About this file

This document summarizes an amendment to a solicitation for a Design Build Multiple Award Task Order Contract. The U.S. Army Corps of Engineers, New England District seeks to award a target of four small business contracts under the MATOC, which will have a total capacity of $90 million over five years. Task orders will range from $500,000 to $10 million for design build services on vertical and horizontal construction projects across New England and the North Atlantic Division. The amendment provides responses to sixteen requests for information that clarify requirements for project manager qualifications, past performance evaluations, proposal volumes and documentation. It also revises evaluation factors and instructions in Sections L and M of the solicitation.

SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

REQUESTS FOR INFORMATION (0002

1. Is this a new contracting vehicle for the New England District? If not, can the Government provide the annual volume issued under the prior contract and the names of the incumbent contractors?

RESPONSE: The proposed DB MATOC is a new contract vehicle for the District. There is no prior DB MATOC contract. District has historically procured DB contracts via individual, project-specific procurements.

2. Will there be additional contracting vehicles covering similar services overlapping with this contract? If so, how will it be determined which projects go to which programs?

RESPONSE: The District has other contracting vehicles in place for AE services, and is in the process of soliciting a Construction MATOC. The District’s future contracting vehicles are source selection sensitive information that may not be disclosed. Each solicitation provides the source selection procedures that will be followed in selecting contract awardees.

3. Please clarify the relationship between this contract and the Special Notice

(W912WJ20X0005, posted October 28, 2019) for the potential use of a Project Labor Agreement (PLA) for a multiple Award Task Order Contract (MATOC) for Construction throughout New England.

RESPONSE: There is no relationship between this solicitation and the referenced Special Notice for a Construction MATOC. The District is in the process of soliciting a Construction MATOC, which will be used for Design-Bid-Build requirements. While some overlap may be possible, it is not anticipated.

4. The next-to-last paragraph on page 7 of 78 in the solicitation states that “The Offeror’s proposal for Phase 1 shall consist of one (1) volume to address Experience, Technical/Management Approach and Past Performance.” This conflicts with the table on the following page in paragraph c. which identifies two required Volumes for Phase I.

Can the Government clarify what is required to be submitted with Phase 1?

RESPONSE: See Section L of the Solicitation as amended herein.

5. The note on page 8 of 78 states that “cover letters, Table of Contents pages, tables, illustrations, and appendices will be counted in the page calculation.” It is our understanding that tabs and divider pages containing no content are excluded from the page count. Can the Government confirm?

RESPONSE: See Government Response to Amendment 0001, RFI No. 21.

6. Can the Government clarify if the items numbered 1 – 4 on the top of page 15 are to be included only in the Phase 2 submission?

RESPONSE: As stated in the solicitation, pg 13, the referenced material is to be provided in Phase 2, Volume II Price Proposals.

7. What percentage of task orders does the Government anticipate awarding using the

Lowest Price, Technically Acceptable method under this contract?

RESPONSE: . It is not possible to predict the percentage of task orders being awarded under an LPTA selection method. Task order selection procedures are dependent upon the future customer’s requirements. Task orders issued under the MATOC will provide awardees with a fair opportunity to be considered for each task order.

8. Reference Phase 1, Volume 1, Factor 2 Past Performance (page 12 of 78), paragraph h.1 states that "For Federal Government projects completed within the last six years...".

The Phase 1, Volume 1, Factor 1 Experience (page 10 of 78) states "Projects provided must be substantially completed (beneficial occupancy obtained) within the past ten (10) years. Please confirm that Phase 1, Volume 1, Factor 2 Past Performance section is incorrect and the completion window for past projects is ten (10) years.

RESPONSE: See response to Amendment 0001, RFI No. 7.

9. Reference Phase 1, Volume 1, Factor 2 Past Performance (page 12 of 78), please confirm that CPARS reports can be utilized in lieu of the PPQ form for past project evaluations.

RESPONSE: Correct. Response to Amendment 0001, RFI No. 22 is revised to: The Government will access CPARS through the online database; the Offeror does not need to provide CPARS reports but may if it has them. If an Offeror has a CPARS report for a project completed between six and ten years ago, that it submitted under the Experience factor, it may submit that report instead of a PPQ.

10. Reference Proposal Submission Requirements (page 8 of 78), paragraph e.

File Packaging states "All of the proposal electronic files shall be submitted in their native formats (e.g., docx, xlsx, ppt). As the Phase 1 native files will be simply Word files is there a need for the Government to have files these files that can be edited or are these native files to be locked?

RESPONSE: Response to Amendment 0001, RFI No. 6 is revised to: Proposal documentation shall be uploaded in PDF format, except for the worksheets used to generate Phase 2, Volume II - Price documentation. This shall be uploaded in its native format (i.e. MS Excel, or equivalent), and the spreadsheet. Native file(s) should not be locked

11. Reference Proposal Submission Requirements (page 8 of 78), paragraph c., the listed materials to be included in the Phase 1/Volume II does not include the Certificate of Corporate Authority. However referencing the actual Certificate of Corporate Authority, Appendix G, it states "Contractors are to complete and submit a Certificate of Corporate Authority of the signing representative with Volume II of their proposal."

Please confirm if the Certificate of Corporate Authority is to be included in the Phase 1/Volume II.

RESPONSE: See Appendix G of the Solicitation as amended herein.

12. As clarified by amendment there is a slight conflict or need for clarification between the

Section L & M relative to the Project Manager qualifications:

As amended in Section L, the Phase 1, Volume I, Factor 2 Project Manager requirements by note are:

“PE, or college degree with 10 years experience directly managing DB projects”. This Section L revision is stating that the absolute requirement for Project Manager experience is a PE (no specific experience requirement) or college degree with 10 years DB management experience.

As amended in Section M, the Phase 1, Volume I, Factor 2 evaluation criteria states “NOTE: Offerors who present Project Managers who have PE registration or who have a college degree and demonstrate 10 years of experience directly managing Design-Build projects may be more highly rated. This Section M revision is stating if the Project Manager possesses DB management experience in addition to the minimum requirement of a PE or college degree the DM management experience will be treated as an enhancement to the experience and may result in a higher rating.

Please clarify:

a) The level of experience of the PE registered Project Manager (we would suggest maintaining the original 5 years experience)

b) If the college degreed Project Manager must have 10 years experience per IDIQ paragraph 8.1

c) If the DB experience will be considered an enhancement for both the PE registered and college degree Project Manager

RESPONSE: The proposed Project Manager at a minimum must:

-hold a college degree, and -have a minimum of 10 years of experience with managing horizontal or vertical construction projects.

Project Managers who meet the mandatory minimum requirements and hold a PE certification, or who demonstrate 10 years of experience in managing DB projects, may be more highly rated. See amendment to Section M, below.

Amendment 0001, pg. 9 (Phase 1, Volume I, Factor 2: Technical/Management Approach)

Note under Table is Revised to: *College degree with 10 years experience directly managing vertical and horizontal construction projects. Alternately, college degree with PE and 10 years managing DB projects. Offerors should identify any additional and/or unique management advantages its proposal provides to the Government.

13. The revised Base IDIQ Scope paragraph 8.1 relative to the Project Manager requirements includes the college degree requirement and 10 years of Project Management experience as the minimum requirement. This differs from the Project Manager requirements stated in Section L and M of the RFP. Specifically, there is no allowance for the use of a PE registered Project Manager in lieu of the 10 years of experience as stated in Section L and there is stated requirement for DB experience.

RESPONSE: See Government response to Amendment 0002, RFI No. 12 above.

14. Within the Q&A responses and amendment revisions there are statements that the

CPARS evaluation will not count against the maximum page count. However the response to question #22 states that the Government will access the CPARs through the online database and the Offeror does not need to provide CPARs. Please confirm that no CPARs are to be included in the proposal.

RESPONSE: The Offeror may choose to include CPARs evaluations with their proposal. See response to RFI No. 9, above.

15. The RFP says: “For all projects submitted by the Offeror in Factor 1 that do not have a

CPARS report, a Past Performance Questionnaire (PPQ) must be completed and submitted electronically…” And the answer to question 7 says that “The Government CPARS/PPIRS system retains project ratings for six years. Thus, anything older than six years requires a PPQ.” If we have a CCASS/CPARS evaluation for a relevant project that was completed between six (6) and ten (10) years ago and if we also provide the name, current email address, and current phone number for a government point-of-contact familiar with the work performed, can we provide that CCASS/CPARS evaluation in lieu a completed PPQ-0/Attachment A form?

RESPONSE: See response to RFI No. 9, above.

16. Please clarify what change was made to Attachment A (the PPQ-0 form) by

Amendment 1. The note that follows Block 8, which is shown in red type in Amendment 1, appears to be otherwise unchanged from the original form.

RESPONSE: No change was made to Attachment A. The text changed to red was done erroneously.

Is deleted in its entirety and replaced with the following:

The proposed Project Manager at a minimum must:

-hold a college degree, and -have a minimum of 10 years of experience with managing horizontal or vertical construction projects.

Project Managers who meet the mandatory minimum requirements and hold a PE certification, or who demonstrate 10 years of experience in managing DB projects, may be more highly rated.
