About this file

This file is a Request for Information (RFI) and Questions and Answers document related to a follow-on rental equipment contract for Joint Base San Antonio-Fort Sam Houston (JBMHH). The RFI addresses two primary inquiries from potential contractors regarding contract structure and performance requirements.

The first question clarifies that the Government will accept offers from prime contractors utilizing qualified mechanical service subcontractors, provided that all contract requirements are met. However, contractors must comply with the 50 percent subcontracting limitation outlined in FAR 52.219-14(e)(1), which applies to this NAICS 532310 services contract. This means prime contractors cannot pay more than 50 percent of the Government's contract payment to non-similarly situated subcontractors. The second question and answer addresses the four-hour response standard for equipment repair or replacement, confirming that contractors must provide either a repaired or replacement operational unit within four hours of notification of equipment failure. The answer indicates that local licensing and equipment-specific service credentials may be required, though specific details are deferred to the full solicitation documents. The underlying opportunity involves providing eight outdoor heaters and eight misting fans for seasonal exchange at JBMHH access control points, with the contractor responsible for equipment placement, maintenance, diagnostics, repairs, replacements, and recovery, while the installation provides fuel, water, and electricity.

RFI FOR JBMHH RENTAL EQUIPMENT FOLLOW-ON AWARD

1. Would the Government consider a prime contractor providing the rental equipment with a qualified mechanical service subcontractor?

ANSWER: The government will consider a contractor with a qualified mechanical subcontractor as long as the requirements can be met.

Please note the requirements as per RFO FAR 52.219-14 (e) (1):

(e) By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for NAICS 532310.

(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

2. Please also clarify whether the four-hour standard requires full repair or replacement within four hours of notification and whether any local licensing or equipment-specific service credentials will be required.

ANSWER: Regarding the four-hour standard requires full repair or replacement within four hours of notification and whether any local licensing or equipment-specific service credentials will be required: The contractor can either repair or replace the item as long as there is an operational unit within 4 hours of notification.
