E.7 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
All non-price factors, when combined, are significantly more important than price. The factors are listed in descending order of importance.
(b) Pricing Periods. For purposes of award of this Contract, the Government intends to evaluate the Pricing Period to extend services under FAR 52.217-8 as follows: The evaluation will consider the possibility that the Pricing Period can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the contract. The evaluation will assume that the prices for any Pricing Period exercised under FAR 52.217-8 will be those rates in effect under the contract each time a Pricing Period is exercised under this clause. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced Pricing Periods has the same effect on the total price of all proposals relative to each other and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any Pricing Period under FAR 52.217-8.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO FAR 52.212-2, EVALUATION, COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
The Government will award a single 5-year Firm-Fixed Price Indefinite Delivery Indefinite Quantity (IDIQ) contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. This is a competitive solicitation that will be evaluated and awarded in accordance with FAR 15.305, evaluation procedures. Evaluation may result in an award to other than the lowest priced offeror.
The government will evaluate information based on the following evaluation criteria: Factor A- Past Performance and Factor B- Price and Factor C- Submission of VA Acquisition Regulation (VAAR) 852.219-77 Certification
Factor A Past Performance
Contractor should Identify Federal, State, and local government contracts and private contracts, and should describe the experience of the company in providing the same/comparable equipment as specified in this solicitation within the past three (3) years. Provide a list of three (3) references pertaining to those contracts including name, address, contact person, and telephone number that can validate level of performance. Offerors with no relevant performance history will receive a neutral rating. This factor will be used to assess the Offeror s past performance history providing Non-Emergent and Transportation Services. It considers each offeror demonstrated recent and relevant record of performance in providing services that met the contract requirements:
There are two separate aspects to the past performance evaluation:
Relevancy of contractual work performed and;
How well the contractual work was performed
Relevant is defined as contracts recently performed that include services that are similar in complexity, dollar value, and contract type. The more recent the offeror s performance in providing similar services, the more consideration that will be given by the Government in evaluating the relevance of the offeror s past performance history. The second aspect of past performance evaluation is to determine how well the contractor performed on the contract.
The Government may contact references, other than those identified by the offeror, and use the information received to evaluate the offeror s past performance. The information evaluated may include data on efforts performed by other divisions, critical subcontractors, or teaming partners, if such resources will be brought to bear or significantly influence the performance of the proposed effort. Special emphasis will be placed on performance related to areas covered in the PWS for this solicitation. The government will also use information obtained from government data bases such as Contractor Performance Reporting Systems (CPARS), Past Performance Information Retrieval System (PPIRS) and any other data base as necessary.
Contractor must provide documentation of proper licensing and certification as outlined in the statement of work.
Contractor must provide documentation that shows capability to perform all elements required in the statement of work.
In the case of an offeror without a record of relevant performance history or for when information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on performance history.
Factor B - Price
This factor shall be used to assess the reasonableness of the Offeror s proposed price.
Factor C- Submission of VA Acquisition Regulation (VAAR) 852.219-77 Certification
All vendors submitting proposals to be considered for award must return the completed VAAR 852.219-77 found in Section C11 of this RFP.

understanding of the requirement, feasibility of approach, flexibility, adequacy of response and
the specific criteria as listed below:
The Offeror's proposal shall disclose the technical ability in as much detail as possible, including, but not limited to, the requirements in this section of the RFP. The technical ability should be specific, detailed and complete enough to clearly and fully demonstrate that offeror thoroughly understands the intent of the
