About this opportunity
The West Virginia Department of Environmental Protection (WVDEP), Office of Abandoned Mine Lands & Reclamation, is issuing an Agency Request for Quote (ARFQ 0313 DEP2600000064) for the AML-West Fork #9 project located in Harrison County near Shinnston, West Virginia. This construction/reclamation procurement seeks comprehensive environmental remediation and site restoration services across approximately 10.7 acres (with a 15-acre construction area limit) involving the reclamation of eight P2 disturbances, three P2 mine portals, one P2 subsidence area, and one P2 dangerous slide site along the West Fork River. The scope of work includes 52 line items encompassing mobilization and demobilization, site preparation with clearing and grubbing, erosion and sediment control installation and maintenance, mine seal construction with dewatering operations, soldier beam and lagging retaining wall construction for slope stabilization, revegetation of 8.4 acres of disturbed areas, stream channel restoration (1,165 linear feet of vegetated trapezoidal channel), utility and drainage infrastructure installation, excavation operations (7,874 cubic yards of unclassified excavation and 6,100-8,950 tons at disposal sites), and pavement operations on the West Fork River Rail Trail. A mandatory pre-bid meeting was held on January 12, 2026, at 1:00 PM at the Shinnston Wastewater Plant; technical questions were due by January 22, 2026, at 4:00 PM Eastern time; and all bids must be submitted electronically through wvOASIS Vendor Self Service by February 3, 2026, at 10:30 AM. Bidders must provide unit and total pricing for each line item with specific cost constraints: mobilization and demobilization capped at 10 percent of total bid, construction layout stakes at 5 percent, quality control at 3 percent, and site preparation at 10 percent of the total contract amount.
No specific set-asides for disadvantaged business enterprises, minority-owned businesses, or women-owned businesses are noted in the solicitation documents; however, the procurement is subject to federal procurement standards under 2 C.F.R. 200.317-200.327, including requirements for consideration of minority business enterprises and domestic product preferences. The contract is federally funded through the Infrastructure Investment and Jobs Act (IIJA) and is subject to Davis-Bacon wage rate requirements; contractors and subcontractors must complete an OSMRE Contractor Information Form (AVS) for eligibility evaluation and submit a Coal Industry Employee Certification Form to document current and former coal industry employees. Bidders must submit a 5 percent bid bond, with the apparent successful vendor required to provide 100 percent performance bonds and labor/material payment bonds prior to contract award, as well as commercial general liability and automobile liability insurance with minimum limits of $2,000,000 per occurrence and workers' compensation insurance as mandated by law. The contract term is one calendar year from the effective start date with potential renewal for up to three successive one-year periods subject to mutual written consent and Attorney General approval. The revised Engineer's Cost Estimate totals $4,405,994.85, representing the anticipated budgeted amount for this procurement, with liquidated damages of $1,000 per working day applicable for work not substantially completed within the contract time period.
