SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
SECTION 00010 - SOLICITATION CONTRACT FORM
The required response date/time has changed from 29-Sep-2016 04:00 PM to 14-Oct-
2016 04:00 PM.
The following have been added by full text:
1) Section L.D, Volume 1-Technical, (3)(C) (pgs. 14-15, Factor 3 – Past Performance) – USACE’s answer to question #5 in Amendment 1 stated that IDIQ task order contracts can be included in past performance for projects and contracts, yet indicated each task order under an IDIQ contract is considered a single project. Will the Government accept a previously-completed past performance questionnaire or CPARS report for an entire IDIQ contract to satisfy the requirement of Factor 3, Subsection 3, or is a past performance questionnaire or access to a CPARS report required for the specific project (task order) provided for Section 1 (Experience)?
• Submitting a CPARS (for a federal Government project) or a PPQ for work that was not performed on federal Government contracts, for an entire IDIQ contract may satisfy the requirement for Factor 3, Subsection 3. Offerors who submit either CPARS or PPQs for individual task orders may receive higher consideration.
2) Section L.D, Volume 1-Technical, (3)(C) (pgs. 14-15, Factor 3 – Past Performance) – Subsection 1 (Contract Descriptions) requires a list of information on relevant Federal Government contracts awarded in the last five years, and Subsection 3 requires past performance questionnaires (except where the Government can access CPARS reports). However, Subsection 3 requires the past performance questionnaires for “all contracts identified in Subsection 1.” This places an onerous burden on Offerors for the following reasons: (a) With some of the contracts having been recently awarded, there has not yet been time to conduct sufficient work for clients to prepare a past performance questionnaire or CPARS report. (b) Additionally, the requirement to provide past performance questionnaires for all of these contracts would put an undue burden on Offerors, especially those who have performed a large number (many tens to hundreds) of relevant Government projects in the last five years. (c) Finally, the requirement to provide past performance questionnaires for all of these contracts cannot be reasonably met because some Government personnel do not provide them nor issue CPARS reports. Is it the District’s intent to instead require past performance questionnaires or
CPARS reports from just the projects listed in Section 1 (Experience, inclusive of subfactors 1a and 1b) of the Solicitation instead of Subsection 1 (Contracts Description)?
• Offerors must submit past performance information for the projects identified in Factor 1 as amended herein.
In addition, offerors shall submit information regarding Government and/or commercial contracts, as identified below, successfully completed during the past 5 years, which are relevant to the efforts required by this solicitation. See VOLUME I – Technical, (3) Factor 3 – Past Performance as revised, in this Amendment.
3) Section L, Volume 2-Price (pg. 16, Proposal Submission Requirements) –
The 2nd paragraph on page 16 requires Offerors to “complete the solicitation sections indicated below using the file provided with the RFP.”
The list of referenced files below that paragraph includes “Section G – Contract Administration Data.” We could not find Attachment G-Contract Administration Data nor any reference to it in the body of the Solicitation.
Please provide that section or clarify what USACE is looking for this specific item.
• Section G is deleted.
4) The RFP states “8(a) firms must have an office in the following geographical locations or a bon-a-fide office that has been approved by the U.S. Small Business Administration (ME, VT, NH, MA, RI, CT, NY, NJ)”. Does this mean you must have an office location within any of these states or the office must be an approved bon-a-fide office location within any of these states?
• An 8(a) offeror must have an office in one of these states. 8(a)’s that are not located in one of these states, can only submit a proposal if they have opened an office in one of these states and the office was approved by the Small Business Administration.
5) Will you be requiring a letter from our bonding company stating our contract parameter for single jobs and total uncompleted work progress values?
• There is no requirement in the Solicitation for a letter from a bonding company.
6) Section 10 14 02 Interior Signage: Please provided a detailed schedule including dimensions of signs, locations, and indication of whether or not it is a changeable message strip sign-Section 2.2.2
• See Drawing Legend on Sheet 610-50-02-A-101. All Interior Signage/Room Tag Descriptions are in a slightly different colored font within the rooms on the plan drawings. Signs shall go where directed by the COR, right outside the door on the new wall. Spec Section 10 14 02 has details on product and letter size. Standard room signs shall be priced, not changeable message strip signs.
7) The finish schedule/legend calls for some Rooms ( 312,316,311, ETC) to have C-1 Carpet however the finish legend Hatchings calls for C-2 this affects several rooms, could you please clarify if we should go by the finish legend or the finish schedule when doing the take off?
Hatchings on Proposed Finish Plan on Sheet 610-50-02-A-101 are correct. Finish Legend on this sheet is incorrect. For instance, Rooms 305, 312 and 316 should read “C-2” in the Finish Legend.
8) Please provide Locations or quantities of fire extinguishers.
Fire Extinguishers shall be located in lobby 306, in the corner between offices 301/302, near the exit to stairs nears server rooms 313/314, and at each end of new bridge, for a total of 5. Also one in Kitchen.
9) Are they looking for vertical window blinds Spec section 12 21 00 or roller shades spec section 12 24 13?
All windows, interior and exterior, in the contractor’s work area shall receive new blinds or shades except for 1ft high windows above 6 ft in interior spaces. Vertical window blinds shall be installed unless specifically noted on the drawings.
10) Room 317(ramp), schedule shows carpet 2 and carpet 3 but only one carpet code is in room 317. Assumption here is that border will be carpet 3, please confirm.
Room 317 is an office and Carpet C2 and C3 is to be installed as per Finish Legend. Ramp is incorrectly labeled 317 on Proposed Finish Plan, but is to receive carpet C1 as the hatching shows on the Finish Plan.
11) For extension of existing fire alarm system we will need the make, model and current/former vendor with contact information.
The existing fire alarm is the MIRCOM FX 2000 and all proposed components (alarms & AV) need to be compatible with that system.
Vendor and POC info is not available. Please do not contact the installation.
12) For extension of existing fire AV system we will need the make, model and current/former vendor with contact information.
The existing fire alarm is the MIRCOM FX 2000 and all proposed components (alarms & AV) need to be compatible with that system.
Vendor and POC info is not available. Please do not contact the installation.
13) Please confirm what Gage studs are to be used on the exterior wall.
16 gage shall be used on outside walls; 18 gage on interior walls.
14) Can you help us understand the scope of this bid option: 0003 TIAC Bldg, 3rd Floor HVAC Replacement of Existing Systems?
The sample project (TIAC third Fl, CRREL) has options within it. This item, 0003 TIAC Bldg, 3rd Floor HVAC Replacement of Existing Systems, is for pricing this option in the sample project. 0002, 0004 and 0005 on the Task Order Tab are also options in the sample task order.
15) Solicitation Attachment three has a breakdown tab for the task order. How does markup get included in this breakdown?
The footnote under the table in Attachment 3 indicates that the rates for PM, Supt, Site Safety and QC shall be burdened with taxes, insurance, and home office overhead; but shall not include job site overhead or profit.
The table needs to be completed for easy comparison purposes, however submitting backup as to how these costs were derived is expected. Same for the “Task Order” tab; it should include rates burdened with taxes and insurance. However, Job Office Overhead, Home Office Overhead, and Profit percentages are applied at the bottom of the “Task Order” tab.
16) Does spec section 07 2700.4510 apply to this project?
Yes. Air Barrier Testing of the bridge is required.
17) We have one more question of importance as well. The frame types and the door sizes are not matching up, for example, on Door 02 it shows it as a type 2 frame, but the door size is 3’0x7’0, which doesn’t match up with the frame sizing.
Also, there is no column on the door schedule for door type, so I am not sure which door elevations correspond with the door schedule, it looks like Type C door would go with a Type 2 door frame.
Double doors are all Door Frame Type 2 as the Door Schedule notes.
Double doors are depicted by Door Type C, also as shown on Drawing A- 601.
18) It looks like doors 02, 03, 06, 07 are all pair of doors according to the hardware and frame type, but once again these only call for a 3’0-7’0 door, which doesn’t match the frame elevation listed.
Doors 02, 03, 07 and 08 (not 06) are double doors. Each of the 2 doors comprising each double door unit is 3’0” x 7’0” for an opening of 6 feet (see Door Type C). Doors 02, 03, 07 and 08 are to receive Door Frame Type 2 as shown in the Door Schedule.
19) Doors 11, 14, 15 don’t have hardware sets that would allow for a pair of doors, but are calling for a type 2 frame, which appears to be a pair of doors.
Door 11 is a single door according to the Door Schedule on Sheet A-60.
Door 12 is the double door along with doors 14 and 15. All Double Door on the Door Schedule should have Door Frame Type 2 and Hardware set D. The Door Schedule is incorrect as to hardware sets.
20) We have a question on the finish schedule/ Legend. The finish schedule calls for some Rooms ( 312,316,311, ETC) to have C-1 Carpet however the finish legend Hatchings calls for C-2 this affects several rooms, could you please clarify if I should go by the finish legend or the finish schedule when doing the take off?
Go with the hatchings. See answer to question 7 above.
21) Reference amendment 0003 question 5 and 6 regarding Past Performance Questionnaires (PPQs). Question: Why is it necessary for the acquisition of this Proposal to have a contractor’s past performance questionnaire be submitted in a sealed envelope?
(Please consider that the contractor should know what their performance rating is and should have been discussing this with the Project owner throughout the construction process. CCASS/CSPAR is set up to allow the contractor to review and comment on the ratings- so it should be no secret. To ask a Project owner to fill it out and put it in a sealed envelope and mail it back to us is burdensome step which will be difficult in some cases to get them to comply. I am not sure why this has to be a hidden secret from the contractor. Please reconsider this answer as you are letting PPQ’s that already in possession to be submitted in the proposal.)
PPQs are not required where a contractor has performed a federal government project and a CCASS/CPARS performance evaluation exists. Offerors who have worked on federal government contracts are to provide the contract number. Refer to solicitation, page 14, (3) Factor 3, Past Performance, A. Subsection 1- Contract Descriptions, (i)
22) In the Solicitation on page 14: Section 3 Factor 3 - Past Performance, first paragraph: "In Addition, offerors shall submit information regarding ALL GOVERNMENT AND/OR COMMERCIAL CONTRACTS, as identified below, for the PRIME OFFEROR AND EACH PROPOSED SUBCONTRACTOR awarded during the past 5 years." This could be 1000's of pages. Please confirm that this is correct.
Please refer to revisions to Section D. “Proposal Submission”, below.
23.) Do you anticipate the RFI to answer any questions pertaining to or expanding the 6 state bon-a-fide office requirement? It is currently published, "Primarily the work will be located within the New England District's geographical boundaries (VT, ME, NH, MA, RI, CT) but this contract may extend within the USACE North Atlantic Division Region (NY, NJ, PA, MD, DE, VA and Washington DC) in the continental United States." We kindly note that Philadelphia is the midpoint of all the states named as possible project locations.
8(a) firms must have an office in the following geographical locations or a bona fide office that has been approved by the U.S. Small Business Administration
(ME, VT, NH, MA, RI, CT, NY, NJ).
24.) Is it truly intended that resumes from ALL SUBS for their PM, super, QC Manager, and Site Safety and Health Officer are required?
Please refer to revisions to Section D. “Proposal Submission”, below.
25.) Is it truly intended that PPQs (or CPARS) are required for EVERY SINGLE RELEVANT PROJECT that we AND our subs have completed in the past five years?
Please refer to revisions to Section D. “Proposal Submission”, below.
Revisions to Section L and Section M, below, also resolve questions 1b, 10, 12, & 14 from Amendment 0003.
REVISED SECTION L

- identify all offices involved in this contract.
- identify all positions by title, organization, and physical location and how they are related, to include any proposed subcontractors and consultants, including lines of reporting and technical areas of responsibility under the contract. Offerors may choose to propose subcontractors, whether or not the proposed prime has written commitments with them. But see Evaluation Approach, as revised, below.
- clearly show the lines of authority of the Offeror’s Project Manager, Quality Control and Safety Organization, including all JV Partners and proposed subcontractors, when applicable.

VOLUME I – Technical, (3) Factor 3 - Past Performance, page 14 of the solicitation, is amended as shown in Bold, below.
(3) Factor 3 – Past Performance
This section shall contain past performance information for each project offeror submits under Factor 1 as revised in this Amendment. In addition, offerors shall submit information regarding Government and/or commercial contracts, as identified below, successfully completed during the past 5 years, which are relevant to the efforts required by this solicitation. Relevancy will be determined by projects that address the Scope of Work required by this solicitation, i.e., projects that show tasks completed encompassing the requirements under 1.2, 1.3. and 1.4 of the Scope of Work. “Data concerning the offeror shall be provided first, followed by each proposed subcontractor, in alphabetical order” is deleted. This section shall be organized into the following subsections:
Paragraph A. Subsection 1(i) and (ii), pages 14-15 of the solicitation remains the same.
Section D, Paragraph B., Subsection 2, page 15 of the solicitation, Letters of Commitment is deleted in its entirety.
Section D, Paragraph C, Subsection 3, page 15 of the solicitation, is revised as shown in Bold, below.

For all contracts identified in sub-section 1, Contract Descriptions, a Past Performance Questionnaire must be completed and submitted or, for offerors that have worked on federal government projects, a Contractor Performance Assessment Reporting System (CPARS) report must be available. If CPARS data is available for a project, the Government will access and evaluate CPARS data. If no CPARS report is available for a listed project (i.e., for work that was not performed on federal government contracts) the offeror shall complete Part I of the Past Performance Questionnaire, send it to the customer to complete Part II of the Past Performance Questionnaire, request the completed form in a sealed envelope from the customer and submit it in the sealed envelope with the original proposal. The Past Performance Questionnaire can be found in Appendix D-1. (No change in Appendix D-1)
REVISED SECTION M
Paragraph A. “Basis for Award”, page 17 of the solicitation, is amended as shown in Bold, below:
A. BASIS FOR AWARD
Three separate contract awards will be made using the best value trade-off process in accordance with FAR Part 15.101, based on the best overall (i.e., best value) proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to three (3) technical evaluation factors: Experience, Management Approach, and Past Performance; and a Price factor. All three technical factors are equal in importance.
Price is more important than any individual technical factor. ALL EVALUATION
FACTORS OTHER THAN PRICE, WHEN COMBINED, ARE APPROXIMATELY
EQUAL TO PRICE. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for all technical factors. Offerors are cautioned that the award(s) may not necessarily be made to the lowest price offer.
B. “Factors to be Evaluated” has been amended as shown in Bold, below:
B. FACTORS TO BE EVALUATED
Award will be made to the three (3) offerors whose proposals are most advantageous to the Government based upon an integrated assessment of the evaluation factors. A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”, Paragraph C of this section. During evaluations of each proposal, the Government will assign an adjectival rating for each factor with a written narrative evaluation reflecting the identified findings. The following evaluation factors will be used to evaluate each proposal:
Factor 1 - Experience: the following is deleted in its entirety:
Subfactor 1a – Prime Contractor/Joint Venture Experience Subfactor 1b – Subcontractor Experience Subfactor 1a is significantly more important than Subfactor 1b.
Factor 1 – Experience: is revised as shown in Bold, below.
This technical factor evaluates the offeror’s Prime Contractor/Joint Venture Experience.
Paragraph C. “Evaluation Approach”, page 18 of the solicitation, is amended as shown in Bold, below:
C. EVALUATION APPROACH
2. Factor 1 - Experience. Prime Contractor/Joint Venture Experience This technical factor evaluates the Offeror’s proposed company experience in successfully completing projects recent and relevant to the Scope of Work.
The Scope of Work indicates tasks required under the solicitation in descending order of importance.
a. Factor 1. The Offeror will be evaluated on whether the past projects are recent and relevant to the work set forth in the Scope of Work. Recency will be determined by projects completed within the last five years that are similar to the work under 1.2, 1.3 and 1.4 of the solicitation Scope of Work.
Relevancy will be determined by projects shown that demonstrate experience in performing the tasks required by the Scope of Work. Projects should demonstrate successful completion of the types of work encompassed by all of the requirements under 1.2, 1.3 and 1.4 of the Scope of Work. The role the Offeror played in past projects will be considered when determining relevancy. Offerors that demonstrate prior successful experience working together with their proposed JV partners and/or subcontractors on projects that are recent and relevant may receive higher consideration for this factor.
Offerors that demonstrate experience with developing a team (including the Prime/JV and subcontractors) that comprehensively satisfied the requirements of recent and relevant projects may receive a higher rating for this factor. Offerors submitting more projects than the minimum (but no more than five projects total) may receive higher consideration for this factor.
Marginal levels of proposed experience could indicate a lack of understanding concerning mission requirements and may result in the offeror receiving an unacceptable rating or being eliminated from the competitive range.
Subfactor 1b-Subcontractor Experience, page 19 of the solicitation, is deleted in its entirety.
Section C. “Evaluation Approach”, paragraph 3, Factor 2 – Management Approach, subparagraph b., page 19 of the solicitation, has been amended as shown in Bold, below:
b. Whether the proposal contains comprehensive descriptions of duties, roles, major responsibilities, and authorities for the Project Manager, Site Superintendent, CQC System Manager, Site Safety and Health Officer, subcontractors and other personnel. This factor will be evaluated on whether the offeror submits a logical approach to perform the Scope of Work that is consistent with the Sample Task Order management
"The ratings for Subfactor 1a and Subfactor 1b will be combined into a single Factor 1 rating" has been deleted in its entirety.
Subfactor 1a - Prime Contractor/Joint Venture Experience is renamed Factor 1.
approach; proposes qualified and experienced personnel sufficient to manage multiple sites simultaneously at geographically dispersed locations; and demonstrates the offeror’s understanding of the requirements.
“Provides one subcontractor letter of commitment for each subcontractor proposed” is deleted in its entirety.
Offerors proposing subcontractors for Factor 2 may receive higher consideration for Factor 2 if they demonstrate recent and relevant experience working with the same subcontractors in the projects submitted for Factor 1.
Joint Venture (JV) offerors must submit a fully-executed Joint Venture Agreement. Failure to provide a fully executed JV agreement with the proposal will disqualify the JV offeror from award.
Section C. “Evaluation Approach”, paragraph 4, Factor 3 – Past Performance, subparagraph b., page 22 of the solicitation, has been amended as shown in Bold, below:
b. The Government will focus its inquiries on the Offeror’s record of performance as it relates to all solicitation requirements, including cost, schedule, and management of subcontractors. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the Offeror in its proposal and data obtained from other sources, including data in Government files.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses
(29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate
(weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or
"UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SULA2012‐007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG‐OH‐0010
08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the
Davis‐Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the
Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations
Wage and Hour Division
U.S. Department of Labor
200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator
(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator
U.S. Department of Labor
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative
Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board
U.S. Department of Labor
4.) All decisions by the Administrative Review Board are final.
