Procedure of Construction Companies According the Ministry of Urban Development
Law: Job description of the Ministry of Urban Development
Documentation required:
1. Application form from the investor
2. AISA license as a construction company
3. letter from the Planning Department after having checked the investor’s documents.
4. Approval letter from the Planning Department of the Kabul Mustofiat
5. Letter from the Ministry of Internal Affairs.
6. Letter from the Planning Department of General Income of the Ministry of Finance.
7. Letter from the Planning Department to the MoUD from AISA.
8. Organizational chart of the investor’s proposed company.
9. Qualification document for the staff of the proposed investment on a form from the Planning Department of the MoUD.
10. List of equipment for the proposed investment project approved by the Planning Department.
There is no need for any additional documents for a foreign investor according the Department of Planning and Construction of the Ministry of Urban Development at the present time.
The process takes from fifteen days to three months to complete. It requires fifteen signatures, the final signature being that of one of the Deputy Ministers. The license is free. The AISA license must be renewed each year under AISA procedures. After renewal with AISA, the company has to bring the AISA license along with its one year activities (income statement and balance sheet) and the receipts from AISA to the Ministry of Urban Development. The MoUD registers this renewal in its book. This process takes about a week.
Step by step process of acquiring the procedure of registering construction companies with the Ministry of Urban Development:
1. The investor submits an application letter to the office of the Minister or one of the Deputy Ministers.
2. Minister or the Deputy Ministers reviews the application, signs it and gives it to the investor to take to the Directorate of Planning and Construction.
3. This Directorate registers it in its office.
4. The investor then takes the letter to the Department of Planning which issues the investor with a Fact Sheet concerning the company.
5. The investor then takes the completed Fact Sheet to the Department of Construction.
6. In this Department a committee reviews and checks the Fact Sheet of the construction company.
7. Based on the Fact Sheet, the Committee categorizes the company into one of three categories based on the AISA license, the investor’s capital and the type and amount of construction equipment it plans to have.
8. Each company that has more activities according the license of the AISA, more capital, and more construction equipment that accepts number one.
9. In the Department of Construction there is an office, named Engineering Office, that receives the equipment documents and the Fact Sheet and registers them because the equipment of one construction company is not permitted to work for another company.
10. After the seeing and checking the Fact Sheet of the investor, the Committee of the Department of Construction sends back the documentation to the Department of Planning.
11. Then Department of Planning sends individual letters to the Ministry of Interior, the AISA, the Mustofiat, the Department General Income of the Ministry of Finance related to this company.
• Letter to Ministry of Interior is to gain assurance that the investor has a clean background.
• Letter to Department of General Income of the Ministry of Finance to gain assurance that the investor has paid the required fees for the AISA license.
• The letter to the Kabul Mustofiat is to gain assurance that taxes and fees have been paid.
1. The letter to the AISA is to gain assurance that indeed the investor has received an AISA license.
Once these assurances have been received, the MoUD registers the investor in its book so that it can bid on government contracts and operate legally.
