SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
The following have been added by full text:
QUESTIONS AND GOVT. RESPONSES
Subject: Questions, Comments, and Concerns in regards to Solicitation W91B4N-18-R-2006 Aviation Fuels Contract.
Question 1: Is there an incumbent contractor for these services?
Government Response: Yes
Question 2: Is the incumbent contract number W91B4N-17-C-2003?
Government Response: Yes
Question 3: There is no CLIN for Defense Base Act (DBA) insurance. DBA insurance is generally included as a separately listed CLIN given it is cost-reimbursable. Will the awarded contractors be required to carry DBA insurance throughout the performance of the resultant contracts?
Government Response: The solicitation will be updated to include Defense Base Act Insurance Contract Line Item Numbers, Solicitation Attachment 0001 – Aviation Fuel Pricing Spreadsheet, and Amendment to FAR 52.212-1 and Amendment to FAR 52.212-2 have been updated.
Question 4: There is no CLIN for Contractor Manpower Reporting (CMR). CMR is typically included as a non-priced CLIN. Will the awarded contractors be required to complete CMR on the resultant contracts?
Government Response: There is not a CLIN for CMR in this solicitation as it is not required for commodities/supply contracts and this is a commodity procurement with incidental services required.
Question 5: Are offerors required to complete the fill-in for 52.203-2 CERTIFICATE OF INDEPENDENT PRICE DETERMINATION (APR 1985) and return the whole solicitation with their proposal?
Government Response: In accordance with Solicitation W91B4N-18-R-2006 Offerors shall complete all required information to include but is not limited to, Federal Acquisition Regulation (FAR) Provision at 52.203-2, Certificate of Independent Price Destination as prescribed in FAR 3.103-1. Offerors shall also return the entire solicitation and required information and documentation with proposals submitted.
Question 6: Are offerors required to complete the fill-in for 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013) and return the whole solicitation with their proposal?
Government Response: In accordance with Solicitation W91B4N-18-R-2006 Offerors shall complete all required information to include but is not limited to, Federal Acquisition Regulation (FAR) Provision at 52.209-7, Information Regarding Responsibility Matters as prescribed in FAR 9.104-7(b). Offerors shall also return the entire solicitation and required information and documentation with proposals submitted.
Question 7: Will the Government award offerors who are debarred by the Afghan National Procurement Authority
(NPA)?
Government Response: This is a USG procurement and will follow US laws, regulations, and policies.
Question 8: Clause states, “If the contract is awarded to an Afghan vendor, the quotation or offer will be converted to Afghani using a Government budget rate of 66.55 Afghani per U.S. dollar.” This is not the current exchange rate.
The current exchange rate on the international currency market is AFN 73.0514 (as of 28 JUN 2018) per U.S. dollar.
The U.S. Department of Treasury, Bureau of the Fiscal Service lists an exchange rate of AFN 69.00 (as of 31 MAR 2018) per U.S. dollar. What source is RCC-E using for the cited exchange rate?
Government Response: The Government uses the U.S. Department of Treasury rate which is updated approximately once a quarter. An amendment will be issued to update the exchange rate to AFN 69.00.
Question 9: Clause states, “If the contract is awarded to an Afghan vendor, the quotation or offer will be converted to Afghani using a Government budget rate of 66.55 Afghani per U.S. dollar.” Will this exchange rate be updated throughout the life of the contract? If so, will the rate be updated on a monthly, quarterly, or yearly basis?
Government Response: This rate will be fixed for the life of the contract at the rate specified in the solicitation in accordance with DFARS Provision 252.232-7014. Refer to the Government’s response to Question 8 for the updated exchange rate.
Question 10: Clause states, “Prime Contractors and subcontractors at any tier may verify their registration at https://www.jccs.gov/jccscoe/ by selecting the “Vendors Login” module and logging in with their user name and password. The offeror must be registered, approved, and eligible for installation access prior to award, and remain eligible for installation access for the life of the contract.” Once logged into JCCS, no vendor page (verified with multiple JCCS registrants) displays whether a vendor is approved within the system or eligible for installation access. The JCCS Helpdesk is non-responsive (ticket number JC-2018-010960). How may offerors determine if their profile is approved within JCCS and whether or not they are eligible for installation access?
Government Response: Only those vendors that are interested in submitting a proposal in response to this Solicitation (W91B4N-18-R-2006) may submit an email inquiring ONLY about their JCCS registration to the Contract Specialist at christina.m.lord.civ@mail.mil. The Contract Specialist will not respond to any email regarding JCCS that is not related this Solicitation (W91B4N-18-R-2006) or to the status of their registration.
Question 11: The table of contents for the SOW cites “Attachment 001 Quality Assurance Surveillance Plan.” This Plan is not included with the solicitation. Is it RCC-E’s intent to share this Plan with perspective offerors prior to the due date for proposals?
Government’s Response: The Quality Assurance Surveillance Plan is an internal Government document that provides continuity and a framework for structured Government contract surveillance in accordance with Federal Acquisition Regulation 46.4(a). Therefore, this document will not be released to potential Offerors. The Statement of Work will be updated to delete this as an attachment and change Attachment 002 Example of Delivery Ticket to Attachment 001 Example of Delivery Ticket.
Question 12: Paragraph 3 states, “It is the Government’s intent to award seven (7) Indefinite Delivery, Indefinite Quantity (IDIQ) Contracts awarded by Region as specified in Paragraph 9 in order to meet the requirements specified herein.” Are offerors required to submit pricing for all seven (7) regions or may offerors elect to bid only on certain regions?
Government’s Response: In accordance with Solicitation W91B4N-18-R-2006, Addendum to FAR 52.212-1, 2.Proposal Preparation and Submission Instructions, Paragraph e, “Offers received for less than the stated number of items listed in the Schedule will be considered ineligible for award.” Therefore, Offerors shall submit a proposal for pricing in all seven (7) regions.
Question 13: Paragraph 3 states, “It is the Government’s intent to award seven (7) Indefinite Delivery, Indefinite Quantity (IDIQ) Contracts awarded by Region as specified in Paragraph 9 in order to meet the requirements specified herein.” May the Government award multiple regions to a single contractor?
Government’s Response: The Government will award a region to the Contractor that is deemed the Lowest Price Technically Acceptable in each of the seven regions. Therefore, it is possible that one contractor may be awarded multiple regions.
Question 14: Paragraph 3 states, “The Contractor and all subcontractor(s) at all tiers shall be registered and be APPROVED in Joint Contracting and Contingency Services (JCCS) for the duration of the contract.” How may a contractor registered in JCCS determine if their profile/company is approved within the system? There is no status available to contractors presently on the system.
Government’s Response: Refer to the Government’s response to Question 10.
Question 15: Paragraph 6.5 states, “The Contractor shall not provide aviation turbine fuel refined in Iran, or from any Russian sources identified by the United States Department of the Treasury Office of Foreign Asset Control (“Russia Sanctions”).” The source of various fuels purchased by the U.S. Government for use in Afghanistan remains a regulatory compliance challenge (see GAO Decision, Fidelis Logistic and Supply Services, B-414445; B- 414445.2, May 17, 2017). In order to avoid confusion on the resultant contracts, will the Government plainly list the “Russian sources” not to be sourced from?
Government’s Response: All requirements, policies, and lists dealing with prohibited sources are available at this website. https://www.treasury.gov/resource-center/sanctions/Pages/default.aspx
Question 16: Paragraph 6.6.3 states, “The Contractor shall provide refueling vehicles at each aviation facility, sufficient to provide fueling services for the duration of the into aircraft performance period.” Is the contractor required to maintain the refueling vehicles on site at each aviation facility in the awarded region for the entire ordering period or only when a Delivery Order (DO) is active for a specific site? For example, if a contractor is awarded Region One (North) Provinces, is the contractor required to maintain a total of 12 refueling vehicles at six
(6) locations for the Ordering Period One (01-AUG-2018 TO 31-JUL-2019) and each of the subsequent ordering periods?
Government’s Response: In accordance with the solicitation and the statement of work, if an Offeror is awarded a contract for a particular region, that said contractor shall provide the specific minimum number of mobile tankers for those sites within the province of that region. This minimum number of mobile tankers shall remain on site at all times during the period of performance of the contract as specified in the delivery orders.
Question 17: Paragraph 10 states, “The Government will award up to seven Fixed Price Economic Price Adjustment (FP EPA) SA IDIQ Contracts.” ADDENDUM TO FAR 52.212-1 states, “Seven (7) Indefinite Delivery Indefinite Quantity contracts will be awarded as a result of this solicitation.” This language is inconsistent. Will the Government award multiple regions to a single contractor? If so, will the Government award separate contracts to that contractor for each region?
Government’s Response: The Government will award seven (7) single award Indefinite Delivery Indefinite Quantity contracts. Each Region will have its own individual contract. If one Offeror is deemed to be Lowest Price Technically Acceptable for more than one region, that offeror will be awarded separate contracts for each region. This language at paragraph 10 of the statement of work will be updated.
Question 18: Paragraph 14.2 states, “Security measures change according to perceived threat levels, and may irregularly affect wait times outside of installation entry points.” Will the Government pay demurrage under the resultant contracts?
Government’s Response: The Government will not pay for any costs outside of what the Offeror Proposes. The Government will not pay any demurrage in any of the resulting contracts.
Question 19: Paragraph 22.6.1 requires offerors to have a “Transportation Services License – Issued by Afghan Central Business Registry” and Paragraph 22.6.2 requires contractors to have a “Transit and License – Issued by Ministry of Commerce and Industry (MoCI).” The Afghan Central Business Registry (ACBR) is part of MoCI and there are not two separate licenses available. The only license available from MoCI is a “Business License.” MoCI does not issue “Transportation Services” or “Transit” licenses. The Government should require contractors to maintain a “Business License” issued by MoCI and remove SOW Paras 22.6.1 and 22.6.2 from the solicitation.
Government’s Response: The Statement of Work paragraph 22.6 has been updated, “The Contractor shall have all applicable required licensing and authorizations to operate a business in Afghanistan as well as all applicable licensing, authorizations and credentialing to import, supply, and deliver fuel types and quantities identified within the SOW, as well, Contractor shall maintain licensing, authorizations and credentialing based on possible future changes there to.”
Question 20: Paragraph 22.6.3 requires offerors to have a “Petroleum Import License – Issued by MoCI.” Will the Government award offerors who do not have a Petroleum Import License – Issued by MoCI?
Government’s Response: No.
Question 21: Paragraph 22.6.5 states, “Afghanistan Investment Support Agency License.” The Government of Afghanistan, Administrative Office of the President, issued a presidential decree in 2017 abolishing the Afghanistan Investment Support Agency (AISA) and moving all licensing authority to the Ministry of Commerce and Industries (MoCI). The Government should remove SOW Para 22.6.5 from the solicitation given the Government of Afghanistan only issues “Business Licenses” from MoCI.
Government’s Response: Refer to the Government’s response to Question 19.
Question 22: ADDENDUM TO FAR 52.212-1 states, “Offerors may have a pending account at the time of proposal submission; however, in order to be eligible for award, all offerors shall be APPROVED in JCCS.” Again, there is no way for registrants in JCCS to determine whether or not their account is pending or approved because JCCS does not provide account status to vendors. This is a major failing of the system unlike the System for Award Management (SAM), which shows the account status. How are offerors to determine the status of their JCCS account?
Government’s Response: Refer to the Government’s response to Question 10.
Question 23: The instructions for Volume I – General are presented on page 76 of the final conformed solicitation.
May offerors simply complete all of the necessary fill-ins throughout the solicitation including completion of the SF-1449 and attach all executed SF-30s to this document, and submit as Volume I – General? Or does the Government envision offerors copying the relevant parts of the solicitation into their own document for submission?
Government’s Response: Offerors shall complete and submit all documentation in accordance with the solicitation to include but is not limited to the SF1449, SF 30, and attachments.
Question 24: The instructions for the Technical Volume are not clear. Page 77 of the final conformed solicitation outlines the instructions for the Technical Volume. These instructions cite the Technical Volume having two factors:
Factor 1 – Technical Capability and Factor 2 – Management Approach. However, Management Approach appears not to be a factor of the Technical Volume, but a completely separate volume unto itself per Table A-1 on page 75 of the solicitation.
Government’s Response: This has been updated Volume II should consist of Factor 1 – Technical Capability and Factor 2 – Management Approach. Also, Volume IV was changed to Volume III.
Question 25: Page 77 of the final conformed solicitation states, “The Offeror shall describe the tangible assets in its possession, or available via lease, or through subcontract, to provide transportation of fuels from point at which the Offeror takes possession of the fuels until final delivery of aviation fuel into the aircraft at ANDSF sites throughout the GIRoA. The Offeror must identify rolling stock through Vehicle Identification Number (VIN) or similar unique identification, and must indicate the capacity of any tank vehicle, tank trailer, or other rolling stock used to meet contractual demand.” May an offeror describe vehicles that are available for lease, but not presently leased by the offeror?
Government’s Response: Yes.
Question 26: Page 77 of the final conformed solicitation states, “The Offeror must describe how it intends to satisfy anticipated monthly demand for fuel at each location identified within Attachment 0001 - Aviation Fuel Pricing Spreadsheet; if the Offeror intends to operate an interim storage facility, it must demonstrate that its mix of storage and transportation assets are sufficient to deliver fuel products within 96 hours of a requested delivery date, to any of the locations listed in paragraph 9 of the SOW.” This language would suggest the Government expects offerors to offer pricing for all seven (7) regions. Are offerors required to submit proposals / pricing for all seven (7) regions or may offerors elect to bid only a single region / multiple regions, but not all?
Government’s Response: In accordance with Solicitation W91B4N-18-R-2006, Addendum to FAR 52.212-1, 2. Proposal Preparation and Submission Instructions, Paragraph e, “Offers received for less than the stated number of items listed in the Schedule will be considered ineligible for award.” Therefore, Question 27: Page 77 of the final conformed solicitation states, “The Offeror shall provide letters of commitment (which will not count against the Technical Volume page limitation) from all fuel suppliers, transportation subcontractors, vehicle leasing companies, and commercial or private fuel storage facilities proposed as an element of the offer.” Many fuel suppliers do not provide letters of commitment. For example, the solicitation cites Turkmenbashi (the state-run oil company of Turkmenistan) by name on page 71 of the final conformed solicitation, but this fuel supplier does not provide letters of commitment. The Government should remove the requirement for offerors to submit letters of commitment for all fuel suppliers. The requirement, as it stands now, is not realistic and impossible if an offeror plans to use Turkmenbashi as one of its fuel suppliers. Delicious
Government’s Response: Paragraph 22.6 has been updated to remove Turkmenistan Membership. The Contractor shall have all applicable required licensing and authorizations to operate a business in Afghanistan as well as all applicable licensing, authorizations and credentialing to import, supply, and deliver fuel types and quantities identified within the SOW, as well, Contractor shall maintain licensing, authorizations and credentialing based on possible future changes there to. The Offeror shall provide letters of commitment (which will not count against the Technical Volume page limitation) from all fuel suppliers, transportation subcontractors, vehicle leasing companies, and commercial or private fuel storage facilities proposed as an element of the offer.
Question 28: Page 77 of the final conformed solicitation states, “The Offeror shall describe its existing quality control policies, plans and procedures, and shall identify any changes thereto in order to comply with contractual quality assurance standards (see SOW Paragraph 11).” Please confirm this is simply a description of the offeror’s quality policies, plans and procedures, and not submission of an actual Quality Control Plan, which is due no later than 10 days after contract award.
Government’s Response: Confirmed.
Question 29: Page 78 of the final conformed solicitation states, “Offerors shall provide and identify the standard reference price (set forth by the market) for one liter of fuel and separately provide the fully burden rate that will be added to the reference unit price.” Shall offerors use the Platts Oilgram Price Reports price for Jet A-1 to identify the standard reference price? If not, how does the Government expect offerors to identify this standard reference price?
It seems that the Government would be best served for the purpose of evaluating offers to provide this reference price rather than rely upon offerors to provide it given it is simply a reference price.
Government’s Response: Offerors shall utilize the price per liter set forth by the market.
Question 30: Page 79 of the final conformed solicitation states, “Afghan Vendors shall submit their quote in AFN IAW with DFARS Clause 252.232-7014.” This is incorrect, and this language should be removed from the solicitation. Per DFARS Clause 252.232-7014, it is the Government’s responsibility to convert the offer to Afghani.
Government’s Response: This is correct. IAW DFARS Provision 252.232-7014 sub-paragraph b; Vendors shall submit quotations and offers in U.S. dollars. If the contract is awarded to an Afghan vendor, the quotation or offer will be converted to Afghani using a Government budget rate of 69.00 Afghani per U.S.
dollar. The language in the solicitation will be updated.
Question 31: Page 80 of the final conformed solicitation states, “The proposal includes a complete listing of proposed prime (and sub) contractor vehicles, by VIN or other unique identification, and describes a maintenance plan to ensure adequate rolling stock to satisfy delivery requirements.” Why is a maintenance plan mentioned in the basis for award and not the instructions to offerors?
Government’s Response: Amendment to FAR 52.212-1 will update this requirement.
Question 32: Page 80 of the final conformed solicitation states, “This plan shall include recent photographs of the front side, back side, left side, and right side of the vehicles. The contractor shall identify the VIN of the vehicle pictured within the photographs.” Will these photos count as part of the page count? This seems to be an overly onerous proposal requirement given any responsible offeror will likely have tens if not hundreds of vehicles, which would require the submission of hundreds of photographs. SOW Paragraph 6.6.4 outlines this requirement as a post-award deliverable and not a proposal requirement. The Government should consider removing this proposal requirement.
Government’s Response: Photographs of vehicles will not count towards the overall page count. Per SOW paragraph 6.6.4 offerors shall provide a list of all owned and/or leased fuel trucking delivery assets to be utilized in the performance of this requirement. Solicitation language will be updated to reflect this as well.
Question 33: Page 81 of the final conformed solicitation states, “The Offeror’s proposed Quality Assurance/Quality Control Plan describes its internal and external testing and assurance policies, its Standard Operating Procedures, and corrective action methodologies to ensure that it consistently delivers compliant fuel throughout the life of the delivery order performance period.” Again, please confirm that offerors are required only to submit a description of their Quality Control Plan and not their actual plan, which is a post-award deliverable.
Government’s Response: This has been updated to change Quality Assurance/Quality Control Plan to Quality Assurance/Quality Control Approach.
Question 34: Attachment 0001 is an MS Excel workbook with eight (8) worksheets, one worksheet with the instructions and seven (7) worksheets for each of the seven (7) regions. Each of the seven (7) worksheets is divided into two separate pricing elements, one element for the “unit price” of aviation fuel and one element for the “loaded rate” of aviation fuel. The offeror understands that the “loaded rate” is the fully burden rate that the offeror proposes to source and deliver aviation fuel into ANDSF airframes at each of the specified locations. However, it is not clear to this offeror what rate should be entered for the “unit price” especially given the guidance provided in the solicitation (page 78) which states, “Offerors shall provide and identify the standard reference price (set forth by the market) for one liter of fuel and separately provide the fully burden rate that will be added to the reference unit price.” Please clarify.
Government’s Response: In accordance with the Instructions Tab within Solicitation Attachment 0001, Offerors shall submit their proposed unit pricing for Aviation Fuel and a fully burden rate that is inclusive of the fuel rate. It is incumbent of the Offeror to provide the unit price of fuel set forth by the market.
Question 35: Can you please extend the date and time.
Government’s Response: Timeline for proposal submissions has been extended eight (8) days to 14 July 2018. See Amendment 004
Question 36: There are four regions for delivering of the fuels. Can we bid for one or two regions.
Government’s Response: In accordance with Solicitation W91B4N-18-R-2006, Addendum to FAR 52.212-1, 2. Proposal Preparation and Submission Instructions, Paragraph e, “Offers received for less than the stated number of items listed in the Schedule will be considered ineligible for award.” Therefore, Question 37: We are Construction Company as well delivery and furnish logistics and transportation's services can we participate for this contract.
Government’s Response: Yes
Question 38: Currently we are register and have MOCi (Ministry Of Commerce and Industries). License does petroleum license is required for this contract.
Government’s Response: Refer to the Government’s response to Question 19.
Question 39: Can we deliver fuels from Turkmenistan, Uzbekistan or other countries.
Government’s Response: Refer to the Government’s response to Question 15.
Question 40: The refuel trucks that we will propose for the tender must be owned by our company or can we lease them?
Government’s Response: Contractors may lease vehicles for the performance of this requirement.
Question 41: Does the company we lease the refuel bowsers from have to be enrolled in JCCS? They will only be leasing the vehicles to our company and we will perform all works. The reason for this question is because there are many vehicle lease companies who are just local businesses but not DoD contractors. They will have no part of the contract performance; they will only provide the trucks to our company for us to utilize and operate to perform the contract.
Government’s Response: Paragraph i of page 73 of the final conformed solicitation states, “In addition, all subcontractors at all tiers shall be registered in JCCS at the time of proposal and must be approved in JCCS at the time of award. A “subcontractor” is identified as any supplier, distributor, vendor, or firm (company) that furnishes supplies or services to or for a prime contractor, or for another subcontractor.”
Question 42: Is a C level test kit required at every one of the 28 sites?
Government’s Response: Yes. Paragraph 6.9.2 of page 60 of the final conformed solicitation states, “Prior to offloading the fuel, a sample shall be taken and jointly inspected between Contractor and government.
This sample shall be tested IAW MIL-STD-3004D_CHG-1, Table XII, “Tests Required for Aviation Turbine Fuels”. This test, which is known as a C Test, includes examination of appearance, color (visual), density or American Petroleum Institute (API) Gravity, water and sediment, fuel system icing inhibitor (if required), and conductivity.
Question 43: The licenses required lists Turkmenistan Security and Commodity Exchange membership. This is not applicable because all of the refineries in Turkmenistan only produce Ts-1 jet fuel and not ASTM D1655 or DEF STD 91-91 Jet fuel that is required in the contract. So do you require Jet A-1 which is compliant with DEF STD 91- 91 or ASTM D1655 (as per the solicitation) or do you require TS-1 which is produced in Turkmenistan? The prices and logistics are very different. The quality is different also as the flash point of TS-1 (with additives) cannot achieve the minimum flash point of 38C as required by DEF STD 91 and/or ASTM D1655 or MIL DTL 83133 (JP8 Spec). So we request the removal of this requirement for Turkmenistan SCE membership or change the specs of the jet fuel to TS-1 which is closer to Afghanistan and readily available.
Question 44: Can we offer TS-1 as an alternative to Jet A-1 (ASTM D1655 / DEF STD 91-91) since the Turkmen Security and Commodity Exchange membership is mentioned in the tender?
Government’s Response: Statement of Work Paragraph 22.6 has been updated. The contractor shall maintain an effective supply chain to ensure uninterrupted supply of Aviation Turbine Fuel, Jet A-1, IAW Defense Standard 91-91 (Jet A-1), American Society of Testing and Materials (ASTM) Standard D1655 (Jet A-1), revision 16C, 1 December 2016 and North Atlantic Treaty Organization Code F-35.
Question 45: As price escalation clause is included in the solicitation, will you be providing a Base Reference Price In accordance with PLATTS? For example 1 June 2018 PLATTS reference under heading Jet Kero, FOB MED?
Please refer to previous fuel solicitations issued by CENTCOM for fuel delivery in Afghanistan.
Government’s Response: Offerors shall provide and identify the standard reference price (set forth by the market) for one liter of fuel and separately provide the fully burden rate that will be added to the reference unit price. However, adjustments in accordance with FAR 52.216-2 will be made utilizing indexmundi.com.
Question 46: The solicitation document including SF1449 cover page states DRAFT. Please remove DRAFT so it can be official when signed. This is not admissible for a submission to US Govt with the DRAFT watermark in accordance with FAR.
Government’s Response: Amendment 001 was issued as the Final Solicitation.
Question 47: Do you want a full QCP (ours is 150 pages) or just a summary in the Technical Capability Section of the proposal?
Government’s Response: This has been updated to change Quality Assurance/Quality Control Plan to Quality Assurance/Quality Control Approach.
Question 48: Do the letters of commitment from suppliers of fuel (refineries) count toward the total number of pages?
Government’s Response: Per page 77 of the final conformed solicitation, “The Offeror shall provide letters of commitment (which will not count against the Technical Volume page limitation) from all fuel suppliers, transportation subcontractors, vehicle leasing companies, and commercial or private fuel storage facilities proposed as an element of the offer.”
Question 49: Can we request that Management approach section be allowed an additional 10 pages?
Government’s Response: The USG believes 15 pages is sufficient enough for the management approach volume.
