contract) to $632,800 across the full five-year term. The additional funding of $422,800 allocates $70,000 for Year 2 and $117,600 annually for Years 3, 4, and 5. The original contract was structured as sole source; the Division of Purchasing must issue a written determination confirming that sole source, transitional costs, or impracticality justifies the award without competition.
Utah Code 63G-27 et seq. requires all vendors to certify they are not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such activities during the contract term. Interested and qualified vendors may submit challenges to the sole source justification directly to the Division of Purchasing during the public notice period. Vendors claiming trade secrets or commercial financial information as confidential must submit both redacted and non-redacted versions per Utah Code 63G-2-305; the Division of Purchasing will not redact proposals on behalf of claimants. If no valid challenges are received or if challenges are overridden, the contract may proceed to award. Additional legislative funding may be added if appropriated for the identified scope of work.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
