About this file

This is a Warranty Bond form document issued by the City of Napa, a California charter city, for use in its public works contracts. The bond serves as a guarantee that contractors will perform warranty obligations on completed projects, covering defects in materials and workmanship discovered during a one-year warranty period commencing with the City's acceptance of the project. The bond is specifically designed for the Citywide Striping - Phase 2 Project, with sealed bids due by Friday, August 7, 2026, at 12:00 pm via electronic submission through the City's procurement portal at https://procurement.opengov.com/portal/cityofnapa.

The warranty bond is set at a maximum amount of 15% of the final contract price unless otherwise specified in the contract documents. The contractor and its surety are jointly bound to the City as obligee, with the surety waiving provisions under California Civil Code sections 2819 and 2845. If the contractor fails to repair or remedy defects discovered during the warranty period at its own expense, or fails to promptly reimburse the City for losses sustained due to such failure, the surety remains fully liable. The bond is governed by California law with venue in Napa County Superior Court, and the surety is responsible for the City's attorneys' fees and costs in any enforcement action. The bond becomes effective on a date to be specified and requires signatures from the surety (with notary acknowledgment and power of attorney), contractor, and City approval.
