About this opportunity

Contract 246175 AMD 1 is a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process issued by the State of Utah Division of Purchasing on behalf of the Commission on Criminal and Juvenile Justice. The procurement concerns the Motorola Solutions Spillman Replicator tool, a proprietary data replication software essential for county jails utilizing Motorola's jail management system. This is a non-competitive, single-source award being pursued because only Motorola can provide this specialized proprietary software. The contract is structured as an agency contract with an anticipated term of 6 years and 2 months and includes renewal options. The procurement represents an amendment to the original Contract 246175 (issued under solicitation GH23-41), extending the contract end date from October 31, 2028, to December 31, 2029, with an annual charge of $72,683 over the five-year extension period. The public comment period for this sole-source determination opened on May 6, 2026, with a deadline of May 13, 2026, for qualified vendors to submit documentation challenging the sole-source justification by demonstrating competing sources or comparable products that meet or exceed specifications.

The procurement is limited to Motorola Solutions as the sole source provider, with no set-aside designations or restrictions on organization types beyond standard state requirements. The incumbent contractor is Motorola Solutions, as the Spillman Replicator tool is an integral component of their existing jail management system already in use by Utah county jails. The contract requires integration with Motorola's jail management infrastructure currently deployed in the state. All contractors must certify compliance with Utah Code 63G-27 et seq., which prohibits economic boycotts and boycotts of the State of Israel. The original contract total was $193,709, with the current proposed amendment total of $557,124, representing a 187 percent increase from the original contract value; the estimated value of the procurement item itself is $363,415 with zero freight costs. The justification for the amendment stems from an unintentional error in the original contract specifications, where the extended date and amount should have been included initially, and the Division of Purchasing currently indicates it is engaged in a standard procurement process for this item.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
