AMC-LEVEL PROTEST PROGRAM (AUG 2012) ACC-APG 5152.233-4900

If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible Contracting Officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the General Accounting Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. Send protests (other than protests to the Contracting Officer) to:

Headquarters U.S. Army Materiel Command
Office of Command Counsel-Deputy Command Counsel 4400 Martin Road
Rm: A6SE040.001
Redstone Arsenal, AL 35898-5000
Phone: (256) 450-8165
Fax: (256) 450-8840
E-mail: amcprotests@conus.army.mil

The AMC-Level Protest Procedures are accessible via the Internet at: www.amc.army.mil/amc/commandcounsel.html. If Internet access is not available, contact the Contracting Officer or HQ, AMC, to obtain the AMC Level Protest Procedures.

Please note some Questions from Vendors and the Answers Listed below:

  • Do you already have a data acquisition system in place to collect/display the data of the Fuel Measurement System?
    • If so, what system are you using? This system is intended to be used as both standalone with manufacture software for control, data logging, and to aid in analysis. In addition, this system is intended to integrate with our Dewesoft and in-house developed Advanced Distributed Modular Acquisition Systems (ADMAS) data acquisition systems.
    • If not, is this intended to be part of the quotation? The manufacturer’s software is indented to be included as part of the system.
  • For the interface support #6, does it have to have all 4 options, or is a partial fulfillment of the list acceptable? All four interfaces are required. A partial fulfillment of the list is NOT acceptable.
  • Regarding note: “A critical requirement of the system is to not introduce a pressure drop and therefore not influence the application and measurement”
    • What is the intention of this requirement? The required components as listed (heat exchanger, valves, piping, etc.) all induce a pressure drop of varying magnitude, so I need to know which part of the circuit you are referring to in order to properly analyze the system for you. This fuel system is designed to be used to measure fuel consumption from very small to mid-sized internal combustion engines used in military and commercial applications. The Extension Unit is designed to account for pressure losses from internal components and the Fueltron utilizes a gear driven flowmeter to achieve Δp=0 at point of measurement.
    • We are fully capable of designing and installing a fuel management system as desired by the Army for use on Army vehicles. By the 22nd of August, we could potentially submit a technical proposal with cost estimates, in accordance with your “Purchase Description” (attached here).  Is this acceptable, or are you only interested in an already developed COTS solution that you can immediately purchase?  A novel system is presents too high of a risk in terms of performance and schedule, and therefore is not an acceptable option for this solicitation. The name brand specified COTS AVL FuelTron Advanced 300 with Extension Unit is a proven, low risk system that meets requirements for performance, interoperability of Army data acquisition systems, NIST traceable calibration, and is available for immediate purchase.
