The Offerors' initial offer should contain the best terms from a price and technical standpoint. The Government may reject any or all offers if such action is in the public interest.

The Government will not be responsible for any failure of transmission or receipt of the quote or sample, or any failure of the offeror to verify receipt of the quote or sample. Offeror Questions and Clarifications: Any questions, comments or clarifications concerning any aspect of the solicitation shall be submitted in writing via e-mail to the Contract Specialist MAJ Tavon Cooper at tavon.m.cooper.mil@army.mil and the Contracting Officer LTC Paul Kilgore at paul.m.kilgore.

Addendum to Evaluation - Commercial Product and Commercial Services

Miscellaneous text in this section has been modified to:

52.212-2 Addendum

:EVALUATION CRITERIA

Basis of award will be made in accordance with FAR Subpart 13.106-2 to identify the offeror whose proposal is more likely to deliver the best value to the Government, considering both non-price factors and price. The Government will select the best overall proposal based upon an integrated assessment of two (2) evaluation factors: Technical Capability and Price.

FACTORS TO BE EVALUATED

The following factors shall be used to evaluate offerors: Factor I, Technical Capability is significantly more important than Factor II, Price. To receive consideration for award, a sample must meet the criteria specified in paragraphs 5 and 6 of the Statement of Work, at a minimum.

As a basis for award, trade-offs between price and non-price factors are permitted. Therefore, the Government reserves the right to award to other than the lowest price. However, the degree of importance of price as a factor in determining award could become greater depending on the equality of the proposals evaluated in the non-price factors. The greater the equality of proposals within the non-price factors, the more important price becomes in selecting the best value to the Government. The Government will evaluate proposed prices for reasonableness using cost and/or pricing analysis techniques. The Government intends to award one contract as a result of this solicitation.

FACTOR 1: TECHNICAL CAPABILITY

The Government will evaluate the extent to which the Offeror's methods and approach have adequately satisfied the requirements and/or exceeded specified in the RFQ. The sample will be evaluated based on the criteria specified in paragraphs 5 and 6 of the Statement of Work and AATCC TM20-2021 test result.

FACTOR 2: - PRICE

The total price will be computed by adding the total for all Ordering Period CLINs on the Standard Form (SF) 1449 to determine the Offeror's Total Evaluated Price (TEP). The TEP will be assessed in accordance with the guidelines in FAR 15.404 to determine that the price is fair, reasonable, and balanced.

Price will not be scored or rated; therefore, no adjectival ratings will be used to evaluate price.

(End of Addendum)

5152.233-4000 AMC-LEVEL PROTEST PROGRAM (Feb 2014) (LOCAL CLAUSE)

Prior to submitting an agency protest, it is preferable that you first attempt to resolve your concerns with the responsible contracting officer. However, you may also file a protest to the Headquarters (HQ), Army Materiel Command (AMC). The HQ AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 35 calendar days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the HQ AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below.
