SUMMARY OF CHANGES

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

SUBMISSION INSTRUCTIONS

SUBMISSION INSTRUCTIONS

1. GENERAL INSTRUCTIONS

In order to be considered for award, each offeror shall submit their proposal(s) in accordance with these instructions.

The Government may reject proposals and not give it consideration in the source selection process if the offeror fails to adhere to these instructions.

Each volume shall be submitted electronically via email. Offerors shall deliver the written portion of the proposals electronically to the Contract Specialist, John Harvey at john.a.harvey1.civ@army.mil and Contracting Officer, Theresa Quick at theresa.s.quick.civ@army.mil. No hard copies will be accepted.

NOTE: Due to the possibility of e-mail transmission errors, immediately before e-mailing the documents, offerors shall provide an e-mail message stating their intent to begin e-mailing their files; the e-mail message shall include the name of each file being e-mailed. Due to the size and complexity of the files and proposal, offerors may need to transmit their proposal files using several, separate e-mails. The Government strongly cautions offerors against waiting until the last minute to submit their proposals.

Offerors shall use Microsoft Office 2013 software or higher to create the required files. Adobe Acrobat Version XI or higher shall be used to create .pdf files. If files are too large to email, vendors are to use the DoD SAFE site (https://safe.apps.mil/) for sending these large files. Each volume shall be clearly labeled with its appropriate title. The proposals must be divided into six (6) volumes.

In order to reduce proposal size, offerors shall submit only essential matters sufficient to clearly present their approach and provide an adequate basis for evaluation. The Government is limiting Volumes I and III of the proposal. The Government may not evaluate information contained on any excess pages. This limit does not apply to the complete, unaltered test reports that the Government requires to accompany the Technical Proposal. The offeror shall deliver all official test reports unaltered in .pdf with a signature from the test laboratory. In addition to the unaltered official test reports, offerors shall submit the data they contain in a separate, unaltered Excel file. The Government will count any physical submissions with print on both sides as two (2) pages. Offerors shall not reduce the size of drawings or other graphics to the extent that legibility is lost. The Government will not attempt to intuit or interpret illegible drawings or graphics. The offerors shall ensure that pages containing text are typewritten, on 8 ½ x 11 inch paper, single spaced with a minimum of twelve (12) point font, and one (1) inch margins. The offeror shall appropriately number and identify each page with the complete company name, date, and solicitation number in the header or footer, or both the header and footer. The price proposal does not have a page limitation.

The offeror shall not include any references to price within the Technical Proposal.

Proposals must remain valid for a period of one hundred eighty (180) days from the closing date of the solicitation.

The Government advises offerors to submit any questions for clarification or explanation to the ACC-APG Point of Contact (POC) provided for in the solicitation.

The following electronic files shall be submitted:

RFP Number: W91CRB-21-R-0002 Submission Date/Time: (required) Offerors Name: (required)

**Note: Due to limited staffing physically located in Building 328T, it is requested offerors provide a way to track delivery of PDMs to insure proper personnel are available to receive delivery.

Offerors must comply with all instructions. The Government will consider how well offerors complied with these instructions when evaluating capabilities to perform the prospective contract. Each offeror must submit a single, complete proposal that contains the offeror’s best terms. If the offeror fails to adhere to these instructions, the Government may reject the offer without evaluation or consideration for award. The Government cautions offerors that "parroting" of the technical requirements or the Statement of Work (SOW) with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. The Government will not make assumptions, and except where noted explicitly in Section IV, the Government will limit its evaluation of each offer to the information provided in the proposal. The evaluators will utilize the offeror’s response to the solicitation as a vehicle for validating the offeror’s understanding and capability to perform as it relates to each of the evaluation criteria.

The Government presumes that the offeror’s proposal represents the offeror’s best effort to respond to the solicitation. The offeror shall explain, in the proposal, all inconsistencies, whether real or apparent, between promised performance and price. The Government may reject the proposal for unexplained inconsistencies resulting from the offeror’s lack of understanding of the nature and scope of work for the overall solicitation or a lack of demonstrated financial ability to perform the contract.

The Government advises offerors that prior to award the Government may, at its discretion, incorporate portions of the successful offeror’s proposal, including information provided by the offeror during discussions, into the contract.

2. USE OF NON-GOVERNMENTAL ADVISORS

The Government advises Offerors that employees of the contracted firm identified below may serve as non-government advisors in the proposal evaluation process. The Government will restrict contracted employee access to only those portions of the proposal data and related discussions necessary to perform their respective advisory duties. Non-government advisors are not voting members during the evaluation process.

F. VOLUME VI – SOLICITATIONS, OFFER AND AWARD DOCUMENTS

Offerors shall name the file as [CompanyName]SOAD.doc (or .pdf or .xls)

Each offeror shall complete (fill-in and sign) the solicitation sections indicated below using the file (without modification to the file) provided with the RFP. An authorized official of the firm shall sign the SF 33 and all certifications requiring original signature. An Acrobat PDF file shall be created to capture the signatures for submission.

Section A – Standard Form 33 (SF 33), Solicitation, Offer and Award

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

EVALUATION FACTORS FOR AWARD

A. BASIS OF AWARD

Awards will be made based on the best overall (i.e., best value) proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to the five (5) evaluation factors: Technical, Cost/Price, Past Performance, Small Business Participation, and Quality Assurance. An award may not necessarily be made to the offeror with the lowest price or the offeror with the highest technical rating. The Technical factor is significantly more important than the Cost/Price factor. The Past Performance, Small Business Participation, and Quality Assurance factors are all equal to each other. Past Performance, Small Business Participation, and Quality Assurance will be evaluated as “Acceptable or Unacceptable”. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for all factors and sub-factors.

Prior to award, the offeror(s) must be determined eligible in accordance with the following:

Apparent awardees must be deemed responsible in accordance with FAR 9.1.

Any offeror other than a small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with FAR 19.702(a).

The Small Business Subcontracting Plan is not a requirement for evaluation in source selection, but rather a requirement for award to a large business, and the Government will incorporate it into any resultant contract. If the offeror is a large business, the offeror must submit a Small Business Subcontracting Plan. This plan is only required from an offeror which is itself other than a SB, SDB, WOSB, HUBZone SB or SDVOSB. The Small Business Subcontracting Plan describes the offeror’s approach to maximizing opportunities for small businesses in this effort, relative to the subcontracted portion’s value. The following references establish the required elements of the SB Subcontracting Plan: FAR 52.219-9, DFARS 252.219-7003. Offerors must address and organize the submission to ensure the proposal addresses each of these elements. The offeror also shall specifically identify all small businesses and historically black colleges or universities and minority institutions included in the Small Business Subcontracting Plan. The offeror shall provide the CAGE code or DUNS number for each proposed subcontractor and include identification of the NAICS code (appropriate to the principal nature of the planned subcontract) supporting each proposed subcontractor’s size status. This information must correlate with all other offeror submitted information and plans.

The Small Business Subcontracting Plan Objectives represent the percentage of the offeror's subcontracting budget allocated for subcontracting with small businesses. The offeror must consider the Government's subcontracting target objectives for this acquisition as follows:

Small Business 15.0% Small Disadvantaged Business 5.0% Women-Owned Small Business 3.6% HUBZone Small Business: 1.3% Veteran Owned Small Business 5.0% Service Disabled Veteran-Owned Small Business 3.0%

An unacceptable subcontracting plan will make an Offeror ineligible for award of a contract.

B. EVALUATION APPROACH

1. The overarching evaluation approach for all factors and sub-factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

c. Performance of Product Demonstration Models (PDMs). The PDMs will be evaluated in each sub-factor to assess the technical capabilities of the offeror’s proposed BCS through inspection and testing. The Offeror must ensure that the PDMs fully demonstrate all technical capabilities and potential to meet BCS requirements.

The Government will evaluate PDMs in accordance with the BCS PD; Section(s):

a. 3.1 1 Material Components and 4.1 Material Components Verification,

b. 3.2 Design (3.2.2 and 4.2.2 Finished Weights & Measurements) and 4.2 Design Verification,

c. 3.3 Construction (3.3 and 4.3.3 End Item Visual Inspection) and 4.3 Construction Verification,

d. 3.5.1 Areal Density and 4.5.1 Areal Density Verification,

e. 3.5.2 Thickness and 4.5.2 Thickness Verification, and

f. 3.5.3 Flexibility and 4.5.3 Flexibility Verification.

2. Factor I – Technical: The offeror’s technical solution will be rated separately from the risk associated with its technical approach. The technical rating evaluates the quality of the offeror’s technical solution for meeting the

Government’s requirement. The risk rating considers the risk associated with the technical approach in meeting the requirement.

The Technical factor is divided into the following six (6) sub-factors:

Sub-Factor A – Design and Workmanship (Outstanding, Good, Acceptable, Marginal or Unacceptable): This sub-factor evaluates the PDMs to ensure a standardized, repeatable design, and workmanship quality of the PDM submittals. Marginal levels of overall design and workmanship could indicate a lack of understanding concerning mission requirements and will result in the entire proposal not being considered for award. The evaluation will focus on the offerors’ design and workmanship with regards to the pattern adherence, Purchase Description (PD) adherence, and standardization processes.

The Government will evaluate the offeror’s BCS PDMs (complete samples submitted as required by Table 5 and submitted data from independent laboratories) as to how well they meet the Government’s requirements using the following sections of the BCS PD:

a. 4.1 Materials and Components Verification

b. 4.2 Design Verification (4.2.2 Finished Weights & Measurements Verification and Table XXI End Item dimensional examination); and

c. 4.3 Construction Verification (4.3 & Table XXIII End Item Visual Defects);

Based on the assessed defects, the Government will apply the following ratings:

Table 5 Design and Workmanship Evaluation Ratings Rating Description

Outstanding Zero defects cumulative across all PDMs is considered Outstanding Good One - Four minors cumulative across all PDMs is considered Good

Acceptable Five - Seven minors, cumulative across all PDMs is considered Acceptable Marginal Eight minors, cumulative across all PDMs is considered Marginal

Unacceptable One major or Nine or more minors, cumulative across all PDMs is considered Unacceptable.

Minor and major defects are identified in the PD in the defect tables XXII through XXIII under classification for each defect.

Any rating less than Acceptable in Design and Workmanship will render the entire proposal Unacceptable and eliminate it from consideration for award.

Sub-Factor B – Flexibility (Outstanding, Good, Acceptable, Marginal or Unacceptable): This sub-factor evaluates the flexibility of the offeror’s BCS proposed solution by examining the test results and assessing the flexibility of test samples submitted. The major emphasis will be placed on the offeror’s ability to ensure BCS flexibility with regards wearing comfort, range of motion, and flexibility standardization.

The Government will evaluate the extent to which the offeror’s PDMs and submitted test results meet the Government’s flexibility requirements in…
