About this opportunity
This is a Notice of Intent to Award an Amendment Contract (266171) without engaging in a standard procurement process for laboratory analytical equipment and service agreements with Agilent Technologies. The Utah Department of Government Operations, Division of Purchasing and General Services, in coordination with the Department of Health and Human Services, is procuring specialized laboratory equipment maintenance, repair support, and software upgrade subscriptions. The goods and services include maintenance and repair support for LC/MS Triple Quadrupole systems, ICP-MS systems (both 7700 and 8900 models), and GC/MS Triple Quad systems, along with associated components such as autosamplers, chillers, pumps, column compartments, and degassers, with phone support and software upgrade subscriptions included. Service periods extend from April 2026 through September 2028, with individual annual and multi-year contracts for specific equipment systems. The non-competitive award is justified based on technical exclusivity and proprietary constraints inherent to Agilent's specialized laboratory equipment, which requires proprietary original equipment manufacturer (OEM) parts, patented software and diagnostics, and OEM certification, making a standard procurement process impractical and likely to result in a "no-bid" scenario from competing vendors. The notice was posted on May 18, 2026, with a due date for public comments or challenges of May 25, 2026, and no formal solicitation period, bidder's conference, or site visit is applicable to this non-competitive award.
The procurement does not identify any set-aside designations or restrictions for disadvantaged enterprises or specific organization types. Agilent Technologies is the incumbent and sole-source vendor for this contract amendment, with the consolidation of multiple expiring agreements into a single master agreement cited as providing administrative efficiency, cost leveraging through bulk service rates, and continuity of care for critical laboratory infrastructure. The estimated amendment value is $151,587.60, representing a 324.73 percent increase from the original contract 266171 value of $46,680.48, with no freight costs included. Individual quotations total $193,176.00 before discounts, with final totals of $33,043.20 for LC/MS system services, $74,246.40 for ICP-MS 7700 and GC/MS systems, and $44,298.00 for ICP-MS 8900 system services after applying region/country and multi-year purchase order discounts. Payment is to be made via ACH, with a 3 percent surcharge applied if credit card payment is used, and all services are subject to Agilent's standard service terms with spare parts covered under a 90-day replacement warranty. Any vendor interested in challenging the sole source determination must submit evidence of competing sources, proof of comparable or superior offerings, and cost comparisons if applicable, along with certification of compliance with Utah Code 63G-27 regarding economic boycott prohibitions.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
