About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition prepared by the US Army Engineer District for a fire alarm panel procurement at Rock Island Arsenal. The document justifies the sole-source acquisition of two Simplex 4006 Fire Alarm Panels for the Substation A Modernization project, citing the installation's existing Simplex fire alarm infrastructure and the panels' proprietary technology that prevents integration with alternative brands. The procurement is planned as part of a firm-fixed-price construction contract under FAR Part 16.505, utilizing FY24 O&M funding, with the overall construction contract estimated under a specific dollar amount. A Notice of Intent was posted to SAM.gov on 06 August 2024, and as of the document's date, no responses had been received. The justification is based on the requirement to maintain compatibility with the existing fire alarm system throughout the Rock Island Arsenal.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: US Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059.

2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name item, a fire alarm panel, model 4006 manufactured by Simplex, in the DBRFP for the Substation A Modernization Design at Rock Island Arsenal, Illinois (RIA).

The government will not purchase the panel directly but will include the brand name specifications in the solicitation that will result in a firm-fixed-price (FFP) construction contract. The construction contract is planned to be awarded under a FAR Part 16.505, using FY24 O&M funding. The overall construction contract is estimated at

3. Description of the Supplies/Service: Provide a fire alarm panel for the Substation identified in this project. Specifically, the project will use the following model: Simplex 4006 Fire Alarm Panel. The Arsenal uses Simplex fire alarm panels and reporting equipment throughout the installation. This equipment utilizes proprietary technology;

therefore, Simplex is the only option. The cost of each panel is approximately and the project intends on utilizing two panels.

4. Authority Cited: The statutory authority permitting acquisition of the requirement by Other than Full and Open Competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).

5. Reason for Authority Cited:

(a) Background: This contract for the construction of the RIA Substation A Modernization at Rock Island Arsenal is a O&M project to update the substation providing power to the installation and to the Joint Manufacturing & Technology Center (JMTC) located on Rock Island. Substation A is the primary substation for the Rock Island Arsenal electrical distribution system. It has two main (incoming) breakers, one tie breaker, and twelve feeder breakers, enclosed in a metal building mounted over a concrete vault to facilitate the underground feeders. Due to its age, repair parts are difficult to find and some of the feeder breakers are overloaded in terms of connected load. Furthermore, Substation A has no spare breakers, which will significantly complicate the design and construction of the upcoming FY25 ERCIP microgrid project. This project will construct and commission a new substation to replace the existing substation during FY25. The new substation will contain a total of 24 medium-voltage main, feed, and tie circuit breakers and will be sized to accommodate planned additional loads for both RIA and JMTC and will be a complete and usable facility.

(b) Justification: The Installation already uses Simplex panels throughout the Arsenal.

Since these panels utilize proprietary technology, the only panels that will integrate with the existing system are those manufactured by Simplex.

12. Fair and Reasonable Cost Determination/Contracting Officer Certification: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on previous procurements of Simplex manufactured fire alarm systems, specifically the Model 4006 panel. The cost of the panel is approximately . Therefore, there is only one available source that meets the requirements of the solicitation. I further certify that this justification is accurate and complete to the best of my knowledge and belief.
