AMENDMENT 0004

SPECIFICATIONS CHANGE

This Amendment Incorporates the Specifications Amendment Document titled “AMENDMENT 0004 OF

SOLICITATION”

RFI - AMENDMENT 0004

Muddy River Phase II Construction Amendment 0004

REQUESTS FOR INFORMATION AND GOVERNMENT RESPONSES

1. We respectfully request a bid extension of two (2) weeks. This is a unique project with numerous environmental and logistical restraints that need to be considered. This extra time would allow for better alignment between our technical proposal and pricing while also providing a more accurate and competitive proposal overall.

RESPONSE: Please see Amendment 0002 to the Solicitation. Proposal due date is August 23 at 2pm.

2. Regarding the contaminated soils and groundwater, most of the supplemental data from the “Compilation of Sediment Quality Information” is over four (4) years old. Are there any soil classifications/analysis from the Phase 1 project that can be provided pre-bid?

RESPONSE: No. All available sediment data is provided as part of the contract documents under “Sediment Data Appendix Phase 2 Specifications – 100%”

3. Due to the time required to process information once answers from earlier requests for information are received, please provide a 4 week extension of the due date to allow adjustments to be made in our Technical Approach and Pricing.

RESPONSE: Please see Amendment 0002 to the Solicitation. Proposal due date is August 23 at 2pm.

4. Please confirm that the 1-year construction warranty, the 12-month Seed Establishment

Period and the 24-month Guarantee Period will extend beyond the Period of Performance indicated.

RESPONSE: See Changes to specifications and contract clauses under Amendment 0004.

5. Reference Specification Section 31 41 16 Metal Sheet Piling to be used for temporary diversion structures, Paragraph 1.6 Delivery, Storage and Handling indicates that "Materials delivered to the site shall be new and undamaged and shall be accompanied by certified test reports." Please confirm that previously used sheet piles can be used, removed and reused for temporary diversion structures.

RESPONSE: Yes, previously used sheets can be used. See changes to specification under Amendment 0004.

6. Please clarify whether sediment staging and dewatering areas are required to have a geomembrane liner to separate stockpiled sediment from underlying materials and that collected water and treated prior to discharge.

RESPONSE: Sediment staging and dewatering areas shall follow all conditions in the DEP Order of Conditions (One for City of Boston and one for Town of Brookline) as well as the Water Quality Certification and all pertinent MADEP regulations.

7. Specification Section 01 57 20 Section 1.7.2.q; States that the river must be free flowing during September 15 - November 1 for juvenile out migration and April 1 to June 15 for adult upstream and downstream migration. Please confirm that inwater work may continue during these periods provided free flowing conditions are maintained.

RESPONSE: Yes, in-water work may continue during these periods provided free flowing conditions of the river are maintained.

8. Reference Sheet CD103 Existing Conditions & Demolition Plan and C-103 Site Plan -

There is a 24-inch diameter drain line and a Storm Drain that pass under The Riverway and Brookline Avenue, respectively, before discharging into the Muddy River in Work Area 3. Please provide flow data for these outlets.

RESPONSE: No flow data is available for these outlets. The Offeror shall make reasonable assumptions of flow based on the size of the pipes that may need to be controlled and diverted for the work in this area and other similar areas.

9. Reference Specification Section 31 62 19 - There is not much information regarding what is needed, if anything, for pile load tests. Section 3.2.1 does not give us any information regarding how many test piles there are, what type of testing is required (static or dynamic), or what the required pile capacity is. It does make reference to a test pile being driven to determine vibration levels during installation. Please clarify pile load testing requirements?

RESPONSE: Per Specification Section 31 62 19, subpart 3.2.1, “One test pile shall be installed for baseline vibration monitoring 80 feet away from the 59 Fenway historic Fire Signal Building.” No additional test piles or dynamic or static pile load tests are required.

10. Referenced Specification Section 31 62 19 - What is the required treatment (CCA, etc.)

for the timber piles? The specification references AWPA U1, but it doesn’t indicate what the treatment level needs to be or what the actual use category is.

RESPONSE: Treated Douglas Fir or Southern Pine piles shall be used. Use category is 4C. See changes to specifications under Amendment 0004.

11. Reference Specification Section 01 57 20 - Page 12 Paragraph 3.1 states... "Obtaining other permits and complying with all environmental permits and commitments required by Federal, State, Regional, and local environmental laws and regulations is the Contractor's responsibility. Among these other permits, the Contractor shall note that an NPDES Construction General Permit is required and has not been obtained by the Government. Who is responsible for obtaining the NPDES Construction General Permit?

RESPONSE: The contractor is responsible to obtain the NPDES Construction General Permit as part of this contract on behalf of the Government and the project Sponsors.

12. The Wage Determination issued with the Solicitation (General Decision Number:

MA190008 2/22/2019) was updated 5/17/2019. Please clarify which wage determination will be applicable for the duration of this contract.

RESPONSE: The Wage Determination is updated with this Amendment.

13. Reference Wage Determination related to survey crew members - US Department of Labor Field Operations Handbook (FOH) Chapter 15e20 Survey Crews identifies which members of survey crews are subject to prevailing wage requirements. Please confirm that this is applicable to this project. Please confirm which Worker Classification (Laborer or Mechanic) and wage Group that survey crew members that are subject to prevailing wage requirements would be classified so that the correct wage can be applied for this project.

RESPONSE: Survey crew members are not classified as laborers or mechanics unless they are doing manual work such as clearing brush, in which case they are considered common laborers.

14. Reference 01 11 00 – Summary of Work – 1.9.12 Storm Preparation and Removal of Equipment states … "All equipment and unconsolidated materials shall be removed from areas subject to the one percent annual chance flood (100-year flood, Zone A) in advance of significant rainfall that will exceed the volume of a ten year, 24-hour storm event."

Can unconsolidated soil stockpiles remain within the 100-year floodplain so long as they are confined by a non-erodible barrier with a top at or above the 100-year flood elevation?

RESPONSE: Yes, unconsolidated soil stockpiles may remain within the 100-year floodplain as long as they are confined by a non-erodible barrier with a top at or above the 100-year flood elevation.

15. Is there an official deadline for questions?

RESPONSE: We request that all pre-bid questions be submitted by 9 August 2019.

16. The project drawings do not indicate a tip elevation for the new timber piles that are supporting the flood wall at the BFD Fire Alarm Building. The specifications indicate that the contractor shall perform geotechnical borings to assess drivability and depth. For the purpose of bidding, will USACE provide a tip elevation and general statement regarding driving conditions to allow contractors to properly price the work.

RESPONSE: Per Sheet S-501 Note #5, "LENGTH OF TIMBER PILES SHALL BE

25 FT OR UNTIL REFUSAL."

17. Specification section 32 93 00(3.11) Extension states: Following completion of the Guarantee Period, the Landscape Architect and the Contracting Officer shall inspect the site. If the plant material and workmanship are acceptable, written notice will be given by the Contracting Officer. If remedial action is required to meet performance standards, the Contracting Officer will extend the Guarantee Period until performance standards are met. Maintenance during the extended Guarantee period shall continue and will be the responsibility of the Contractor. Please clarify the following: Will maintenance during the extended Guarantee period apply only to the replacement plantings or to the entire site?

18. Specification section 32 93 00, 3.6.1.1 Performance standards: Each plant shall show at least 80 percent healthy growth and shall have the natural character of a plant of its species in accordance with the American Nurserymens Association Standards. Dead or unsatisfactory plants shall be replaced during the normal planting season. The contracting officer shall make a final inspection for acceptance after the replacement plants have been maintained in satisfactory condition for one year. Please confirm this final acceptance will be relevant to replacement plants only.

19. Please refer to section 3.6.1 of specification 32 93 00. Please clarify if provisional acceptance and guarantee period will begin after all installation of all plant material on the project or all plant material by “Area” as shown on the plans.

20. The Maintenance and Guarantee Period will commence following Provisional

Acceptance of plantings. The Guarantee Period shall extend until October 15 in the second calendar year following the year in which Provisional Acceptance was granted per

3.6.1. Please confirm Provision Acceptance of plantings will be provided on a Work Area level following substantial completion within each individual work area.

RESPONSE: See changes to specifications under Amendment 0004.

21. Please provide the electronic version of the CAD files for the Landscape Plans L‐100 through L‐ 118; and S‐101 for Work Area 13 for the project. They were not included in Amendment 0003.

RESPONSE: All information to submit a proposal is shown on the contract drawings. The Offeror shall bid the project as shown and amended.

22. Reference Specification 32 93 00 Exterior Planting and Habitat Restoration ‐ paragraph 3.6.1 Guarantee Period ‐ please confirm that Provisional Acceptance of plantings within each Work Area will be provided by USACE by Work Area once successfully restored and does not require completion of all 13 Work Areas.

RESPONSE: See changes in specification under Amendment 0004.

23. Reference Solicitation Section 00800 ‐ Special Contract Requirements ‐ Clause 52.211‐10 Commencement, Project and Completion of Work, paragraph (c) states... "complete the entire work ready for use not later than 1095 Days from Notice to proceed issuance. The time stated for completion shall include final cleanup of the premises." Please confirm that Guarantee Periods for plantings are not included in this 1095 day limit.

RESPONSE: See changes to specification under Amendment 0004.

24. Reference "Amendment_ 0003_ of_ Solicitation" dated July 26, 2019, page 3, section 1.2.1 Revised and reissued Drawings ‐ please revise. The text of the section is not readable behind the list of revised drawings.

RESPONSE: See Changes to Issued Amendments under Amendment 0004.

25. Responses to questions in Amendment 0003 did not reference other responses correctly. Please clarify.

RESPONSE: See Amendment 0004 for corrections to Amendment 0003 Requests for Information that had been published with clerical errors.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S.
