Subfactor 3:
Key Personnel Qualification
We have a question on your following answer for Modified Solicitation, "Valid certification shall be in the form of an accredited ROK institution. The government cannot specifically state what the certificate must state as there are several ROK accredited institutions. Certification proof must be submitted in English."
For both Certificates and Proof of experience, we need to submit Certified Translation?
Is it allowed that we add the English translation in handwriting only in copied Certificates?
The government will accept a "communications" certificate from any accredited instution within the ROK. The government must be able to read and understand the certificate therefor it must be provided in English. A translated certified certificate is acceptable.
Subfactor 1:
Prime
Contractor's Business
Registration
If the contract is for Maintenance and Repair of Electronic Security System Closed Circuit Television (CCTV), what is the basis for the requirement of "Registration for Repair for internet and computing technologies, networking and telecommunications, and radio in its entirety?
We understand the evolution of technology and digital video recording on computer platforms. One of our members installed most of the CCTV on the Korean peninsula. CCTV is closed circuit CCTV. We understand that there could be Internet connectivity, but the internet repair falls under other organizations (e.g., KT, LG, SK, and the Signal organization). If the system runs over fiber optic, it is still closed circuit. CISCO repairs or replaces lowest replaceable units (LRU) in its equipment, the same for Bosch. Therefore, it is not understood why the government agency is requesting registration certificates/certifications in all of the areas or in the way that it is being required. Is there a legal requirement? Particularly, if radio or Internet become issues
The government will accept a Business Registration in the form of Electronic Security Systems or maintenance and repair of Closed Circuit Television systems.
it is not the main focus of the title of the contract and could be satisfied through sub-contracting or the appropriate organization.
If this is the licensing certificate(s) held by the current contractor, We see no technical reason for the requirement tied to the prime contractor.
General The amendment 0002 says that
1. Change CLINs 0001, 1001, 2001, 3001, 4001, 0003, 1003, 2003, 3003, and 4003 to Requirements CLINs.
It means the Qty will be Estimated quantity?
Yes.
PWS para 3.13
Para. 3.13.: Do you have any specific information to include in PMP?
The awarded contractor will be responsible for preparing the PMP.
Reference FAR Clause 52.245-1 for requirements of the PMP.
General CLINs 0004, 1004, 2004, 3004, 4004 are deleted. Should the cost of the parts be included in CLINs 0001, 0002, 0003 and option CLINs? Do you still require separate price lists of Appendix B by each year?
The cost of parts should be included in the Corrective Maintenance (CM) CLINs and Emergency On-Call CLINs. Appendix B shall be completed by the Offeror for each year.
The following have been modified:
ADDENDUM TO FAR 52.212-1
ADDENDUM TO FAR 52.212-1, INSTRUCTIONS TO THE OFFEROR(S)
NOTICE TO OFFERORS
All sources may submit a proposal or quote as applicable. However, the Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA), precludes the U.S. Government from granting Invited Contractor or Technical Representative status to any offeror, for this requirement. 4.0. SUBMITTAL REQUIREMENTS
FACTOR A TECHNICAL:
Subfactor 1: Prime Contractor’s Business Registration – The offeror shall submit a copy of both English and Korean version of the Prime Contractor’s Certificate of Business Registration for the business item category of “Electronic Security Systems and Closed Circuit Television (installation, repair, and maintenance)” issued by the Republic of Korea (ROK) Government Nation Tax Service (NTS). The issuance of the certificate date must be within one (1) year from the release date of this solicitation. Any other business registration otherwise specified above will not be acceptable.
Note: Only the Prime Contractor’s Business Registration will be considered for this qualification requirement.
Submission of subcontractor’s business registration cannot be substituted for the prime contractor’s business registration and will not be considered technically acceptable.
Subfactor 2: Prime Contractor’s Prior Experience – A minimum two (2) years prior experience in inspection, repair and maintenance (ITM) of CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of services within the last seven (7) years as of closing date of the solicitation. The experience of a subcontractor cannot be substituted for the prime contractor’s experience.
Subfactor 3: Key Personnel Qualification:
NOTE: A resume shall be submitted for each key personnel listed below:
a. Contract Manager (CM)
-Prior Experience: A minimum of two (2) years working experience within the last seven (7) years as of closing date of the solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience.
b. Communications Technician (CT):
- Prior Experience: A minimum of two (2) years working experience within the last seven (7) years as of closing date of the solicitation as a CT on similar projects . CT must be experienced with fiber based closed security networks and be able to program a CCTV head-end system for multiple remote viewing locations.
- Certificate: A valid communication certificate from an accredited ROK institution.
c. Technicians:
- Prior Experience: A minimum of one (1) year working experience within the last seven (7) years as of closing date of the solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience.
- Note: Contractor shall provide a minimum of three (3) technicians to meet the requirement of the
PWS.
FACTOR B PAST PERFORMANCE:
Past performance shall be evaluated on an acceptable/unacceptable basis.
The following ratings will be used in evaluating Past Performance:
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below).
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
Offerors are authorized to provide information on the problems encountered on the identified contracts and the offeror’s corrective action. The offeror shall have recent and relevant past performance in the same or similar projects related to this requirement. Recent past performance is within the last seven (7) years from the solicitation issue date. Relevant past performances are those that are the same or similar services based on size, scope, complexity, and contract type.
Past Performance of offerors will be evaluated based on the following processes:
1. Review of the detailed explanation submitted by offerors, demonstrating the relevance of the references to the requirements of the solicitation.
2. References will be contacted by phone to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
3. The Government reserves the right to obtain past performance information from any reasonable source available, including the Government database; Contractor Performance Assessment Reporting System (CPARS) website http://www.cpars.gov in order to evaluate offerors’ past performance.
Note: As part of the Responsibility Determination, the Contracting Officer will evaluate past performance to determine the offeror’s capability to perform the contract. Failure to submit data or lack of any performance history will not in itself be a reason for determination of non-responsibility. The Contracting Officer is not limited to the information provided. The Contracting Officer may use this data along with data obtained from other sources the Contracting Officer determines appropriate to obtain sufficient information on the offeror’s past performance to make a responsibility determination
FACTOR C PRICE:
Price analysis will be conducted for each proposal to ensure completeness, price realism, price reasonableness and unbalanced pricing.
The following applies to that evaluation:
1. Completeness. The Offeror shall complete the pricing information for all CLINs and Sub-CLINs identified for all five (5) years. Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.
2. Price Realism. Price Analysis in conjunction with Technical Analysis will be used to perform a Price
Realism Analysis to determine if the price is realistic for the work to be performed. The proposal will be evaluated using price analysis techniques to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is realistic for the work to be performed and is consistent with approaches described in the technical proposal. Price proposals, which are unrealistically low, will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal.
3. Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, previous prices for same or similar services and/or when compared among other technically acceptable offers.
4. Unbalanced Pricing. As part of the price evaluation, proposals will be reviewed to identify any unbalanced pricing. IAW FAR 15.404-1(g)(3), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.
Note 1: The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy-in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.
Note 2: Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period five (5) years from the date of award. Price shall include all CLINs and Sub- CLINs as listed on the Price Schedule, including all five (5) years. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
Option Clause 52.217-8. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period price to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the 1st year, 2nd year, 3rd year, 4th year, 5th year, and one-half of the 5th year. Offerors are required only to price the five (5) years.
Offerors shall not provide a price for the potential one-half year extension of services period.
5.0. SITE VISIT
Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the price of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Attendess must bring a Korean Idenitification Card (주민등록증) to attend the site visit. The site orientation schedule is as follows:
Camp Casey
Date: 27 April 2022, Time: 1000 AM Meeting Location: Camp Casey Pedestrian Gate. https://waze.com/ul/hwydreqb2r POC: Bob Aldridge Tel No.: (DSN) (315) 755-8036, (Comm) 0503-355-8036 E-mail Address: robert.l.aldridge2.civ@army.mil
NOTE: Any offeror(s) who are interested in participation of the site visit shall present at the Camp Casey Pedestrian Gate no later than the above indicated time and date and also provide a list of attendant’s information (Contractor name, attendant name and telephone number, ROK ID number) to POC through e-mail 48 hours prior to the site visit for the installation access process. No vehicles will be allowed onto the installation.
The CCTV system is in close proximity to the Pedestrian Gate. Due to limited access on specific military installations, it is requested that each Contractor send no more than two (2) representatives.
6.0. PRE-AWARD SURVEY:
A pre-award survey may be conducted on any firm, to include joint venture partners and subcontractors indicating firm commitments to this acquisition, submitting offers. The pre-award survey is to determine the prospective Contractor’s responsibility in accordance with FAR Part 9.104-1. Information may be requested as required by the Contracting Officer and the information shall be submitted within three working days of the request.
End of ADDENDUM TO FAR 52.212-1 INSTRUCTION TO OFFERORS – COMMERCIAL ITEMS (NOV 2021)
ADDENDUM TO FAR 52.212-2
ADDENDUM TO FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021)
EVALUATION CRITERIA
In accordance with FAR Parts 12 and 13, award will be made to the responsible Offeror submitting the Lowest Priced Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.
The following ratings will be used in evaluating all non-price factors and subfactors except Past Performance:
Acceptable Proposal meets the requif the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Factor A. Technical Capability: All technical factors shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor will result in a technically unacceptable rating. Failure to provide the below requirements will result in a rating of “Unacceptable”.
Prime Contractor’s Business Certificate of Registration: The prime contractor shall posess and submit the copies of both English and Korean versions of the following valid and current business certificates;
NOTE: A resume shall be submitted for each key personnel listed below:
d. Contract Manager (CM)
-Prior Experience: A minimum of two (2) years working experience within the last seven (7) years as of closing date of the solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience.
e. Communications Technician (CT):
- Prior Experience: A minimum of two (2) years working experience within the last seven (7) years as of closing date of the solicitation as a CT on similar projects . CT must be experienced with fiber based closed security networks and be able to program a CCTV head-end system for multiple remote viewing locations.
f. Technicians:
- Prior Experience: A minimum of one (1) year working experience within the last seven (7) years as of closing date of the solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience.
- Note: Contractor shall provide a minimum of three (3) technicians to meet the requirement of the
PWS.
Factor B. Past Performance: Past performance shall be evaluated on an acceptable/unacceptable basis.
4. Review of the detailed explanation submitted by offerors, demonstrating the relevance of the references to the requirements of the solicitation.
5. References will be contacted by phone to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
Factor C. Price.
Price analysis will be conducted for each proposal to ensure completeness, price realism, price reasonableness and unbalanced pricing.
The following applies to that evaluation:
5. Completeness. The Offeror shall complete the pricing information for all CLINs and Sub-CLINs identified for all five (5) years. Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.
7. Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, previous prices for same or similar services and/or when compared among other technically acceptable offers.
