About this opportunity
The Utah Division of Purchasing is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for AM27-1 Canister Samples, with a challenge period closing July 16, 2026. The procurement is sole-source to Eastern Research Group, Inc. (ERG) based on ERG's status as an EPA-certified laboratory that helped create the TO-15 sampling method and serves as the preferred EPA laboratory for the National Air Toxics Trends Station (NATTS) network.
The Utah Division of Air Quality is procuring canister sample collection, chemical analysis, and data validation services for a volatile organic compound field campaign in the Salt Lake Valley from July 19 through September 29, 2026. The scope encompasses pre-cleaned canisters supplied with flow controllers and timers, collection of approximately 275 samples across 15 locations using 8-hour, 16-hour, and 24-hour sampling intervals on a 1-in-6-day schedule, chemical analysis using EPA Compendium Method TO-15 with gas chromatography/mass spectrometry (GC/MS), monthly data validation and reporting, and shipping. ERG's EPA-approved analysis standard operating procedures and Category 1 QA/QC protocols are required and incorporated into the Division of Air Quality's Quality Assurance Project Plan. Sample comparability with existing NATTS station data from the Bountiful Viewmont location, which ERG has historically analyzed, is a critical requirement.
The estimated contract value is $155,975 with a five-year term. The contract is funded by a competitive EPA grant awarded to UDAQ in 2024. The sole-source justification rests on ERG's proven track record with UDAQ on EPA-awarded research grants, its ability to provide equipment without significant lead time, and capacity to troubleshoot samples exceeding normal TO-15 parameters. The Division of Air Quality conducted market research contacting ALS Environmental, DRI, Pace Analytical, and a local contractor; responses were minimal or nonexistent. Vendors may challenge the sole-source determination by submitting detailed documentation demonstrating competing capabilities and cost comparisons; all responding vendors must certify compliance with Utah Code 63G-27 et seq., confirming they are not engaged in economic boycotts or boycotts of the State of Israel.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
