52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
EVALUATION FACTORS
The Government will assess its level of confidence that vendor’s quote will successfully perform all requirements regarding the technical capabilities of the Xray machine, vendor’s past performance, and delivery and site-specific requirement’s narrative.
The evaluation factors will measure the Government’s confidence that the quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract.
Quoters shall provide sufficient information for the Government to determine its level of confidence in the ability of the Quoter to perform the requirements of the RFQ based on an assessment of relevant experience from the contractor.
Basis for Award
The Government will assess its level of confidence that the contractor will successfully perform the requirements based on their experience performing similar magnitude of work. The Government intends to award one contract to the responsible quoter whose quote is determined to be the best value to the Government. Selection of the best value to the Government will be achieved through a process of comparative evaluation of all quotes against the evaluation factors described below.
Quotes will be evaluated solely on the factors specified in the solicitation. The contracting officer will conduct a comparative evaluation of offers against the evaluation factors in this section to determine the quoter’s ability to perform the contract. Award will be made to that quote deemed fair and reasonable resulting in the best value to the government in accordance with FAR 13.106- 2(b)(3).
Factor 1: Technical Capabilities (non-cost/price factor)
The Government will evaluate the degree to which the technical and management approach demonstrates a thorough understanding of the requirements and provides a viable plan and means for successful completion, including installation, training, methodology for completion of the work, and quality assurance procedures. The Government will also evaluate how the offeror plans to assess difficulties and risks it may encounter, and how the offeror plans to deal with them while still successfully performing the work.
Technical Capabilities Submission Instructions: (Not to exceed 50 pages) The quoter shall provide information to facilitate the Government’s consideration. The contractor shall provide:
- Detail Xray Machine specifications that meets or exceeds specifications listed at PWS paragraphs 1.4 & 5 1.2 & 4.
- Provide a commercial warranty that covers the lifespan of the unit and is consistent for all the Xray components.
- Ability to provide Instructor Led Training (ILT) at Guantanamo Bay, Cuba upon installation of the unit to familiarize the users with the basic functionality of the unit.
Factor 2: Past Performance (non-cost/price factor)
The Government will evaluate relevant and recent past performance information obtained from the quoter performing work similar in scope, size, and complexity to the outlined in the Performance Work Statement. The information will be evaluated to assess the quoter’s potential success in performing the work required by the contract. The Government will evaluate recent past performance information for contracts that are currently being performed or have a period of performance end date within the last five (5) years from the original solicitation issuance date.
No record of past performance. If the quoter do not have a record of relevant past performance or if information is not available, the quoter will be evaluated neither favorably nor unfavorably.
Terminations. The Government may consider contracts of the quoter, (1) were terminated for default, (2) terminated for cause over the preceding five (5) years from original solicitation issuance date, including the reasoning for the aforementioned actions.
Source of Past Performance. The government may consider past performance information from sources other than those provided by the quoter, such as commercial and government clients, government records, regulatory agencies, and government databases such as the Government’s Contractor Performance Assessment Reporting System (CPARS). The Government may contact any or all of the references provided by the quoter and will consider such information obtained in its evaluation.
Evaluation Factor Submission Instructions: The offeror shall provide past performance information for no more than three (3) of the most relevant contracts performed for Federal agencies, state/local governments and/or commercial customers within the last five (5) years from the issue date of this RFQ or currently being performed. Relevant contracts include contracts similar or greater in scope, magnitude, and complexity than the effort described in this RFQ. The Offeror shall provide a Contractor Performance Assessment Report (CPAR) for the referenced project, if one is available. If a CPAR is not available, the Offeror shall submit a Past Performance Questionnaire (PPQ) signed by the customer reference (see attachment PPQ attached below). PPQs shall not be sent directly to the Contracting Office soliciting this requirement; it is the responsibility of the Offeror to include the completed CPAR and/or PPQ as part of its quote.

The quoters shall include a delivery narrative addressing delivery, security requirement, and base access to complete the contract effort.
a. Delivery: Shall comply with Barge Shipping Instructions included in the solicitation.
