About this opportunity

The West Virginia Department of Environmental Protection is soliciting bids through an Agency Request for Quote (ARFQ 0313 DEP2600000065) for abandoned mine land (AML) reclamation and acid mine drainage (AMD) remediation work at the Upland Run (Harrison) site located in Lewis County, West Virginia, with jurisdiction in Hampshire County. The comprehensive construction project encompasses approximately 89.48 acres and includes 54 line items covering mobilization and demobilization, site preparation with clearing and grubbing, construction of approximately 11 miles of drainage channels (Types I, II, V, and VI), installation of HDPE and PVC piping systems ranging from 4 inches to 42 inches in diameter, erosion and sediment control measures, excavation of approximately 21,811 cubic yards of unclassified materials, revegetation of 8.28 acres, installation of approximately 4,811 linear feet of fencing, armored slope protection, and various drainage and energy dissipation structures. Vendors must submit bids electronically through the wvOASIS Vendor Self Service portal by February 3, 2026, at 11:30 a.m., with a mandatory pre-bid meeting held on January 13, 2026, at 1:00 p.m. Eastern time at 2101 Berlin Road, Weston, WV 26452 (failure to attend results in automatic bid disqualification). Technical questions were due by 4:00 p.m. on January 22, 2026. Pricing must be submitted on a unit price and lump sum basis as specified for each line item, with certain categories capped as percentages of total bid: mobilization and demobilization (5 percent), construction layout (5 percent), quality control (3 percent), site preparation (10 percent), administration (3 percent), and traffic control (3 percent). Qualified contractors must demonstrate experience in construction and environmental remediation projects and must comply with all federal, state, and local regulations.

The project is subject to significant compliance requirements and restrictions, including a mandatory local labor market hiring requirement of 75 percent local workers, Davis-Bacon prevailing wage rates (federally funded through the Infrastructure Investment and Jobs Act), Build America Buy America Act domestic content provisions, and drug-free workplace requirements. All vendors must provide a bid bond equal to 5 percent of the total bid amount, along with performance and labor/material payment bonds equal to 100 percent of the contract value prior to award, and maintain commercial general liability and automobile liability insurance coverage of not less than $2,000,000 per occurrence throughout the project. The contractor must assume responsibility as Co-Applicant #1 under the NPDES Construction Storm Water General Permit (WV0115924) and submit a pre-qualification questionnaire with all required addenda acknowledgments to avoid disqualification. Liquidated damages are assessed at $1,000 per working day for delays beyond the specified completion timeframe, and payment will be made in arrears upon receipt of proper invoices, with the State not reimbursing applicable sales, use, or personal property taxes. No incumbent vendor information or specific budget range has been provided in the available solicitation documents. The buyer contact is Larry T. Workman at (304) 414-1242 or larry.t.workman@wv.gov.
