SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

REQUESTS FOR INFORMATION

1. Some past New England and other US Army Corps of Engineer District solicitations have allowed Offerors to substitute additional relevant experience of key personnel for certain educational requirements or professional registrations, including on Design Build contract procurements. For this Design Build MATOC, will the District allow personnel filling the Project Manager position to substitute additional demonstrated experience managing Design Build projects to substitute for professional registration (i.e., PE or

RA)?

RESPONSE: See Section L, Paragraph g4 of the solicitation as amended herein and IDIQ Scope of Work, Section 8.1.

2. In reviewing this solicitations requirements we noticed in Section L, subparagraph g.4

(page 11 of 78), a requirement for the Construction Project Manager and the Design Project Manager to both be a registered Professional Engineer (PE) or a Registered Architect (RA). While this is common for the Design Project Manager, it is typically not for a Construction Project Manager. The same is also indicated under section 8.1 (page 68 of 78).

RESPONSE: See Government’s response to RFI No. 1, which applies to the (Construction) Project Manager.

3. For Phase 1 / Volume 1 / Factor 1: Experience (Construction and A/E Contractors), please confirm that it is the responsibility of the Offeror to establish the format for presenting it’s company Experience for the five projects that it chooses to submit.

RESPONSE: When no specific formats are required, the Offeror should submit the required information in their preferred layout. Required file formates (ie. PDF, xlsx) remain unchanged.

4. Will there be a site visit for the seed project in phase 1, or will it be held during phase 2?

RESPONSE: The site visit for the Seed TO will be held during Phase 2 of this solicitation.

5. Please provide a deadline for RFIs.

RESPONSE: RFIs should be submitted no later than 4 November 2019.

6. On page 6 of 78 the solicitation states to upload the proposal file as a PDF in two places, but on page 8 of 78 it states the proposal file shall be uploaded in its native format. Please advise.

RESPONSE: All proposal documentation should be uploaded in PDF format; however, the worksheets used to generate Phase 2, Volume II - Price documentation should ALSO be uploaded in its native format (i.e. MS Excel, or equivalent).

7. On page 10 of 78 the solicitation states project experience shall be within 10 years but on page 12 of 78 h. 1) it states to be completed within the last six years. Please advise.

RESPONSE: As stated on Pg 10, projects provided in response to Factor 1 - Experience must be substantially completed (beneficial occupancy obtained) within the past ten (10) years. The text on Pg 12 is relevant to past performance information requirements. The Government CPARS/PPIRS system retains project ratings for six years. Thus, anything older than six years requires a PPQ. A PPQ is required for all non-Federal Government projects submitted.

8. We noticed that the Seed Task Order is in New Hampshire. Does the architect have to be currently licensed in all the states (NAE and North Atlantic Division (NAD) Area) for this IDIQ.

RESPONSE: For each of the technical disciplines, active professional registration/licensure in any state will meet the requirement for this solicitation.

9. Proposal Submission Requirements…Content Required, Section f, page 9 of 78:

Please confirm each relevant completed project submitted only needs to meet one (as a minimum) of the five criteria listed in order to be considered. If this is correct, is there a minimum dollar value for projects other than those that meet the fourth bullet requirement?

RESPONSE: There is no minimum dollar value, however, similarity of price is one of the criteria used to determine relevancey of a submitted project. Please see section L, Content Requirement, paragraph f.

10. Proposal Submission Requirements…Content Required, Section f, page 10 of 78:

Please confirm if each project submitted must be design-build in nature. The second bullet point near the top of the page appears to allow participation by the designer or contractor in Design-Bid-Build, while other requirements in the solicitation that projects be design-build are more consistent. This includes the requirement about two-thirds of the way down page 10: “A project is defined as a construction project performed under a single task order or contract which included both design and construction of the project.”

RESPONSE: Design-Bid-Build projects are permitted for consideration under Factor 1- Experience. However, the Offerors are cautioned that this solicitation is specifically for a Design-Build IDIQ. As stated in the solicitation:

"The Offeror shall submit a maximum of five (5) projects demonstrating team experience, including the Designer of Record and the Construction Contractor that best demonstrate the Offeror’s team members’ experience on recent and relevant projects that are similar in size, scope, complexity, and price."

11. g. Phase 1, Volume I, Factor 2: Technical/Management Approach…4), page 11 of 78;

also 8.0 Contractor Personnel and Qualifications, page 68 of 78:

Will USACE allow other demonstrated experience to replace the requirement that the contractor’s project manager and design manager must be either professional engineers or registered architects? This staffing requirement is not typical and will not necessarily ensure successful performance on projects as compared to individuals with demonstrated experience at successful design-build firms. Furthermore, as individuals with these credentials may not be currently be on offerors’ staffs, this will be a challenge for submission of a compliant proposal.

RESPONSE: See Government’s response to RFI number 1, above.

12. h. Phase 1, Volume I, Factor 3: Past Performance…1), page 12 of 78:

This instruction references “projects completed within the last six years…” whereas other requirements in the solicitation clearly allow projects completed within ten years. Please confirm completion within the past ten years is the correct requirement for projects submitted. As a follow-up question, should the information required in this section be provided for all projects submitted, and not just those completed within six years?

RESPONSE: See Government’s response to RFI number 7, above

13. Clauses Incorporated by Full Text, 52.236-1 Performance of Work by the Contractor

(Apr 1984), page 54 of 78:

Can USACE provide its expectation of how the 15 percent performance requirement applies to the work? In our experience, different agencies interpret this requirement differently, applying the percentage to either total contract value, contract value not including markups, contract value not including field management staff, the total value of performance labor only (i.e., no materials), etc. The cited FAR clause does not provide any clarification of this.

RESPONSE: The 15% is based on total contract value.

14. 1) Section 00100, Section L, Proposal Submission Requirements, paragraph f - Phase

1, Volume I, Factor 1: Experience (Construction and A/E Contractors). For the five (5) projects submitted the listed project relevancy requirement apply.

Question a - The first relevancy attribute states: "A single project which includes both the design and construction (aka Design-Build) of a new , multi-story facility." Please confirm that all five projects do not need to meet the multi-story relevancy requirement.

Question b - Regarding the relevancy criteria listed, will projects be rated higher if they meet more of the relevancy requirements or are they considered simply compliant if they meet one or more of the listed relevancy criteria?

RESPONSE: Response to Question a: As stated in the solicitation, for purposes of this evaluation, a relevant project would meet one or more of the stated criteria. Therefore, all five projects do not need to meet the multi-story relevancy requirement.

Response to Question b: The more relevancy criteria a submitted project meets, the more highly it may be rated.

15. 2) Section 00100, Section M, paragraph A, sub-paragraph c - Phase 1, Volume I, Factor

1: Evaluation of Experience (Construction and A/E Contractors).

This paragraph states in part "Project relevancy will be determined by those projects which demonstrate successful completion in performing the requirements identified in Section D.4.a. We do not find a paragraph D.4.a in Section 00100 of the solicitation.

Should this reference be to the relevancy requirements listed in Section L, paragraph f?

RESPONSE: Yes. The subject reference to Section D.4.a is deleted and replaced with “Section 00100, Section L, paragraph f.”

16. Per Part 8.1 (Page 68 of 78) sub-part (b) of the Project Manager’s qualifications states that the PM shall have a professional registration (PE or RA). This registration is unable to be achieved if the PM has a college degree from an accredited school in construction management as listed in sub-part (a). Additionally, the described responsibilities of the PM do not reflect those required by a RA or PE and we wonder if this is a mistake as the requirement of an employee to be an RA or PE is covered in the qualifications of the Design Manager listed in Section 8.2. Please confirm whether the PM is, in fact, required to be a professional RA or PE or whether this requirement can be removed.

RESPONSE: See Government's response to RFI No. 1, above

17. What is the dealine for submitting questions on the RFP?

RESPONSE: Please see the response to RFI number 5.

18. In Section 00100 on page 6, Section L says (in two places on this page) that “Submission shall be in Adobe PDF format.” But in Section 00100 on the bottom of page 8, Section L says that “all of the proposal electronic files shall be submitted in their native formats (e.g., docx, xlsx, ppt) and uploaded electronically to DoD SAFE website.” Word-searchable PDF files are typically required by government RFPs. Please confirm that USACE is requesting PDF files, not native files, for the electronic submissions.

RESPONSE: Please see response to RFI number 6.

19. In Section 00100 on page 8, Section L says that “Past performance questionnaires

WILL NOT count against the page limit.” If offerors are providing CPARS evaluations in lieu of PPQs, are the CPARS evaluations similarly exempt from page limitations?

RESPONSE: Past performance questionnaires and CPARS evaluations will not count against the stated page limits.

20. Instructions for Submitting Electronic Proposals, page 6 of 78:

This instruction references “Submission shall be in Adobe PDF format,” whereas Section e, File Packaging, Page 8 of 78 in the solicitation requires “Submission of proposal files in their native formats (e.g. .docx, xlsx, ppt)…” as well as PDF copies. Please confirm the file packaging and submission requirements.

RESPONSE: See response to RFI number 6.

21. Proposal File Format and Packaging, Section e, page 9 of 78:

While packaging Volume I as one file for PDF submission, is it allowable to insert a page break to separate subsequent Factors? For example, a BLANK colored page or a page with text on it, similar to what would be on a physical tab, such as “FACTOR 1: Experience”.

As a follow-up question, should such page breaks be allowed, will they be counted against the overall page limit of 35 pages for Volume I?

RESPONSE: The offeror can package their proposal with page breaks if deired; however, all pages WILL count toward the stated page limit, with only those exceptions specifically stated in the solicitation.

22. h. Phase 1, Volume I, Factor 3: Past Performance…1), page 12 of 78:

This instruction references “For all projects submitted by the offeror in Factor 1 that do not have a CPARS report, a PPQ must be completed….”. If CPARS reports are available for the projects, are offerors required to submit them as part of the proposal, or will the Government access them through the CPARS system?

As a follow-up question, if CPARS reports are including in the proposal submission, will they be counted against the overall page limit of 35 pages for Volume I?

RESPONSE: The Government will access CPARs through the online database; the Offeror does not need to provide CPARs reports.

23. Phase 1 Volume 1, Factor 2 Technical/Management Approach section 4 indicates that the Prime’s Project Manager shall have a PE or RA registration. Typically Project Managers, especially for small businesses, for construction projects do not hold these registrations. Wouldn’t a degree in Construction Management and 5 minimum years of relevant experience of serving as project manager for construction project ranging in sizes of 5 million or greater with the Design Manager having a PE or RA bring a member of the proposed team be sufficient.

RESPONSE: See response to RFI number 1, above.

24. The table on page 8 of the RFP indicates that Volume II is to be submitted in both Phase 1 and Phase 2. Should the Phase 1 Volume II include the Section 00600 Representations and Certifications?

RESPONSE: Yes.

25. The table on page 8 of the RFP indicates that Volume II is to be submitted in both Phase 1 and Phase 2. Should the Phase 1 Volume II include the Appendix G Certificate of Corporate Authority?

RESPONSE: Yes.

26. It looks as though the resume template provided in Appendix F (Key Personnel Qualifications Summary) is in 10 point font. Can smaller font (i.e., 10 point font) be used for the resumes?

RESPONSE: No.

27. Can smaller font (i.e., 10 point font) be used for the project descriptions?

RESPONSE: See response to RFI number 26.

28. In Appendix F (Key Personnel Qualifications Summary), item 3 (Job Category/Level) indicates that this part should provide “Current and Proposed Category/Level.” For a project manager or a design manager, what type of information is requested for “Current and Proposed Category/Level”?

RESPONSE: Job category/Level equates to job title (ex. Project Manager, Design Manager) and the level of the employee (ex. Sr., Staff, Jr.) proposed for that position.

29. In Appendix F (Key Personnel Qualifications Summary), item 3 (Job Category/Level) indicates that this part should “Identify the appropriate percentage of the individual’s time that will be dedicated to proposed project.” For a project manager or a design manager, how can these percentages be predicted at this point? Should these be estimated for the seed project?

RESPONSE: This requirement is removed.

30. On page 10, the solicitation states projects must have been substantially completed within 10 years; however, on page 12, h. 1) the solicitation states we should submit references no more than 6 years old in the Past Performance section. Is it acceptable to provide Past Performance References of up to 10 years to correspond to the projects submitted under Phase 1, Volume 1, Factor. Please respond.

RESPONSE: See Government’s response to RFI number 7.

31. Phase 1, Volume 1, Factor 2 states that the Project Manager must be a PE or an RA and must be employed directly by the Prime Contractor. Can this requirement be modified to include the option of Construction Project Manager experience (8 years) in lieu of the required PE or RA?. …. OR optionally meet the PE/RA requirement but not a direct employee of the prime contractor.

RESPONSE: See Government’s response to RFI number 1.

SECTION M

EVALUATION FACTORS FOR AWARD

a. Phase 1, Volume I, Factor 1: Experience (Construction and A/E Contractors), page 18 of the solicitation, is amended as follows:

Offerors shall submit no more than five (5) projects, each must have been completed within the last ten

(10) years, as evidence of recent and relevant experience. Project relevancy will be determined by those projects which demonstrate successful completion in performing the requirements identified in Section L, Paragraph f D.4.a. The roles and responsibilities of work performed by the Offeror’s team members will be considered when determining relevancy, and should be clearly marked.

b. Phase 1, Volume I, Factor 2: Technical/Management Approach

The Offeror’s Technical/Management Approach will be evaluated for completeness, reasonableness, and level of risk to the Government. The Government will evaluate the degree to which the plan:

1) Includes all the elements described in the solicitation;

2) Is reasonable and logical in relation to the anticipated projects, and;

3) Describes a comprehensive and viable strategy to execute the anticipated projects as described in the solicitation.

NOTE: Offerors who present Project Managers who have PE registration or who have a college degree and demonstrate 10 years of experience directly managing Design-Build projects may be more highly rated.

Final Selection, page 21 of the solicitation, is amended as follows:

The Government intends to award without discussions. Therefore, the Offeror’s Phase 1 and Phase 2 submittal should contain the Offeror’s best terms from a technical and a price standpoint. The Government reserves the right to conduct discussions in Phase 2 if the Source Selection Authority (SSA) later determines it necessary.

The resulting contracts will be Multiple Award Task Order Contracts (MATOCs). One contract each will be awarded to a target of four (4) Offerors whose proposals are considered most advantageous to the Government, based upon an integrated assessment of the evaluation factors and which the SSA determines has conformed to the solicitation, is fair and reasonable, and offers the best overall value to the Government, all factors considered. The Seed Task Order may be awarded to the MATOC awardee with the lowest Seed Task Order Bid Schedule price proposed.

1) The Government will award contracts resulting from this solicitation to the Offerors selected in accordance with the above procedures. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

2) In the course of evaluating proposals, the SST may contact references submitted by the Offeror. The SST may also check past performance information obtained from sources other than those identified by the Offeror. All gathered information will be used to evaluate the Offerors’ overall past performance. The SSA may determine that a “Substantial Confidence” or “Satisfactory Confidence” rating is worth more than a “Neutral Confidence” in the Best Value Trade-Off.

At no time during this process, or during the debriefing, or after award, will the names of individuals providing reference information about an Offeror's past performance be revealed to the Offerors or to any other party.
