About this opportunity

The Utah Division of Purchasing is proceeding with a sole-source contract amendment (Amendment 1 to Contract 256321) to award preventative maintenance service coverage for two Nitrogen Generators to Peak Scientific without engaging in standard procurement, with a notice period closing September 16, 2026. The amendment is justified under the Utah Procurement Code on the grounds that the equipment cannot function without the service and that transitional costs make standard procurement impractical; challengers may submit documentation of alternative qualified sources during the notice period.

The scope covers annual preventative maintenance service for a Genius XE35 120V Nitrogen Generator (Serial No. 723020261) and a Genius 1024 generator (Serial No. 721020133) supporting the State of Utah's Newborn Screening program. Service terms include one to two on-site preventative maintenance visits annually, full function checks, component retrofits where applicable, compressor repair or replacement, and 48-hour response-time breakdown and repair service. Service agreements run from October 17, 2026 through April 20, 2030, with online technical support included.

The amendment value is $52,882.62. The original Contract 256321 with Peak Scientific totaled $30,240.00, bringing the post-amendment contract total to $83,122.62. Pricing for the two generators is divided into four equal annual invoices per generator: the Genius XE35 120V at $6,428.38 annually, and the Genius 1024 at $6,792.28 annually, invoiced October 17 of each year with 30-day payment terms. Tariff costs and applicable taxes will be added separately. Peak Scientific is the incumbent vendor. All challengers must certify non-engagement in boycotts of Israel under Utah Code 63G-27 et seq.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
