About this opportunity
The Department of Energy's National Energy Technology Laboratory (NETL) has issued a Special Notice regarding its intent to sole source a maintenance plan for a JEOL 7600 FESEM Field Emission Scanning Electron Microscope. The notice, posted on March 13, 2025, outlines NETL's plan to negotiate and award a purchase order directly to JEOL for comprehensive maintenance services. This procurement falls under Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, and is specifically targeted at maintaining a highly specialized scientific instrument. NETL has determined that only JEOL can provide the necessary maintenance services due to the instrument's unique technical requirements. The agency emphasizes that factory-trained technicians are essential to prevent potential damage to the equipment and ensure user safety.
The primary objective of this Special Notice is to allow potential alternative service providers an opportunity to demonstrate their capability to meet NETL's specific maintenance requirements for the JEOL 7600 FESEM. Interested parties must submit written evidence of their ability to fulfill the maintenance plan by 1:00 PM on March 31, 2025, via email to Shannon.Lynch@netl.doe.gov. Telephone responses will not be accepted, and the government retains sole discretion in determining whether to compete the requirement based on received submissions. The maintenance plan includes comprehensive services such as full functionality support, technical assistance, upgrades, no-cost equipment exchanges, and scheduled preventive maintenance. While the notice is not a formal request for quotes or proposals, it provides a mechanism for potential contractors to self-identify and prove their technical competence in servicing this specialized scientific equipment.
Notice text
Notice of Intent to Sole Source to JEOL 7600 FESEM Field Emission Scanning Electron Microscope Maintenance Plan
In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to JEOL for a JEOL 7600 FESEM Field Emission Scanning Electron Microscope Maintenance Plan because all major components for instruments specific to this manufacturer must be serviced and replaced by factory-trained technicians in order to avoid costly damage to the instrument and prevent injury to its users. The maintenance renewal includes full functionality, technical support, and upgrades, no cost exchange of equipment or loaner equipment, and scheduled preventive maintenance.
This is considered a sole source to JOEL because, to the best of the NETL’s knowledge and based on market research conducted JOEL is the only known source that can provide this type of service. No known potential alternate sources exist which could satisfy NETL's requirement.
This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 13:00 PM on 03/31/2025. Responses must be submitted in writing to Shannon.Lynch@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
