About this opportunity

The Department of the Navy Naval Facilities Engineering Command has issued a Special Notice requesting information from the construction community regarding the potential use of a Project Labor Agreement (PLA) for a construction project to replace an intermediate pumphouse and two reservoirs at the Naval Air Weapons Station in China Lake, California. The anticipated $50M-$100M Design-Build project has a 910-calendar day period of performance.

The purpose of this Special Notice is to solicit feedback from the construction community on the use of a PLA for this federal procurement. The government is seeking to determine if a PLA would advance economy, efficiency, and labor-management stability for the project. Contractors are requested to provide information on their entity type, availability of specialized contractors, union/non-union labor, interest in the project, experience with PLAs, wage rate comparisons, potential cost impacts of PLAs, and timing considerations for PLA negotiations. The government will use the responses to inform its decision on whether to require a PLA for this construction project. Responses to the attached questionnaire must be submitted by 3:00 PM Pacific Standard Time on May 31, 2024.

Notice text

This is a request for information (Questionnaire attached).  NAVFAC SW is soliciting comments from the construction community addressing the use of Project Labor Agreements (PLA) for the following construction project. The construction project is to replace intermediate pumphouse and replacement of two (2) new 1.5 million gallon, above ground welded steel, reservoirs, 20121-20123(PS) at Naval Air Weapons Station China Lake, Ridgecrest, California. Work to be performed shall be in compliance with American Water Works Association (AWWA) and NSF requirements.  Project will be Design-Build.  NAICS Code: 237990.  The magnitude of construction is anticipated to be $50M – $100M.  General period of performance is anticipated to be approximately 910 calendar days.

A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158 (f).  Federal Acquisition Regulation (FAR) Policy states: Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects.  An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for a particular project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) be consistent with law.  Reference is made to: FAR Subpart 22.5 Use of Project Labor Agreements for Federal Construction Projects; provision, FAR 52.222-33 Notice of Requirement for Project Labor Agreement; and to clause, FAR 52.222-34 Project Labor Agreement.

In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of a PLA for this construction project.
