QUESTIONS AND ANSWERS
Questions and Answers for W91B4N-19-R-2019
Reference: 252.225-7995 Contractor Personnel Performing in the United States Central Command Area of
Responsibility, part (5)(k), page 128 of the solicitation states the following:
“Vehicle or equipment licenses. Contractor personnel shall possess the required licenses to operate all vehicles or equipment necessary to perform the contract in the USCENTCOM AOR.”
Question 1: Can the government please clarify what specific licenses are required here and when the Offeror must submit them (i.e., upon award or prior to contract start of performance)?
Answer 1: For NTVs (any type) contractor will need to provide a civilian driver’s license. For tactical vehicles, contractor will need to present a certificate of completed driver’s training on the necessary vehicles as well as a driver’s license (company generated) for the individual to carry on their person. The contractor shall provide these documents 10 days before reaching Full Operational Capacity (FOC).
References: Attachment 6; Sections 4.2.1 and 4.3 of the PWS; and Addendum to FAR 52.212-1, Instruction to
Offerors-Commercial Items, Section C, Proposal Format, page 145 of the solicitation.
Question 2: Can the government please confirm if both the Prime Contractor and any Subcontractors must possess a license from the Islamic Republic of Afghanistan Ministry of Commerce and Industries (or equivalent), a PSC license and arming authorization?
Answer 2: Yes, Subcontractors must possess an Afghanistan Business License from the Islamic Republic of
Afghanistan Ministry of Commerce and Industries (or equivalent) and a Private Security Company (PSC) license issued by the Government of the Islamic State of Afghanistan (GIRoA) Ministry of Interior (MOI).
For example, if the sub is preforming maintenance services, it does not need a PSC license. The maintenance sub would still need a business license. If the subcontractor is performing security functions, then a PSC and
Business licenses are required. Every employee, either Prime or subcontractor employee who is armed shall be in possession of an arming authorization before starting work on this contract. When traveling outside the perimeter of a designated “agreed facility,” which is a US or NATO controlled Base, or military installation, or US or NATO controlled portion of a base or military installation; the Private Security Contractor, it’s employees, and weapons shall maintain the required registration and licensing with the GIRoA Ministry of
Interior, to be able to conduct operations in support of this contract.
Question 3: Can Offerors submit their bid as a joint venture and, if yes, must all JV entities be similarly licensed?
Answer 3: Offerors can submit their proposal as a joint venture. All entities shall possess the required licenses per this solicitation. IF the joint venture is its own legal entity/company then this legal entity shall hold the required licenses. See question 2 above.
Reference: Attachment 6.
Question 4: Regarding arming authorizations and permits, since these require copies of individual contractor employee Letters of Authorization (LOAs) and other specific employee information to be submitted, can the government please advise when the Contractor is expected to have the required arming authorization – i.e., prior to contract start of performance?
Answer 4: Arming packets are mandatory for employees who are required to be armed; the Contractor shall submit all required documentation in support of arming requests to the COR no later than 45 days prior to the required fully operational date of a Task Order as established by the Contractor for that employee's first day of performance on the contract. Exception: during mobilization period for a Task Order, arming requests shall be submitted into CAAMS prior to arrival at CRC for EXPATS and prior to departure for
Afghanistan for RSMA and OCN Guards. Every employee shall possess an arming authorization before they can carry a weapon. The authorizations shall be provided by the contractor before their employee’s first day of performance on the Task Order. When traveling outside the perimeter of a designated “agreed facility,” which is a US or NATO controlled Base, or military installation, or US or NATO controlled portion of a base or military installation; the Private Security Contractor, it’s employees, and weapons shall maintain the required registration and licensing with the GIRoA Ministry of Interior, to be able to conduct operations in support of this contract.
Reference: Addendum to FAR 52.212-1 Instruction to Offerors-Commercial Items, Section C, Proposal Format, page 145 of the solicitation.
Question 5: May Offerors use less-than-12-size font in tables and graphics?
Answer 5: Yes, contractors can use Times New Roman 10 point font in tables and graphics.
Reference: Key Personnel, PWS Section 2.7.
Question 6: Are any resumes required to be submitted with the proposal for the Key Personnel listed in PWS
Section 2.7?
Answer 6: Resumes are not required for the key personnel referenced in PWS paragraph 2.1.2 with their proposals.
Reference: PWS Section 5.11
Question 7: Please confirm the Contractor must obtain an ITAR license for any employee who is not from an FVEY nation, or does this apply only to the Key Personnel listed in PWS Section 2.7?
Answer 7: This requirement is for the contractor to have an ITAR license for their company, not individuals within the company. Please see PWS for changes.
Question 8: When must the ITAR license(s) be submitted – i.e., prior to contract start?
Answer 8: The licenses shall be provided by the contractor before their employee’s first day of performance on the contract.
Reference: Page 147. Instructions to Offerors, E(1)c TAB D – Signed Teaming Arrangements of Letter of Intent
Question 9: The Government states, “TAB D - Signed Teaming Arrangements or Letter of Intent; this shall include all proposed sub- contractors and their current Islamic Republic of Afghanistan Ministry of Commerce and
Industries License (or Equivalent) and PSC License. Contractors not using sub-contractors shall state they are not using sub- contractors in this section.” Can the Government confirm this requirement only applies to any subcontractors performing services that require both an AISA license and PSC license? If not, can the Government explain how Offerors are to provide a copy of a PSC license for subcontracted services not related to security, as a
PSC license applies to security providers only?
Answer 9: The government confirms that the requirement for subcontractors performing security services shall provide both their current Islamic Republic of Afghanistan Ministry of Commerce and Industries
License (or Equivalent) and PSC License. Subcontractors used for services not related to security shall provide their current Islamic Republic of Afghanistan Ministry of Commerce and Industries Business
License (or Equivalent).
Reference: Page 147. Instructions to Offerors, E(1)c TAB D – Signed Teaming Arrangements of Letter of Intent.
Question 10: The Government states, “TAB D - Signed Teaming Arrangements or Letter of Intent; this shall include all proposed sub- contractors and their current Islamic Republic of Afghanistan Ministry of Commerce and
Industries License (or Equivalent) and PSC License. Contractors not using sub-contractors shall state they are not using sub- contractors in this section.” Will the Government consider modifying the requirements of the solicitation to only those Offerors that hold an active AISA and PSC license and restrict the ability for Offerors to subcontract any security services under this contract?
Answer 10: The Government will not modify the contract to restrict the ability for Offerors to subcontract any security services under this contract. The prime and subcontractor (if providing security services) shall have both licenses.

Question 25: Where Secret clearances are/may be required, will interim Secrets be authorized, pending final clearance adjudication?
Answer 25: Yes
Question 26: As FAR 52.212-3 and FAR 52.209-7 are 17 pages of the solicitation, will the government exclude
Volume 1 TAB B Representation, Certifications, and Other Statements of Offerors from the 20-page limit for
Volume 1?
Answer 26: The Government will exclude FAR 52.212-3 and FAR 52.209-7 from the 20-page limit for
Volume 1. Please see updated Addendum to FAR 52.212-1 Volume I TAB B.
Question 27: Solicitation, Addendum 52.212-1 – Instruction to Offerors – Commercial Items, Section C, Proposal
Format, Table 2, Volume I (page 145), requests “Evidence of compliance with DFARS 252.225-7039”. Offeror has reviewed the stated DFAR Clause which provides no specific guidance as to how an Offeror would provide such evidence. Will the Government provide clarification as to what it expects the Offeror to provide as “evidence” of compliance? Typically, the Offerors PSC.1 certification would show evidence of compliance through a third-party accrediting agency. However, in this case, the PSC.1 certification is requested in addition to the “evidence of compliance” with DFARS 252.225-7039.
Answer 27: The evidence that needs to be provided is the PSC.1 certification.
Question 28: Solicitation, Addendum 52.212-1 – Instruction to Offerors – Commercial Items, Section C, Proposal
Format, Table 2, Volume I (page 145), requests “Evidence of compliance with DFARS 252.225-7039” however this requirement is absent from E Proposal Content. Where does the government want this requirement?
Answer 28: The PSC.1 certification shall be incorporated in TAB D. Please see updated Addendum to FAR
52.212-1 Volume I TAB D.
Question 29: On the Base PWS Attachment 1 Pricing Workbook, OY3, cell D18, the quantity for the Armed
Guards appears to be missing. Every other OY has a quantity of 25. Should D18 say “25”? Please update and send a revised Pricing workbook.
Answer 29: Yes, it should say 25. Please see the updated pricing workbook
Question 30: Attachment 1 Pricing Workbook Note 1 states that the rates shall be the maximum rates (capped rates) under this contract. Are we to assume the capped rates should include salaries only whereas ODC’, training, etc. will be proposed at the task order level?
Answer 30: The contractor shall include salaries and ODC in the capped prices in Attachment 1. The CAP rate is the maximum price to be charged. This rate should include all relevant costs.
Question 31: PWS 2.1.1 How does the Government define English proficiency?
Answer 31: Speaking 2 (Limited Working Proficiency) Able to satisfy routine social demands and limited work requirements. Can handle routine work-related interactions that are limited in scope. In more complex and sophisticated work-related tasks, language usage generally disturbs the native speaker. Can handle with confidence, but not with facility, most normal, high-frequency social conversational situations including extensive, but casual conversations about current events, as well as work, family, and autobiographical information. The individual can get the gist of most everyday conversations but has some difficulty understanding native speakers in situations that require specialized or sophisticated knowledge. The individual's utterances are minimally cohesive. Linguistic structure is usually not very elaborate and not thoroughly controlled; errors are frequent. Vocabulary use is appropriate for high-frequency utterances. but unusual or imprecise elsewhere. Examples: While these interactions will vary widely from individual to individual, the individual can typically ask and answer predictable questions in the workplace and give straightforward instructions to subordinates. Additionally, the individual can participate in personal and accommodation-type interactions with elaboration and facility; that is, can give and understand complicated, detailed, and extensive directions and make non-routine changes in travel and accommodation arrangements.
Simple structures and basic grammatical relations are typically controlled; however, there are areas of weakness. In the commonly taught languages, these may be simple markings such as plurals, articles, linking words, and negatives or more complex structures such as tense/aspect usage, case morphology, passive constructions, word order, and embedding. Please see addition to PWS paragraph 2.1.1. and Base PWS
Attachment 8 Interagency Language Roundtable.
Question 32: Per USFOR-A FRAGO 16, 1.A.4.A defines armed security as an exception to policy for arming contractors. Are contractors on this contract still required to submit and ETP request 45 days in advance to gain approval to be armed?
Answer 32: Yes. The contractor does not need to submit the ETP themselves. The ETP will be encompassed in your AAL request in CAAMs. The contractor will need to send the employee data (Full Name, Passport
Number and Position) to the COR so he/she can create and submit the Requirement Owner (RO) memo on
CAAMs. The vendor will need to upload the rest of the arming documents in CAAMs for each contractor.
Please contact the Armed Contractor Oversight Directorate (ACOD) for all arming questions.
Question 33: Are there local facilities to conduct training (LN initial training and annual, semi-annual, and quarterly sustainment training)?
Answer 33: Locations have small areas to conduct training as needed.
Question 34: Solicitation Addendum 52.212-1 – Instruction to Offerors – Commercial Items Section E (3) b (2) –
What do the “fully burdened rates” include? Do the rates include only direct and indirect costs? Do the rates need to include ODCs?
Answer 34: The rates do not only include direct and indirect costs. The rates shall include all costs, except those provided in other CLINS. CMR, DBA, mobilization, and demobilization, are the only other authorized
CLINS on this contract.
Question 35: PWS 3.2 “Armed personnel who are required by the nature of their duties to carry protective masks shall familiarize themselves with firing their assigned weapon while wearing protective masks at least annually according to the standards described in applicable Department of the Army weapons training manuals or training circulars described above.” Should the contractor assume the task orders will be conducted in a CBRN environment?
Answer 35: All performance will be in Afghanistan. The training standards are identified.
Question 36: Due to the size requirements being dictated at the TO level (i.e., the task orders between $30,000.00 and $50,000,000.00), will the USG consider a PMO CLIN as part of the price matrix?
Answer 36: The Government will not use a PMO CLIN as part of the price matrix.
Question 37: Solicitation Addendum 52.212-1 – Instruction to Offerors – Commercial Items, Section E, (1), c.
(page 147), “TAB D - Signed Teaming Arrangements or Letter of Intent; this shall include all proposed sub-contractors and their current Islamic Republic of Afghanistan Ministry of Commerce and Industries License (or
Equivalent) and PSC License. Contractors not using sub-contractors shall state they are not using sub- contractors in this section.” How does the Government define a “proposed sub-contractor” in this context?
Answer 37: Solicitation page 144 defines a “subcontractor” as “any supplier, distributor, vendor, leaser or firm (company) that furnishes supplies or services to or for a prime contractor, or for another subcontractor”.
Question 38: Solicitation page 144 defines a “subcontractor” as “any supplier, distributor, vendor, leaser or firm
(company) that furnishes supplies or services to or for a prime contractor, or for another subcontractor”. Although the solicitation requires “all subcontractors” to be registered and approved in JCCS prior to award, is the offeror correct in assuming that the Government does not require US/international vendors of equipment and supplies (e.g.
5.11 Tactical, Colt Firearms, Galls inc.. etc..) to be approved in JCCS? If this is not correct, can the government provide a listing of vendors that are approved in JCCS?
Answer 38: The Government requires all vendors (US/International/Local) to be registered and approved in
JCCS prior to award.
Question 39: In the Proposal Content description of ADDENDUM TO FAR 52.212-1 Instruction to Offerors-
Commercial Items, the section pertaining to Volume III – Factor 2 Price includes language about “notional labor hours” and the “number of hours per category”. Can the Government clarify that it instead intended to describe
“notional days required” and the “number of days per category”?

Question 40: This section states "(1) This Lowest Price Technically Acceptable (LPTA) source selection is in accordance with FAR Part 15.101-2, Lowest Price Technically Acceptable Source Selection Process. Offers will be evaluated using the criteria under Addendum to FAR 52.212-2, Evaluation Factors for Award".
Due to the complexities, dangers, and challenges of operating a security program in support of the U.S. Government in Afghanistan, we recommend a Best-Value Trade Off evaluation of the IDIQ-level proposals. If the evaluation factor is LPTA at the IDIQ level, many security providers may take unnecessary challenges to their proposed CAP rates to be one of the 5 lowest bidders, resulting in poor performance for the life of the contract which increases risk to the U.S. Government. We recommend the Government reserve LPTA evaluation for the Task Order level competition.
Answer 40: The Government will use the LPTA source selection in accordance with the solicitation.

Question 41: This section states "Past Performance will not be evaluated. The Procuring Contracting Officer will complete a responsibility determination IAW FAR 9.104. A determination of non-responsibility will deem the
Offeror ineligible for award".
Companies without past performance but have a secret facility clearance and Afghanistan-specific licenses will technically qualify under the current evaluation requirements. For companies not to be required to have a minimum level of past performance with recent and relevant experience in Afghanistan, this increases overall risk to this program and brings a layer of regional inexperience to the operation. We recommend a minimum of 3 performance references within the past 3 years that are similar in scope and size, within Afghanistan. This allows only experienced vendors to be eligible for this contract, especially if the contract is being evaluated using LPTA. If the contract requires zero past performance and is evaluated under LPTA circumstances, this combination generates an increased possibility of performance failure.
Answer 41: The Government will not evaluate Past Performance for this requirement.

Question 42: This section states "TAB D - Signed Teaming Arrangements or Letter of Intent; this shall include all proposed sub- contractors and their current Islamic Republic of Afghanistan Ministry of Commerce and Industries
License (or Equivalent) and PSC License. Contractors not using sub-contractors shall state they are not using sub-contractors in this section."
We highly recommended that the U.S. Government require that Prime bidders have valid PSC and commercial licenses in their name. If teaming agreements are utilized, organization unlicensed in Afghanistan as the prime contractor have minimal oversight on the overall performance of the contract, which ultimately invites a subcontractor to be only operational entity capable of performing, which minimizes the checks and balance relationship between sub and prime contractors and ultimately increases risk to the Government. This is not ideal for the U.S. Government and the U.S. mission.
Answer 42: The Prime Contract as well as subcontractors shall have the appropriate licenses to operate in the Afghanistan Area of Responsibility.
