The Government anticipates awarding multiple IDIQs for this requirement.

Stucco repair and painting will account for approximately 50-percent of all specified façade systems.

The Government guarantees a minimum of $10,000 in task orders over the life of the contract. The anticipated amount of these Task Orders will range from approximately $250,000 to $5,000,000, depending on the specific design limitations, locations, and security parameters. It is anticipated the maximum dollar value of Task Orders issued under the Contract shall not exceed $10,000,000 per year; the total Contract amount over five years shall not exceed $25,000,000.

2. Contract Solicitation

Contract solicitation will consist of two phases. First phase seeks pre-qualifications of Offerors interested in performing Construction Services for the building envelope, roofing, and waterproofing services at Foreign Service Posts worldwide. The second phase formally requests Offerors to forward technical and past performance qualifications for evaluation and selection. Only Offerors prequalified in Phase I are eligible for participation in subsequent Phase II and/or for award. The structure of the Offeror must remain the same throughout each subsequent Phase.

Phase I – Omnibus Pre-Qualification of Offerors

Phase I Pre-Qualification Instructions:

Submission Requirements for Phase I, Pre-Qualification of Offerors: Offeror shall submit sufficient documentation to allow DOS to evaluate its capabilities on the pre-qualification criteria. Submissions that are missing information or otherwise do not comply with the submission requirements may be eliminated from consideration at the Contracting Officer’s determination.

Offeror shall show on their capability statement any licenses, registrations, or other certifications as a display of firm’s incorporation, professional quality, technical accuracy, and the coordination of construction services, as well as awards and other indicators of high-quality performance.

Firms submitting information for Phase I qualification shall address the following criteria To demonstrate performance of similar construction work for Omnibus Diplomatic Security and Antiterrorism Act of 1986 purposes, the offeror needs to provide pre-qualifications demonstrating that it has successfully completed similar projects in the United States or at a Foreign Service Post of at least three building envelope, roofing, and/or below grade waterproofing construction contracts or subcontracts in the past five (5) years involving work of the similar complexity and having a contract or subcontract value of at least $1 million. The Offeror must complete and submit as part of its pre-qualification package the pamphlet "Certifications Relevant to Public Law 99-399, Statement of Qualifications for Purpose of Section 402 of The Omnibus Diplomatic Security and Antiterrorism Act of 1986." (The pamphlet is attached to this SAM.gov announcement and may be obtained from the DOS Contract Specialist listed at the end of this notice.) If a Joint Venture (JV) is formed, the company having 51 percent or greater interest in the JV must be the one completing the pamphlet and meeting the “U.S Person” definition/criteria. The exact legal entity that prequalified under the Omnibus Act as a “U.S. Person” (Prime or JV) will be the entity that is eligible to be considered under Phase 2 and for award.

The U.S. person co-venturer will be required to sign a guarantee making the U.S. person individually responsible for performance of any contract awarded, notwithstanding the terms of any joint venture agreement.

Phase I Additional Eligibility Requirements:

SAM registration is not required for purposes of pre-qualification but please note the pre-qualified entity should be the same offeror/entity submitting a proposal in response to the subsequent and Phase II proposal submission. Pre-qualification is distinct from eligibility for contract award and the Omnibus Certification is distinct from the Security Clearance Requirements. Specific requirements for security clearance and eligibility for award will be set forth in the Solicitation.

To the extent the Offeror anticipates proposing two or more entities or related entities to perform under the contract and to meet the stated requirements of the Solicitation and/or the Omnibus Act “U.S. Person” criteria, the Offeror should be structured as a formal joint venture (JV), or prime/subcontractor and the Offeror (formal JV or Prime) should be registered in SAM prior to Phase II proposal submission. The exact legal entity that prequalified under the Omnibus Act as a “U.S. Person” (Prime or JV) will be the entity that is eligible to be considered under Phase 2 and for award. Also, the Offeror itself should possess a security clearance or be able to obtain one in accordance with the terms of the Solicitation (NOTE: Security clearance requirements are not the same as prequalifying as a “US Person” under the Diplomatic Security Act).

The time to register a new entity on SAM.gov may vary, therefore any firms not actively registered should start the registration process early. An active entity registration of the prequalified offeror on SAM.gov is required by the Phase II proposal due date of the RFP. If the prequalified offeror fails to obtain final registration in SAM.gov by the RFP’s proposal due date, the submitted proposal will not be evaluated and will not be considered for award.

Phase II – Requests for Proposals from Pre-Qualified Offerors

Phase II General Instructions:

Those Offerors determined to be pre-qualified in Phase I in accordance with this notice will be issued a formal Request for Proposal (RFP) for the project and invited to submit technical and pricing proposals in Phase II. Only Offerors prequalified in Phase I are eligible for participation in subsequent Phase II and for selection. The business structure of the Offeror must remain the same throughout each procurement Phase. The exact legal entity that prequalified under the Omnibus Act as a “U.S. Person” (Prime or JV) under Phase 1 will be the entity that is eligible to be considered under Phase 2 and for award.

Phase II proposals shall provide pricing for fixed loaded rate labor categories for all cleared personnel performing construction services. After contract award for construction services, task orders will be “firm fixed price” based on the contract labor rates plus materials, project logistics, and travel costs. Construction services will include providing construction labor and materials to execute the design; on-site organization with management to ensure overall project coordination; and overall control throughout the life of the project. Required services include preparation of product data documents, quality control plans, safety plans, project schedules, and project close-out activities.

In Phase II, offerors shall be required to submit a technical proposal addressing specific evaluation factors: 1) Demonstrated Experience; 2) Technical/Management Approach; 3) Safety Program and 4) Past Performance. Failure to address each evaluation factor may result in failure to be selected. The Government reserves the right not to award any offeror receiving less than a satisfactory rating in all Evaluation Factors.

Offerors responding and accepted under Phase I will be sent a formal Request for Proposal.

Security Clearance Requirement:

In order to be eligible to perform under this contract, the pre-qualified firm(s) must be able to obtain and possess a Defense Security Service (DSS) Secret or Top Secret facility security clearance (FCL) with Secret safeguarding capability, issued in accordance with the National Industrial Security Program Operating Manual (NISPOM), DoD 5220.22-M. Offerors already possessing the necessary FCL must submit their appropriate Commercial and Government Entity (CAGE) Code, facility clearance and safeguarding level with the required pre-qualification documentation.

If an Offeror does not possess the necessary FCL, DOS will sponsor the firm for an FCL at the time the Offeror is determined to be pre-qualified. DOS will allow 120 calendar days from the notice of pre-qualification for firms to obtain the necessary FCL. Firms will not receive the classified portions of the Phase II RFP until they have been issued the appropriate FCL and received Defense Counterintelligence and Security Agency (DCSA) approval to safeguard classified documents. DOS sponsorship does not guarantee that the Offeror will receive the FCL, nor that it will be received within the 120-day period. The Government will not be obligated to extend its solicitation schedule, or to make an award to a sponsored, pre-qualified firm, if that firm has not been issued an FCL.
