SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been added by full text:

AMENDMENT 0002

Question #1: Please confirm that the original bid guarantee can be received within 3 business days of the due date and time.

Government Response 1:

Please see the “Virtual Bid Opening Solicitation Instructions” in the solicitation.

Question #2: Specification 01 35 26, 1.6.1 calls for Safety and Health Manager to be an Industrial Hygienist. Is it a full time position (a dedicated person without other duties) for the entire duration of the work IN ADDITION to a dedicated SSHO as stated below in the same specification, para 1.6.7.1.1.1?

Government Response 2:

There is no requirement for the Health and Safety Manager to be onsite fulltime or restrictions preventing the Health and Safety Manager from performing other duties. The qualifications, responsibilities, and duties of the Health and Safety Manager are stated in 01 35 26 paragraphs

1.6.1 and 1.6.1.1.

There is a requirement for the Site Safety and Health Officer to be onsite and restrictions preventing the Site Safety and Health Officer from serving in other positions. The qualifications, responsibilities, and duties of the Site Safety and Health Officer are stated in 01 35 26 paragraphs 1.6.2, 1.6.2.1, 1.6.7.1.1, and 1.6.7.1.1.1.

Question #3: Please elaborate on role, duties and responsibilities of a licensed Occupational Physician as requested by Spec 01 35 26, 1.6.3. Does the Physician have to be on site all the time (the entire duration of the project) or be occasionally on the site per necessity? If it’s per necessity, who and how establish this necessity or how to quantify his/her visits?

Government Response 3:

There is no requirement for the Occupational Physician to be onsite or provide primary treatment. The qualifications, responsibilities, and duties of the Occupational Physician are stated in 01 35 26 paragraph 1.6.3.

Question #4: Spec 01 32 01, 3.3.8 and 3.3.19 mentioned “unusually severe weather”. Can the Government provide historical data for number of days due to severe weather for potential delays?

Government Response 4:

See amendment 0002.

Question #5: Elevations A-201 and A-202 show masonry walls for the Pumping Station while A-401 Wall Sections shows insulated precast panels and concrete walls. Please clarify.

Government Response 5:

The precast concrete walls require an exterior finish. See Sheets 01 A-201 and 01 A-202 Key Values 03250.12A and 03250.12B. Also see specifications section 03 45 33 paragraph 2.3.10.2 Formed Surfaces.

Question #6: We have reviewed the plans and specifications for the Raymark Stormwater Pump Station bid, after our review of the plans and specification we feel, we are qualified to bid the project as a general contractor. In the Solicitation, Offer and Award part of the bid package “Special Contract Requirements “on page 44 of 63 under subparagraph “Definitive Responsibility Criterion” the section states “The prime contractor that is low bidder has to provide: documentation of successfully completed at least one project that involved a new pump station of 150 CFS or greater valved at $9 million or greater. The company has been in business for 50 years. In that time, we have built hundreds of new pump stations here in Connecticut along with doing renovation and improvement work at a number of water and sewage treatment plants. The company is bonded to do construction work for 20 million dollars for a single project and 40 million aggregates. (See attachment) The company meets the requirements of a small business, but 150 CFS/9 million requirements are not practical for a small business contractor here from Connecticut. Can the statement of the prime contractor having to provide documentation of one new pump station project, successfully completed that is 150 CFS or greater valved at $9 million be removed from the specification requirements.

Government Response 6:

See Amendment 0002.

Question #7: Specifications call for removal and disposal of contaminated soil but neither specifications nor drawings provided quantities nor details for this work. Please provide Hazardous Material report or specify the quantities and type of contamination to price this work.

Government Response 7:

Hazardous waste has not been found at the pump station location and is not anticipated to be encountered in this work. See SECTION 01 35 26 PART 1 GENERAL.

Question #8: Drawing C-103 includes a note that the Precast Concrete Box Culvert… will be constructed by others. Please confirm the schedule/timing of this installation as it relates to this project. What interface/coordination will be required?

Government Response 8:

The Conveyance System Contract is anticipated to begin before the Pumping Station Contract.

The Conveyance System Contract requires work to begin at Station 23+37 of the Conveyance System and is equal to Station 0+00 of the Pumping Station. Limited coordination for the open channel work from the Conveyance Contract at Station 23+37 and the installation of the box culvert starting at Station 0+00 of the Pumping Station Contract may be required. The contractor for the Pumping Station Contract shall discuss coordination of work at the interface of the two project limits with the USCAE Contracting Officer Representative.

Question #9: Drawing C-102 notes Drainage Channel Grading & Area Improvements under separate contract… Please confirm what coordination will be required. When is this work scheduled to occur?

Government Response 9:

The Conveyance System Contract is anticipated to begin before the Pumping Station Contract.

The Conveyance System Contract requires work to begin at Station 23+37 of the Conveyance System and is equal to Station 0+00 of the Pumping Station. Limited coordination for the open channel work from the Conveyance Contract at Station 23+37 and the installation of the box culvert starting at Station 0+00 of the Pumping Station Contract may be required. SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS

The following have been added by full text:

CONSTRUCTION TIME EXTENSIONS FOR WEATHER

a. This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the CONTRACT CLAUSE entitled “DEFAULT (FIXED PRICE CONSTRUCTION).” In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied.

(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

b. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor’s progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS

BASED ON 5 DAY WORK WEEK

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

( 9 ) ( 8 ) ( 6 ) ( 3 ) ( 2 ) ( 2 ) ( 2 ) ( 2 ) ( 2 ) ( 4 ) ( 6 ) ( 8 )

c. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor’s scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph b, above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the contract clause entitled “DEFAULT (FIXED PRICE CONSTRUCTION).”

The following have been modified:

Definitive Responsibility Criterion

After bid opening, but prior to award, the apparent low bidder will be required to furnish documentation that the prime contractor or subcontractor has:

Within the last 10 years, successfully completed at least one (1) project that involved a new sanitary, water or stormwater pump station construction for a station of 150 cfs or greater and valued at $7.0 million or greater.

The requirements of the DRC may be met by providing subcontractor experience. However, in this case, the subcontractor must perform the same functions of work on the resulting contract and shall not be substituted without approval by the Contracting Officer.

The apparent low bidder will have 3 (three) working days after bid opening to submit the documentation demonstrating that it meets the above definitive responsibility criterion and will receive award of the contract if otherwise eligible and responsible. If the apparent low bidder cannot provide this documentation or if the documentation it submits does not show that it meets these criteria, the apparent next low bidder will be requested to provide this documentation, and if it timely provides the documentation within 3 (three) days of the Government’s request therefor, it will receive award of the contract if otherwise eligible and responsible. This process will be followed until the low bidder who meets the requirement can document that it meets the definitive responsibility criterion, or the Government cancels the solicitation.

** completed: a contract is complete if and only if the Contractor has completed all work and related contract obligations, corrected all deficiencies and all punch list items, and complied with all conditions for final payment.
