About this file
This is Amendment 0001 to Solicitation W912WJ26QA175, issued by the U.S. Army Corps of Engineers (USACE), New England District, on September 23, 2026, with an effective date of the same day. The amendment provides responses to 12 industry questions and revises the Bid Schedule. The solicitation closing date remains October 7, 2026 at 2:00 PM Eastern, and all other terms and conditions remain unchanged.
The solicitation is for portable toilet supply and service at Cape Cod Canal recreational sites in Bourne and Sandwich, Massachusetts, over a 7-month period of performance. The contract requires: (1) Monthly rental and service of three standard portable toilets with 12 cleaning services per month (Monday, Wednesday, Friday schedule), for 7 months; (2) Monthly rental and service of three accessible portable toilets with the same cleaning schedule, for 7 months; and (3) Emergency cleaning service for up to 10 instances during the period of performance, covering both standard and accessible toilets at any of the three sites (A, B, or D). Billing for Items 1 and 2 is structured as a firm-fixed monthly price per unit regardless of calendar variations in service days. Standard portable toilet tanks are approximately 60 gallons; accessible units are approximately 40 gallons. Emergency response time is within 24 hours of notification, and service may be required on weekends or holidays. All placements will be on unpaved surfaces suitable for rebar anchoring. The contractor must provide a written Spill Prevention Plan prior to field work, comply with sustainability requirements (EPA CPG toilet paper and USDA BioPreferred hand sanitizer), and is responsible for providing all water resources and off-site disposal of waste in accordance with applicable regulations. Only Site A (Buzzards Bay) requires gate key access; Sites B and D are accessible without keys.

REQUEST FOR INFORMATION:
Question 1: Monthly Servicing Schedule vs. Billing Basis (Items 1 & 2): The Bid Schedule calculates monthly rates for Items 1 and 2 based on a 12-cleaning baseline per month (36 total monthly cleanings across 3 units). However, PWS Section II.1.a mandates routine servicing three times weekly on Mondays, Wednesdays, and Fridays. Depending on calendar variations, certain months contain 13 or 14 scheduled service days. Could the Government confirm whether monthly invoicing should remain a flat fixed price based on the 12-service baseline, or if invoices should adjust for months with additional calendar service days?
Response 1: Billing shall remain monthly based on a flat fixed price. The Bid Schedule is revised to remove the reference to 36 total monthly cleanings.
Question 2: Confirmation of Firm-Fixed Monthly Billing Structure: Please confirm that billing for Items 1 and 2 is strictly a flat, firm-fixed monthly price per unit, and that no per-gallon or variable waste volume rate will be utilized.
Response 2: Confirmed.
Question 3: Anticipated Period of Performance Start Date: The solicitation specifies a 7-month period of performance beginning upon contract award, with a Pre-Work Conference within seven
(7) business days of award. Does USACE have an estimated calendar start date (e.g., November 1, 2026) for field equipment placement and service commencement?
W912WJ26QA1750001
Response 3: The Government cannot provide an anticipated start date for the period of performance. The Government intends to minimize the time between the solicitation closing and award, however, award is dependent on several factors that prohibit a time estimate from being provided.
Question 4: Tank Capacity and Waste Volume Assumptions: The PWS requires complete waste tank pumping on every service visit but does not specify holding tank capacities or estimated gallon volumes. Does the Government have a required minimum gallon capacity per tank (e.g., 50- 60 gallons for standard units), or an estimated average volume pumped per visit for planning purposes?
Response 4: Tank capacity shall be approximately 60 gallons for standard portable toilet units and approximately 40 gallons for accessible portable toilet units. The Government will not provide an estimated average volume pumped per visit.
Question 5: Emergency Cleaning Service Response Time SLA (Item 3): PWS Section II.1.c outlines unscheduled emergency cleanings for up to ten (10) instances. What is the required response time / Service Level Agreement (e.g., 2 hours, 4 hours, or 24 hours) from notification by the Technical Point of Contact? Additionally, are emergency calls anticipated on weekends or holidays?
Response 5: Required response time is within 24 hours from when the TPOC notifies the contractor of unsanitary conditions. Emergency calls may require service on weekends or holidays. The government will close the unit off to the public until cleaned and returned to service.
Question 6: Ground Anchoring Conditions at Placement Sites: PWS Section II.1.b requires portable toilets to be staked with steel rebar, or weighted with sandbags where staking is not possible. Could the Government clarify whether the designated placement spots at Site A (Buzzards Bay), Site B (Sagamore), and Site D (Sandwich) are on unpaved surfaces suitable for rebar staking, or on concrete/asphalt requiring sandbag ballast?
Response 6: All placements of portable toilets will be on unpaved surfaces suitable for accepting rebar anchors to stake down units.
Question 7: Spill Prevention Plan (SPP) Submittal Requirements: PWS Section II.2 mandates an accepted Spill Prevention Plan (SPP) prior to field work. Does USACE New England District provide a standard SPP template, or should the contractor submit a corporate SPP format?
Response 7: There is no required template for a Spill Prevention Plan. The contractor shall provide the government with a plan in writing outlining methods to prevent spills from occurring and methods to resolve a spill if one occurs that will include environmental restoration. The plan will be reviewed by the government as a submittal and be covered during the pre-work conference.
Question 8: BioPreferred and EPA CPG Compliance Documentation: PWS Section II.1.d requires toilet paper meeting EPA Comprehensive Procurement Guidelines (CPG) and hand sanitizer meeting USDA BioPreferred standards. Will product specification sheets or manufacturer certifications be required as part of the pre-work submittal package?
Response 8: Contractors shall comply with all Sustainability requirements. Product submittals will not be required.
Question 9: Site Access and Gate Key Distribution: PWS Section I.8 notes that contractors will receive up to two (2) gate keys for access. Are all three recreation sites locked outside of public hours, and will servicing vehicles be granted early morning access prior to public park opening?
Response 9: Only Site A, Buzzards Bay Recreation Area, is behind a locked gate that will require a key for access. The other two sites, B and D, are in accessible areas that are available for servicing as required by the Performance Work Statement without a key.
Question 10: Post-Award Submittals: Beyond the Spill Prevention Plan, insurance certificates, and iWATCH training completions, are there any additional post-award submittals or administrative requirements we should anticipate prior to service kickoff?
Response 10: No other submittals are required.
Question 1: Is there a water source on site?
Response 11: There is no water source on site. The Contractor is responsible for providing all resources necessary to complete work.
Question 12: Is there a dumping facility we can use on site?
Response 12: There is no dumping facility. The Contractor is responsible for off site disposal of all material in accordance with all applicable regulations.
