The following have been modified:
ADDENDUM TO FAR 52.212-1
1. General Instructions
a. Seven (7) Indefinite Delivery Indefinite Quantity contracts will be awarded as a result of this solicitation.
The selection of sources for award purposes will be conducted utilizing source selection procedures as delineated in Federal Acquisition Regulations (FAR) Part 15.3 with the process of FAR Part 15.101-2 (Lowest Price Technically Acceptable (LPTA)). Offers will be evaluated using the criteria under Addendum to Clause 52.212-2, Evaluation Factors for Award.
b. A site visit shall NOT be provided for this acquisition.
c. The Offer: The submission of the documentation specified below will constitute the offeror’s acceptance of the terms and conditions of the (RFP) Request for Proposal; concurrence with the SOW; and contract type.
d. It is the Government’s intent to award without discussions in accordance with (IAW) FAR Part 52.212- 1(g). Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, IAW FAR Part 15.306, the Government reserves the right to hold discussions if necessary. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).
e. Instructions outlined in paragraph two (2) below, prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.
f. If an Offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the Offeror shall immediately notify the Contract Specialist and KO in writing with supporting rationale (Refer to Paragraph 2.b. for submittal instructions).
g. All referenced documents for this solicitation are available on the Federal Business Opportunities website at http://www.fedbizzopps.gov. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
h. Debriefings: The KO will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing IAW FAR 15.505. The KO will notify offerors who were in the competitive range of the source selection but were not selected for award IAW FAR Part 15.503(b). Upon such notification, unsuccessful offerors may request and receive a debriefing IAW the requirements of FAR Part 15.506.
i. Joint Contracting and Contingency Services (JCCS) registration: All JCCS information and registration can be accomplished at: https://www.jccs.gov/olvr/bta_olvr_reg_guide_faqs.aspx. All Offerors shall be registered in JCCS registration at time of proposal submission. Offerors may have a pending account at the time of proposal submission; however, in order to be eligible for award, all offerors shall be APPROVED in JCCS. In addition, all subcontractors at all tiers shall be registered in JCCS at the time of proposal and must be approved in JCCS at the time of award. All Offerors and subcontractors must be approved in JCCS in order to receive award. A status of “pending approval” in JCCS is not sufficient for award. Contractors are ultimately responsible for their status in JCCS and for rectifying issues, such as missing documentation, prior to proposal submission.
k. SAM Registration: Only offerors who are from the United States shall be registered and current in the System for Award Management (SAM) database at the time of proposal submission. In addition to registration in JCCS, an U.S. Contractor or subcontractor must be registered in the System for Award Management (SAM) and must provide have an active DUNS number. a. General: Offerors are required to submit a completed SF 1449 (Solicitation, Offer, and Award) (including acknowledgment of Amendments), to include blocks 19-24 (Contract Schedule and Representations/Certifications). The Offeror must describe its import and export policies and procedures, as well as its plans and programs for regulatory and business licensing requirements of the GIRoA. The Offeror shall provide current front and back copies of all license (with its translation to English) and permits as required.
The Offeror shall describe its supply chain management program. The program must include identification of sources of supply, the Offeror’s current relationship with wholesale suppliers of refined products, the Offeror’s current practices for acquisition, import, and transportation of fuel from sources of supply to final destination (including any interim storage identified as integral to contract operations), and its policies and practices for recruitment, training, and oversight of a qualified workforce. The supply chain management program must address how the Offeror will finance acquisition of aviation fuels, and demonstrate the financial resources necessary to acquire and deliver fuels for at least ninety (90) days from award of delivery order to initial payment by the government (delivery order award will be thirty (30) days before first delivery, the first monthly invoice will be thirty (30) days after that, and the Government has thirty (30) additional days to pay the invoice).
The Offeror shall address its subcontract and lease management programs, if it intends to subcontract for transportation or lease vehicles or interim storage facilities. The Offeror shall provide letters of commitment from all proposed subcontractors or lessors, describing the scope of the subcontract/lease and including an unequivocal promise to participate if the Offeror is selected for award.
7. Volume III– Factor 3: Price
The Offeror shall complete the proposed price per liter for fuel and the fully burden rate in the Pricing Workbook (Attachment 1 – Aviation Fuel Pricing Spreadsheet). Although adequate price competition is expected, the Government reserves the right to require the submission of Other Than Certified Cost or Pricing Data as is deemed necessary in order to determine a fair and reasonable price.
Contractors will complete Attachment 0001 – Aviation Fuel Pricing Spreadsheet by providing pricing of fuels in each of the region identified. Prices must be exclusive of taxes. Offerors shall provide and identify the standard reference price (set forth by the market) for one liter of fuel and separately provide the fully burden rate that will be added to the reference unit price. The fully burden rate provided, exclusive of the price of aviation fuel per liter, will be capped for all three (3), 12 month ordering periods.
The resulting contract shall permit for economic price adjustment on the reference price of fuel only when a Delivery Order is issued. Adjustments to the reference price shall be negotiated based on indexmundi.com, Jet Fuel Price and shall apply only to deliveries made on or after the effective date of such change is approved in writing by the KO.
Offers shall not submit quantities less than the estimated quantities specified in Attachment 1 – Aviation Fuel Pricing Spreadsheet. Offers submitted for less than the quantities in Attachment 1 – Aviation Fuel Pricing Spreadsheet will not be considered for award. If there is a discrepancy in the Offeror’s price in Attachment 1 – Aviation Fuel Pricing Spreadsheet and that which is provided in the CLINs, the prices submitted on the CLINs will take precedence.
Afghan Vendors shall submit their quote in AFN IAW with DFARS Clause 252.232-7014. Prices submitted shall remain valid for 120 days and will be the basis for the first delivery order(s) issued.
The Government has provided an estimated cost in the Defense Base Act Insurance CLINs (CLINs 0008, 1008 and 2008) in Attachment 0001 – Aviation Fuel Pricing Spreadsheet. All Offerors shall use the Government's provided estimated cost for these CLINs.
Failure to comply with this pricing factor will render the Offeror non-responsive, and ineligible for award.
1. DISCUSSIONS
1. GENERAL INFORMATION. In accordance with FAR 15.306(d), discussion sessions with each offeror may be held should the KO deem them necessary. Should discussions take place, all offerors in the competitive range will be allowed a minimum of five (5) calendar days to submit Final Proposal Revisions after discussions are complete.
2. DISCUSSION SCHEDULING. If discussions are conducted, the KO will schedule the discussion sessions, and each offeror will be notified of the time and place at least one (1) day prior to its discussion session. The KO will provide additional instructions with the notification. Discussions may be in writing or in person.
ADDENDUM TO FAR 52.212-2
2. BASIS FOR AWARD (52.212-2)
a. The Government will award seven (7) Single Award (SA) Fixed Price Economic Price Adjustment (FP EPA) Indefinite Quantity Indefinite Delivery (IDIQ) Contracts to the Offerors whose proposals are determined to be the LPTA in accordance with (IAW) FAR Part 15.101-2.
b. The Government will assess each Offeror’s proposal for technical acceptability. Only those Offerors that are deemed to be Acceptable in non-price factors (and Subfactors) will be evaluated on price. The Government reserves the right not to award a contract if it is determined to be in the best interest of the Government.
c. Trade-offs between price and non- price factors is not permitted.
d. Award for All of the Work: Award will be made to Offerors who are deemed responsible IAW FAR Part
9.1, whose proposals conforms to the solicitation requirements, and whose proposals, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the LPTA offer for any particular region.
e. Discussions: As set forth in FAR 52.212-1(g), the Government intends to evaluate proposals and award seven (7) SA IDIQ contracts without discussions with Offerors (except clarifications as described in FAR Part 15.306(a), Clarifications and award without discussions). Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer (KO) later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the KO determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the KO may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. Past Performance: Past Performance will not be evaluated. The Contracting Officer will complete a responsibility determination IAW FAR 9.104. A determination of non-responsibility will deem the Offeror ineligible award.
4. Proposal Responsiveness: Timely proposals will be reviewed for responsiveness (compliance) to the solicitation. Offerors shall comply with Addendum to FAR Clause 52.212-1 (General Instructions, Proposal Preparation and Submission Instructions). If the proposal is not responsive to the solicitation, it will not be evaluated and the Offeror will be notified that the proposal is non-responsive.
5. FACTORS AND SUB-FACTORS TO BE EVALUATED
Evaluation criteria consist of factors and subfactors. The proposals will be evaluated under three (3) factors with factor one having two (2) subfactors:
Factor 1: Technical Capability
Subfactor 1 - Transportation, Storage and Fuel Fleet Requirements Subfactor 2 - Quality Control
Factor 2: Management Approach
Factor 3: Price
Technical. The Technical Factor evaluation provides an assessment of the Offeror’s capability to satisfy the Government’s minimum requirements.
Factor 1: Technical Capability
1. Technical Capability: The Technical Factor evaluation provides an assessment of the Offeror’s capability to satisfy the Government’s minimum technical requirements. The Government will consider the completeness and feasibility of the Offeror’s proposed technical approach to assess the Offeror’s understanding of the requirement and its ability to successfully complete contract requirements. To be considered technically acceptable Offeror’s proposal must clearly meet the minimum requirements of the solicitation.
a. Subfactor 1 - Transportation, Storage and Fuel Fleet Requirements: To be acceptable, the
Offeror must provide a management and staffing approach that addresses in detail the requirements of the Statement of Work (SOW) paragraphs below:
The Offeror’s proposed transportation plan, interim storage (if proposed), and fuel vehicle fleet will be evaluated to determine their suitability for fuel delivery to all geographic areas of Afghanistan to include those regions and provinces identified in the SOW Paragraph 9. To be acceptable, the offer demonstrates the ability to transport the volume of fuel identified in Attachment 0001 – Aviation Fuel Pricing Spreadsheet. If the Offeror proposes interim storage, its proposal shall demonstrate that its mix of storage capacity and transport vehicles is adequate to satisfy the demand indicated in Attachment 0001 - Aviation Fuel Pricing Spreadsheet. If the offeror does not propose interim storage, its proposal must adequately describes how its vehicle fleet can transport fuels from refinery to multiple final destinations within the ninety-six (96) hour timeframe required by the contract SOW. The proposal includes a complete listing of proposed prime (and sub) contractor vehicles, by VIN or other unique identification, and describes a maintenance plan to ensure adequate rolling stock to satisfy delivery requirements. This plan shall include recent photographs of the front side, back side, left side, and right side of the vehicles.
The contractor shall identify the VIN of the vehicle pictured within the photographs. (These photographs will not count against the Technical Volume page limitation.)
The Offeror provides letters of commitment from all their fuel suppliers, transportation subcontractors, vehicle leasing companies, and commercial or private fuel storage facilities proposed.
b. Subfactor 2 - Quality Control: The Offeror’s proposed Quality Assurance/Quality Control
Approach describes its internal and external testing and assurance policies, its Standard Operating Procedures, and corrective action methodologies to ensure that it consistently delivers compliant fuel throughout the life of the delivery order performance period. The approach provides for testing and validation of fuel quality throughout the Offeror’s supply chain, including point of origin, any transfer points (between carriers, between prime and subcontractors, or from interim storage facilities into final delivery vehicles), and at point of final delivery. The approach shall explain how a sample that failed testing will be remediated and describe the procedures that will be used to deliver the fuel within 24 hours to the site that failed the test. The offeror must also demonstrate that its proposed subcontractors possess mature and effective quality control plans, and that both prime and subcontractor plans will be updated to reflect any process that are unique to performance under this contract.
All Technical Factors will receive one of the adjectival ratings defined below. The Subfactor ratings will be used to determine an overall rating for the factor. If the evaluators deem any Subfactors as Unacceptable then the overall factor will be rated Unacceptable. Table A-1 depicts the rating definitions for this factor and its Subfactors.
Table A-1
TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS
Rating Definition
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 2: Management Approach: To be acceptable, the Offeror’s management proposal will describe the Offeror’s management structure, key personnel, subcontract and lease management programs, and internal Standard Operating Procedures with sufficient detail to reasonably demonstrate its ability to manage a contract of this scope and complexity. The management proposal will include letters of commitment from fuel suppliers, any proposed transportation subcontractors, and any lessors of commercial interim storage capacity, if proposed. The Offeror’s supply chain will be fully described, from purchase of aviation fuels at refineries, importation of fuel consistent with Afghan law, transportation and storage (if proposed), and delivery to ultimate destination, with particular attention paid to training and management of delivery personnel responsible for final delivery to ANDSF training sites, operating sites, operational forces, and national-level management and leadership activities. The Offeror will also demonstrate the financial resources necessary to acquire and deliver fuel for at least sixty (60) days prior to initial payment under this contract, and must provide letters of commitment from wholesale providers of fuel and/or letters of credit from recognized financial institutions sufficient to provide financing of contractor operations for up to ninety (90) days prior to initial payment. The Offeror shall provide English translations of all current licenses as required in SOW Paragraph 22.6.
General statements that Offerors understand the factors and can or will comply with the requirements of the solicitation will be considered unacceptable. Statements to the effect that Offeror has, can or will comply with the licensing and credentialing, including referenced licenses; statements paraphrasing the solicitation or parts thereof, including applicable licenses.; and phrases such as “we have this license” or “will obtain upon award” etc., or parroting of instructions to offerors, will be considered unacceptable.
This Factor will receive one of the adjectival ratings defined below. Table A-2 depicts the rating definitions for this factor and its Subfactors.
Table A-2
TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS
Rating Definition Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 3: Cost/Price
Price will not be scored or rated. The price will be evaluated as the lowest price technically acceptable that meets the requirements of the factors and subfactors above. The pricing in Attachment 0001 – Pricing Workbook will be evaluated for balance. Unbalanced Pricing may be evaluated IAW FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices. The lowest priced technically acceptable offer will be evaluated to determine the price is fair and reasonable IAW FAR Part 15.402, using the techniques in
FAR Part 15.404-1(a) and (b). Proposed prices evaluated as unreasonable may be grounds for eliminating a proposal from competition.
Defense Base Act CLINs 0008, 1008, and 2008 will not be evaluated in the total price.
Through these techniques, the Government will determine whether prices are reasonable, complete and balanced. A technically acceptable Offeror with the lowest Total Evaluated Price for a particular region, will be awarded that region.
Definitions:
Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Completeness/Accuracy. The Offeror’s proposal complies with the price submission instructions in the solicitation.
NOTICE TO OFFERORS
In the event a Contractor fails to perform in accordance with the terms and conditions of the contract, the next Lowest Price Technically Acceptable Offeror for that Region will be awarded a contract.

FUEL
1. GENERAL
This is a supply and delivery of aviation turbine fuel to Afghan National Defense and Security Forces (ANDSF) sites throughout the Government of the Islamic Republic of Afghanistan (GIRoA). The Government will not exercise any supervision or control over the contract service providers performing the delivery services herein. Such contract service providers shall be accountable solely to the Contractor which in turn is responsible to the Government.
This SOW defines responsibilities for the Contractor to supply and deliver aviation turbine fuel to ANDSF sites throughout the GIRoA. The delivery will consist of mobile cold fueling to the following Afghan Air Force (AAF) and Special Mission Wing (SMW) Aircraft:
C-130, A-29, C-208, PC-12,
MD-530,
Mi-17, and
UH-60.
Mobile cold fueling is defined as “the mobile fueling (by truck) of static aircraft with engines not running” and is also known as “direct to tail” fueling. The Contractor shall provide all personnel, equipment (i.e. required vehicles), supplies, transportation, tools, materials, supervision, other items, and other ancillary non-personal services necessary to deliver aviation turbine fuel to AAF and SMW locations throughout Afghanistan. The Contractor shall accomplish all required sourcing, transportation services to delivery points, and delivery of fuel into aircraft specified for service on a Free on Board (FOB) Destination Basis. ANDSF operational requirements for this commodity may vary in quantity, duration, delivery suspense, and may not be limited to locations in Paragraph 9 of this SOW; the Contractor shall maintain sufficient operational flexibility to satisfy requirements at a broad range of locations throughout Afghanistan.
2. BACKGROUND
The Combined Security Transition Command-Afghanistan (CSTC-A), in coordination with North Atlantic Treaty Organization (NATO) nations and partners, international organizations, donors and non-governmental organizations, supports the GIRoA in its efforts to develop and sustain the ANDSF; develop leaders and leadership structure; and establish enduring institutional capacity to enable accountable Afghanistan-centric security to the country. CSTC-A helps oversee training and equipping of Afghanistan forces throughout Afghanistan, and provides logistics support to ANDSF consistent with that mission. As an element of that support, the United States (U.S.) Government has identified an enduring requirement to ensure that adequate supplies of aviation turbine fuels are available to ANDSF training sites, operating sites, operational forces, and national-level management and leadership activities.
3. OBJECTIVES
This contract will serve as the primary support mechanism for Direct-Into-Aircraft fuel requirements throughout the GIRoA. The contract will satisfy requirements of the AAF and the SMW. The aviation turbine fuel provided under the resulting contract(s) is for ANDSF use ONLY, but delivery may be made to ANDSF unit(s) that are co-located with U.S.
