SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

Requests for Information:

1) Page 15 of 122, Subsection 2: Letters of Commitment shall be included in the proposal for subcontractors in order to be considered for award.

a. Is there a sample letter that can be used as a reference?

(i) No sample letter will be provided as a reference.

b. Is the commitment letter from the Prime Contractor committing to the Subcontractor that they will be used or from the Subcontract to the Prime Contractor stating that they will work on the Contract?

(i) A separate amendment will be issued which may substantially change the solicitation approach to subcontracting.

2) Page 15 of 122, Subsection 3: references “The Past Performance Questionnaires can be found in Appendix D-1”. There is no Appendix D-1 in the solicitation.

a. Appendix D-1 was provided as an attachment to Amendment 0001 to the Solicitation.

3) On page 15 of the solicitation it says that the Past Performance Questionnaire can be found in Appendix D-1. We were unable to find Appendix D-1 or the Past Performance Questionnaire (PPQ) template in the files posted. According to USACE Acquisition Instruction (UAI), the NAVFAC/USACE Past Performance Questionnaire Form PPQ-0, which was standardized in 2011, applies to all procurements for which the submission of PPQs are sought/permitted within the solicitation. Are we correct in assuming that the Form PPQ-0 should be used for this solicitation?

a. Yes. Appendix D-1 was provided as an attachment to Amendment 0001 of the Solicitation.

4) The solicitation W912WJ16R0001 for the New England area is missing several sheets. In particular a number of 300 series drawings are not included in the set posted.

a. There is only one “300 series” drawing included in the Solicitation. The Government does not intend to provide any other 300 series drawings.

5) For a project that does not have a CPARS evaluation, please confirm that offerors can submit a previously-completed PPQ-0 form rather than requesting their customer to complete a new questionnaire. This approach would be consistent with USACE Acquisition Instruction (UAI) guidance on the use, and re-use, of the Form PPQ-0.

a. Yes, offerors can submit a previously completed PPQ-0 form rather than requesting a new questionnaire from the customer.

6) On page 15 of the solicitation it says that “the offeror shall complete Part I of the Past Performance Questionnaire, send it to the customer to complete Part II of the Past Performance Questionnaire, request the completed form in a sealed envelope from the customer and submit it in the sealed envelope with the proposal.” This requirement/request to put completed PPQs in sealed envelopes seems burdensome and unnecessary, especially considering the number of prime and subcontractor PPQs that will be in each offeror’s proposal. Also consider that offerors are instructed to provide NAE with one original and 3 copies of Volume I, which would mean that each customer who completed a PPQ would need to provide 4 sealed envelopes (one sealed envelope with the original PPQ plus 3 other sealed envelopes each containing copies of the completed PPQ). Please consider relaxing or eliminating the requirement for completed PPQs to be provided in sealed envelopes. Perhaps the use of sealed envelopes could be optional, and left up to the customer completing the PPQ to decide. Consider also that the Form PPQ-0, which is prescribed by the USACE Acquisition Instruction (UAI), intends that federal contractors keep completed PPQs on file for use in future proposals – something that they would not be able to do if the forms are in sealed envelopes.

a. The original Past Performance Questionnaire needs to be provided in a sealed envelope and submitted with the original offer. No copies of the PPQ need be provided in the additional copies of the offeror’s proposal.

7) On page 12 of the solicitation it says that “Each file of the proposal shall consist of a Table of Contents, Summary Section, and the Narrative discussion. The Summary Section shall contain a brief abstract of the file.” This sounds like a requirement, perhaps, for each volume of the proposal (Volume I – Technical Information, and Volume II – Price). Is this correct?

a. Yes, this requirement applies to both Volume I and Volume II of the proposal, as it is listed under the subheading “3. PROPOSAL FILES”.

8) On page 18 of the solicitation it says that tasks listed in the Scope of Work are in descending order of importance. Does this mean that vertical construction (SOW 1.2) is more important than horizontal construction (SOW 1.3)?

a. Yes.

9) The solicitation documents include two different sets of wage rates.

Soliciation_Attachment_2.pdf has rates for General Decision Number: NH160009 01/15/2016 NH9 (Modification 1), and Wage_Determination_20160401.docx has rates for General Decision Number: NH160009 04/01/2016 NH9 (Modification 2). Please clarify which rates apply to this procurement.

a. The most recent Wage Determination applies. Note: the most recent Department of Labor Wage Rates are to be included in a contract up to the time of award.

10) This procurement is for a 5-year, multiple-award IDIQ contract with a relatively broad scope of construction services. RFP instructions for Volume I require offerors to identify an adequate number of subcontractors to show experience in the entire breadth of the SOW, and have those subcontractors provide project descriptions and PPQs for relevant projects as well as a signed letter of commitment. This is an unusual requirement because prime contractors on MATOCs like this do not know where exactly the projects will be located, when those projects will start, or what the scope of those projects will be. In order to provide NAE with the best value or lowest cost for construction services, trade-specific work (such as finishes, mechanical work, or roofing work) is almost always competitively procured on a project-specific basis and often involves obtaining at least three quotes from firms interested in that specific requirement. It is not advisable to require offerors on a 5-year regional MATOC to pre-determine which firms they will subcontract their construction trades work to.

Doing so will prevent the Government from receiving the advantages of competitive pricing at the project level. Also, because this is a competitive, qualifications-based prime contract procurement, the 8(a), SDVOSB, and HUBZone firms bidding on the MATOC would be best served by getting commitments from the largest and most experienced firms to provide these construction services. The largest firms are the ones most likely to be able to respond to projects at all five of the installations serviced by NAE and the ones mostly likely to be able to provide the required project descriptions and past performance information. This procurement/subcontracting strategy limits opportunities for small businesses that may be local to a project site and able to provide the best value to the government for specific requirements. As we talk with construction firms in this geographical area about this MATOC, we are finding that some firms (due to different licensing requirements and the distances involved) work in the Hanover area but do not work in MA, and some MA firms will not work in NH. Would the Government please consider relaxing the requirement to provide project descriptions, past performance information, and letters of commitment for subcontractors covering the entire breadth of the SOW? Would it be sufficient, instead, to provide a list of construction firms (potential subcontractors) each prime offeror would include on project bidders lists for each of the trades/disciplines included in the SOW? Past working experience with subcontractors on those lists could be indicated in a concise manner somehow if this is an important part of source selection.

a. A separate amendment will be issued which may substantially change the solicitation approach to subcontracting.

11) For Volume 1: (i) Description of a minimum of two recent and relevant projects, but no more than five projects. Relevant to the MATOC scope or the SAMPLE TAKS ORDER?

a. Beginning on page 18 of 122, under “C. EVALUATION APPROACH” heading, the solicitation states that Factor 1 and its subfactors will be evaluated on whether the past projects are recent and relevant to the work set forth in the Scope of Work.

12) Subfactor 1b. The experience of the offeror’s proposed Subcontractors. The subfactor portion of the proposal shall address the following at a minimum: Descriptions for all proposed subcontractors. Provide no more than two projects per subcontractor. An appropriate number of subcontractors should be proposed to show experience in the entire breadth of work in the Scope of Work. Indicate the work to be self-performed and the work to be performed by subcontractors submitted in their proposal. Relevant to the MATOC scope or the SAMPLE TASK ORDER?

a. A separate amendment will be issued which may substantially change the solicitation approach to subcontracting.

13) The front page block 13B is marked that an offer guarantee is not required but specification section 00 80 00 paragraph 1.8 requires a bid guarantee in the amount of 20% of the bid price or $3,000,000.00 whichever is less. Is an offer guarantee and a bid guarantee the same thing? Will a bid guarantee be required? Will an offer guarantee also be required?

Please clarify.

a. An offer guarantee is the equivalent of a bid guarantee. Block 13B is marked correctly, a guarantee is not required because the task order provided for bidding purposes is a sample.

14) Should the subcontractor letters of commitment be presented in the section for Factor 2 or the section for Factor 3?

a. A separate amendment will be issued which may substantially change the solicitation approach to subcontracting.

15) If there are CPARS evaluations for projects used in the proposal, should copies of those CPARS evaluations be included in the section for Factor 3 (assuming that they, like PPQs, are exempt from page limits)?

a. For government projects that have CPARS evaluations, only the contract number need be provided in the proposal. Inclusion of the entire CPARS evaluation is not required (see page 15, (3)A(i)). CPARS evaluation are exempt from page limits.

16) If PPQs are submitted in sealed envelopes, they will not be included in the electronic copies of the proposal. Please confirm that this is what is expected.

a. Yes, PPQs are to be submitted in sealed envelopes and are not expected to be included in the electronic copies of the proposal.
