About this file
This is a Worker Protection and Investment Certification Form (BOP 2201) issued by the Commonwealth of Pennsylvania in accordance with Executive Order 2021-06, applicable to contractors and grantees working with Pennsylvania state agencies, including PennDOT. The form requires all contractors to certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and thirteen specified state labor and workforce safety laws, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and the Construction Industry Employee Verification Act, among others. Contractors must have a duly authorized official execute the certification form, confirming the contractor's compliance status with all applicable labor laws and regulations. Contractors are required to report any changes in their compliance status to the purchasing agency immediately.
Submission of false certifications carries significant penalties under Pennsylvania law, including contract termination and three-year ineligibility to bid on future Commonwealth contracts under 62 Pa.C.S. § 531 (Debarment or Suspension). Additionally, false certifications are subject to penalties under 18 Pa.C.S. § 4904 (Unsworn Falsification to Authorities). The certification must be signed and dated by the authorized certifying official, with the contractor/grantee name and official title clearly printed on the form. This certification requirement applies to the On Call Vegetation contract for PennDOT Engineering District 12-0, which is restricted to certified small businesses eligible under the Small Business Procurement Initiative (SBPI) established by Executive Order 2011-09.
