About this opportunity
The Utah Division of Purchasing is issuing a notice of intent to award a five-year service agreement for a Hologic Panther Fusion Plus system without competition, with a listing due date of November 6, 2026. The Conducting Procurement Unit intends to award a sole-source contract to Hologic Sales and Service, LLC on behalf of the Utah Department of Health and Human Services and its Utah Public Health Laboratory. Vendors may challenge the single-source determination during the public notice period by submitting documentation of competing sources, comparable or superior products, or cost comparisons. Challengers must certify compliance with Utah Code 63G-27 et seq., including boycott certifications.
The scope covers annual on-site preventive maintenance, calibration, repair, and technical support under the Standard service option, which includes labor, travel, and replacement parts (excluding disposables) during standard business hours. It also covers factory-authorized updates and telephone technical support. The contractor must submit digital field service reports after each on-site or remote visit and use only Hologic-approved consumables, as non-approved consumables void all warranties. The justification rests on the platform's proprietary closed-loop hardware and software, Hologic's exclusive ownership of calibration tools, embedded software, and technical manuals, and CLIA and FDA requirements for original equipment manufacturer servicing. The Conducting Procurement Unit reports that federal market research and a State Cooperative Database search found no alternative vendors or superseding contracts.
The estimated contract value is $142,500 with zero freight costs, and the agreement carries a five-year term with renewal options. Contracts do not automatically renew. Monthly invoices are due by the 20th of the following month, and services performed through June 30 must be billed by July 14 of the following fiscal year. The contractor must maintain commercial general liability insurance of at least $1,000,000 per occurrence and $3,000,000 aggregate, and must register in the E-Verify system. Work-made-for-hire intellectual property created under the contract belongs to DHHS.
