About this opportunity
The Utah Division of Purchasing issued a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process on behalf of the Utah State Tax Commission for annual maintenance and support of a remittance processing solution, with a public notice period ending September 21, 2026. The procurement is a sole-source award to Deluxe Corporation, justified on the grounds that Deluxe possesses custom programming specifically developed for the Tax Commission's operational requirements and that transitioning to another vendor would require an implementation period incompatible with license expiration timelines.
The scope covers maintenance and support for multiple software systems and licenses including Orbograph Accura XV, Progress 4GL Development System, Progress OE Enterprise RDBMS, ImageRPS software packages, OCR software, and PE/R&K Remit Software, along with connectivity and support services. The contract encompasses 17 line items with annual maintenance rates ranging from $33.85 to $6,251.88 per unit. The contract value is $51,393.74 for the period October 1, 2026, through September 30, 2027, with a cancellation option available up to one week after contract start and a three-month cancellation deadline for yearly renewal consideration.
The Tax Commission is actively implementing a custom solution with another vendor but requires immediate maintenance coverage from the incumbent to prevent service lapse during the transition. Vendors may contest the sole-source determination by submitting detailed documentation demonstrating competing sources capable of providing comparable services during the public notice period. All challenge submissions must include vendor certification of compliance with Utah Code 63G-27 regarding economic boycotts.
A Notice of No Award was subsequently issued, formally closing the Part 8 solicitation without awarding a contract through the non-competitive process. Any future contract award will occur through a separate process.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
