About this file
The Worker Protection Form is a certification document issued by the Commonwealth of Pennsylvania, specifically addressing worker protection and investment standards for contractors and grantees. The form requires businesses to certify compliance with various Pennsylvania state labor and workforce safety laws, including thirteen specific statutes such as the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, and Equal Pay Law.
The document outlines significant legal consequences for non-compliance, including potential contract termination and a three-year debarment from bidding on future Commonwealth contracts. Contractors must sign and certify their adherence to these labor laws, with an understanding that any changes in compliance status must be immediately reported to the Purchasing Agency. The form, published on February 7, 2022, carries legal weight under 18 Pa. C.S. § 4904, which addresses unsworn falsification to authorities, thereby creating a legally binding mechanism to ensure worker protections across Pennsylvania's state contracts.
