About this opportunity
The Department of Energy's National Energy Technology Laboratory (NETL) has issued a Special Notice announcing its intent to sole source a purchase order for a VersaProbe III X-ray Photoelectron Spectrometer Service Contact to Physical Electronics. The notice, posted on March 5, 2025, outlines NETL's plan to negotiate a service contract directly with this specific manufacturer under Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures. NETL has determined that Physical Electronics is the only known source capable of providing the required specialized instrument maintenance and service. The procurement is specifically for maintaining a highly technical scientific instrument that requires factory-trained technicians to service and replace components. By pursuing a sole source contract, NETL aims to prevent potential costly damage to the equipment and ensure user safety.
The primary objective of this Special Notice is to provide transparency about NETL's intent to award a non-competitive contract and offer an opportunity for potential alternative vendors to demonstrate their capability. Interested parties who believe they can meet NETL's requirements must submit written evidence of their capabilities by 1:00 PM on March 19, 2025, via email to Shannon.Lynch@netl.doe.gov. The maintenance renewal will include comprehensive services such as full functionality, technical support, upgrades, no-cost equipment exchanges, remote diagnostics, and scheduled preventive maintenance. Contractors responding to the notice should understand that the government retains sole discretion in determining whether to compete the requirement based on received responses. The service contract will cover the period from March 24, 2025, to March 25, 2026, and is categorized under NAICS code 811210 for Electronic and Precision Equipment Repair and Maintenance. Telephone responses will not be accepted, and all submissions will be evaluated strictly for the purpose of assessing potential competitive procurement alternatives.

In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to Physical Electronics for a VersaProbe III X-ray Photoelectron Spectrometer Service Contact because all major components for instruments specific to this manufacturer must be serviced and replaced by factory-trained technicians in order to avoid costly damage to the instrument and prevent injury to its users. The maintenance renewal includes full functionality, technical support, and upgrades, no cost exchange of equipment or loaner equipment, use of remote diagnostics program (ReACH), and scheduled preventive maintenance.
This is considered a sole source to Physical Electronics because, to the best of the NETL’s knowledge and based on market research conducted Physical Electronics is the only known source that can provide this type of service. No known potential alternate sources exist which could satisfy NETL's requirement.
This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 13:00 PM on 03/19/2025. Responses must be submitted in writing to Shannon.Lynch@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
