About this opportunity

The Pawnee Indian Health Center, a component of the Department of Health and Human Services Indian Health Service, has issued a Special Notice announcing its intent to award a non-competitive, sole source purchase order to Biomerieux, Inc. for respiratory test kits. The procurement is being conducted under FAR Part 5.406(a), which allows for sole source acquisition when only one source can provide equipment meeting specific quality requirements. Biomerieux, Inc. is identified as the manufacturer and sole licensed provider of the required equipment, with the agency emphasizing the critical nature of maintaining uninterrupted patient care services. The Special Notice specifically relates to the VC-SPOTFIRE system, which can simultaneously test for multiple respiratory pathogens including COVID-19, Influenza A/B, Respiratory Syncytial Virus, and Rhinovirus in a rapid 16-minute testing format.

The purpose of this Special Notice is to formally communicate the government's intent to proceed with a non-competitive procurement and provide a limited opportunity for potential challenges to the sole source determination. Contractors have until March 13, 2025, at 2:00 PM CDT to submit responses, with any challenge requiring clear and convincing evidence that competition would be advantageous to the government. The total procurement value is $172,680, and the purchase will be made against an existing contract (75H71124P00237) with pricing previously determined to be fair and reasonable. Eligibility is implicitly limited, as the notice explicitly states this is not a competitive solicitation and Biomerieux, Inc. is the sole identified vendor. Respondents are cautioned against submitting proprietary, classified, or sensitive information, and the government reserves the right to use any non-proprietary technical information in potential future solicitations. The agency emphasizes that responses will not be considered solicitation responses and that it is under no obligation to provide feedback or acknowledge receipt of submissions.
