About this opportunity
The Utah Department of Government Operations Division of Purchasing is publishing notice of intent to award a contract without competition to Environment Rating Scales Institute Inc., with a public-comment period closing July 30, 2026. This is a sole-source amendment (Contract 246015, Amendment 3) under the Utah Procurement Code.
The Utah Department of Workforce Services, Office of Child Care is the conducting procurement unit. The contract covers Environmental Rating Scales training and reliability testing mandated by the federal Child Care and Development Fund. ERSI will conduct three separate four-day training sessions in Salt Lake City: Infant Toddler Environment Rating Scale–3rd edition (September 18–21, 2023), Family Child Care Environment Rating Scale–3rd edition (January 22–25, 2024), and Early Childhood Environment Rating Scale–3rd edition (May 13–16, 2024). Each session accommodates up to three participants. The contractor must provide electronic originals of training handouts, maintain email and telephone availability throughout the contract year to answer questions, and submit camera-ready training materials one week before each session. DWS Office of Child Care is responsible for securing meeting space, reproducing training materials and published scales, and providing delivery support.
The estimated contract value for this amendment is $45,000, representing a 100 percent increase to the original contract total. The amended contract total reaches $180,000, up from $135,000 under the original sole-source award. Compensation covers all trainer fees and travel expenses; final payment is due within 30 days of completion of the last training session upon invoice submission and a current W-9 form. If DWS Office of Child Care modifies or cancels training, ERSI is reimbursed for travel costs already incurred. The justification for sole-source award rests on single-source availability and transitional costs as a significant consideration in contract selection.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
