About this file
File Summary
This is Addendum No. 2 to a Request for Quotation (ARFQ DEP2600000065) issued by the West Virginia Department of Environmental Protection (WVDEP) Division of Land Restoration, Office of Abandoned Mine Lands and Reclamation for the Upland Run (Harrison) Abandoned Mine Drainage (AMD) project located northeast of Weston in Lewis County, West Virginia. The project involves installing above-grade drainage channels and a below-grade stormwater system to divert water away from affected properties and prevent flooding and structural damage. A pre-bid conference was conducted on-site on January 13, 2026. The addendum publishes the results of that conference, including clarifications on critical project requirements such as the prohibition on burning, stacking, or windrowing materials onsite; the requirement to remove all felled trees and stumps; confirmation that all subsurface drainage pipes shall be a minimum of 8 inches in diameter (revised from 4 inches); and confirmation that the contractor is responsible for brush pile and equipment removal if the property owner does not complete removal prior to construction. The addendum addresses nine additional questions regarding tree removal, survey plans, material usage restrictions, site access, and equipment coordination with the landowner.
The specifications detail comprehensive scope requirements including mobilization and demobilization, construction layout and surveying, quality control testing, site preparation with clearing and grubbing, erosion and sediment control, drainage structure installation, unclassified excavation, traffic control, and revegetation. The contractor must assume responsibility as Co-Applicant #1 under the NPDES Construction Storm Water General Permit (WV0115924) and complete required signature pages before a Notice to Proceed is issued. The project is federally funded through the Infrastructure Investment and Jobs Act and subject to Davis-Bacon prevailing wage requirements and Build America Buy America Act domestic content provisions. Lump sum bid caps are established at 5 percent for mobilization and demobilization, 5 percent for construction layout, 3 percent for quality control, and 10 percent for site preparation. The contractor must provide pre-construction and post-construction photographic and video documentation, as-built plans in multiple formats, and detailed inspection reports throughout construction to ensure compliance with all federal, state, and local environmental and safety regulations.

Division I – Special Provisions
I Location/Site Description
The project is located Northeast of the City of Weston, Lewis County, WV, off Berlin Road. The main area of concern is a large drainage channel that is capturing water from above the Harrison property and depositing at a point near their garage/outbuilding and it is scouring out an area, fills it with water, then overflows, flooding the building on the Harrison’s property. This same drainage has undermined the pumphouse for the Hicks residence and may cause the structure to fail.
During heavy rains, water overflows a DOH culvert on Berlin Road and an adjacent access road for property owners.
The purpose of this project is to install above grade drainage channels and a below grade stormwater system to divert water away from the properties and structures. The highwall and unstable areas will be reclaimed with toe key foundations and bonding benches. The contractor will be responsible to plan the repair and revised drainage conveyance. The contractor will also be responsible to plan the sequencing of their Work and access considerations such that the
Contractor can comply with these requirements, the Limits of Disturbance shown on the Plans, and all other requirements in these Specifications or in the Plans.

Project survey stakeout must be performed by a Surveyor with survey grade instruments that will provide real time sub-centimeter accuracy based on the project control provided in the Plans. Survey stakeout tolerances will be stated on plans; in absence of this, tolerances will be determined in the following way:
A survey plan will be submitted in writing or electronically to the Engineer. The submission will include a comprehensive list of survey personnel qualifications, the survey equipment to be used, and a detailed outline of the means, methods, and precision for tasks such as stakeout procedures, quantity measurements, volumetric confirmation, and as-built procedures. Approval of the plan is required prior to any work being performed.
The Contractor’s Surveyor shall provide field forces and shall set all additional stakes as needed, such as offset stakes, reference point stakes, slope stakes, grade stakes, stakes for drainage, or other structures, supplementary benchmarks, and any other horizontal or vertical controls necessary to secure a correct layout of the Work, including the re-establishment of the survey and construction baselines (as necessary), as shown on the Construction Drawings.
The Contractor’s Surveyor shall be responsible for assuring the layout staking work is in conformance to the lines, grades, elevations, dimensions, and locations shown on the
Construction Drawings, or as required by the Engineer. The Contractor shall furnish a copy of their survey records for review by the Engineer and for the State’s permanent file. These records shall be furnished as they are completed during the progress of the
Work.
Any inspection or review of the Surveyor's layout by the Engineer and the acceptance of all or any part of it shall not relieve the Contractor of their responsibility to secure the proper dimensions, grades, and elevations of the Work.
The Contractor’s Surveyor shall be responsible for locating all property corner monumentation within the LOD and provide coordinates to the Engineer for verification.
Upon verification, the Contractor shall remove and preserve disturbed monumentation, and reset original monuments to their location upon project completion. The Contractor shall exercise care in the preservation of stakes, monuments, and benchmarks, including existing property line markers, and shall have them reset at their expense if any are damaged, lost, displaced, or removed. The Contractor shall use competent personnel and suitable equipment for the layout work required and shall provide that it be done under the supervision of, or directed by, a Professional Surveyor registered in the State of West Virginia. As the survey is completed, the Professional Surveyor shall certify that the site layout is complete; this includes, at a minimum, all necessary grades
(both cut and fill), location and grades of all ditches, and all cross-sections related to cut and fill where grade lines are necessary for construction and or billing.
As-Built plans shall be provided to the Engineer for approval prior to the Final Invoicing.
All work completed by the Surveyor on the As-Builts must be certified by the Surveyor as to completeness and accuracy of the plan submittal. The As-Builts shall be provided in two forms of electronic format in PDF and AutoCAD 2020 or approved later version on either CD-ROM, DVD, or USB memory stick and one paper copy of the plans with the same size and scale as contained on the original plans.
The As-Builts shall include the following:
• Show all permanent Work in place installed both on the surface and subsurface, and any deviations from original plans.
• The preferred coordinate system and elevation datum by the Contractor need to be specified. The State has a preference for the US State Plane Coordinates of
1983 West Virginia South Zone – SPCS83 Zone 4702 in feet, unless otherwise specified.
• Show all horizontal and vertical dimensions (including invert elevations) of all installed components (i.e., pipes, drop inlets, mine seals, drainage channels, splash pads, manholes, etc.), as well as surveyed locations of the installed structures. Any other items deemed necessary (provided in the contract) by the
State shall be included in the As-Builts.
• Each cut-fill section shall have the area of that section labeled.
• Have the lines on the plans shown in either color or line type to distinguish between the original plan lines, the contractor’s original survey lines and the final grade lines. This will apply for all cross-sections on the project.
• All waste and borrow areas shall be shown and labeled.
• Revegetation that is paid for by acreage, shall be per plan view acreage and shall be shown on a separate AutoCAD layer. The enclosed areas shall not include any graveled surfaces, paved surfaces, roads, ponds, treatment components, all non-vegetated channels, buildings, etc. (non-vegetated areas are not to be included in the revegetation acreage calculation or AutoCAD layer).
• Any control points shall be shown with coordinates and elevations labeled. If the State has provided control points, the Contractor shall reference elevations and coordinates to them. If no control points were set, then new points shall be set and utilized.
• Any seep collectors, underdrains, or other structures inaccessible after covering, shall be surveyed for location, prior to covering.
• Show total quantities for all items on the project. The format shall be in a tabular form (i.e., Bid Schedule or Summary of Quantities).
• [Changes (deviations) should be on separate “Change” layer, not on the original layers from the original plan.]
