About this opportunity
The Department of Agriculture Rural Housing Service seeks judicial and non-judicial foreclosure legal services and related technical support covering North Carolina, South Carolina, and Arkansas, with quotes due October 1, 2026. This is an unrestricted procurement with no small business set-aside.
Place of performance is Washington, DC. The solicitation was originally posted July 24 with an August 10 deadline; Amendment 001 extended the deadline to October 1, 2026. Questions were due July 31, 2026.
The contractor must be a licensed law firm in good standing in at least one of the three required state jurisdictions, with teaming arrangements for coverage in other states where required. The scope covers foreclosure services (uncontested and contested), real estate owned services, mediation, eviction, bankruptcy services (Chapter 7 and 13), and deficiency judgment enforcement. The contractor must confirm title within 15 business days of case acceptance and achieve first legal filing within 90 calendar days. All attorneys must comply with applicable federal and state statutes, Rules of Professional Conduct, Fair Debt Collection Practices Act, and Debt Collection Act requirements.
Performance standards require 95% compliance with foreclosure timelines per HUD Handbook 4000.1 Appendix 6, 95% monthly report submission by the 10th calendar day, 95% eviction completion within three months of order receipt, and not exceeding one major compliance violation per quarter. The contractor must maintain commercially reasonable malpractice insurance and indemnify the United States for professional negligence.
Compensation is firm-fixed price with time-and-material rates for reimbursables. Foreclosure services invoice in two milestones at percentages varying by judicial status. Reimbursable costs include filing fees, title reports, and recording fees, capped at $4,000 per case unless pre-approved, with cumulative reimbursables capped at $2,500 per case. Over-and-above legal fees not to exceed $25,000 for the entire contract and reimbursable elements not to exceed $257,500 require prior written approval, billed in 1/10th-hour increments.
The NAICS code is 531390, Other Activities Related to Real Estate, with a small business size standard of $19.5 million. Non-small businesses must submit a subcontracting plan targeting 22 percent of total planned subcontracting dollars for small businesses. Evaluation will be conducted using technical approach (highest confidence rating preferred), fair and reasonable pricing, and past performance (acceptable or neutral), with pricing evaluated only after the highest technically rated offeror is identified. The Government intends to make one award as a firm-fixed price purchase order for a one-year period of performance. Quotations must be submitted via email to Dominique Davis at dominique.davis@usda.gov, with a 30-page maximum for technical approach and no more than 2 pages for past performance, and completion of the Price Workbook required.
