About this file
This justification and approval document and related federal contract opportunity outline requirements for the construction of a flight simulator facility at Patrick Air Force Base in Florida. The construction contract requires the contractor to build a two-story facility to house a personnel recovery HC-130J flight simulator. The project is funded by military construction dollars with an estimated value between $10 million and $25 million. The justification document calls for the Schneider SXWASPXXX1000 building level network controller as the sole source requirement due to its compatibility with the base's existing energy management control systems, as specified in technical guidance documents. No alternatives exist. The related federal contract opportunity provides additional details on the full and open competitive solicitation for the design-build project, including the NAICS code, size determination, HUBZone price evaluation factor, and instructions for technical inquiries and proposal submission through online portals.

Personnel Recovery HC-130J Flight Simulator
Schneider / SXWASPXXX1000 Building Level Network
JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
1) Contracting Agency: US Army Corps of Engineers, Louisville District, PO Box 59, Louisville, KY 40201-0059
2) Description of the Action: This justification and approval (J&A) is being prepared for the use of a brand name item, that is a Building Level Network Controller manufactured by Schneider. This Schneider/ SXWASPXXX1000 BLNC is to be a new sole source and brand name requirement for the building level network controller specification in the solicitation for the Personnel Recovery HC-130J Flight Simulator project at Patrick Air Force Base (AFB). The Personnel Recovery HC-130J Flight Simulator project will be funded with MILCON dollars. The estimated cost for the building level network controller system is .
3) Description of Supplies/Services or Nature of Construction: The construction contract requires that the contractor build a two-story Personnel Recovery HC-130J Flight Simulator.
This action requires Schneider / SXWASPXXX1000 building level network controller to be the sole source manufacturer with a specific estimated value of is the approved sole source supplier for Patrick Air Force Base as explained below.
4) Authority Cited: 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only One Responsible Source and No Other Supplies of Services Will Satisfy Agency Requirements.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).
5) Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. This J&A applies that ‘Only One Responsible Source’ authority using the application of FAR 6.302-1(b)(4), which states that “[w]hen the agency head has determined in accordance with the agency’s standardization program that only specified makes and models of technical equipment and parts will satisfy the agency’s needs for additional units or replacement items, and only one source is available.”
a) Background: This project supports the construction of a flight simulator facility consisting of two-story bay for an HC-130J simulator. The purpose of the HC-130J simulator is to provide realistic training and accurately portray the Mission Design Series needed to properly train and increase readiness of the Personnel Recovery community. The facility will house the simulator, loadmaster floor trainer, control systems, training and instructor personnel, classrooms, mission brief/debrief rooms, and administrative support. There are no existing facilities on Patrick AFB that meet this requirement. The attached Engineer Technical Letter (ETL 11-1): Utility Monitoring and control System (UMCS) Front End and Integration (UFC 3-470-01): Civil Engineer Control Systems Cybersecurity (AFGM2019-32-
02) explains that only one manufacturer (Schneider) produces the BLNC that is compatible with the existing system.
b) Justification:
1. FAR 6.302-1(b)(4) permits use of the Only One Responsible Source authority when the agency head has determined in accordance with the agency's standardization program that only specified makes and models of technical equipment and parts will satisfy the
Personnel Recovery HC-130J Flight Simulator
Schneider / SXWASPXXX1000 Building Level Network agency's needs for additional units or replacement items, and only one source is available.
2. Engineer Technical Letter (ETL 11-1): Utility Monitoring and control System (UMCS) Front End and Integration (UFC 3-470-01): Civil Engineer Control Systems Cybersecurity (AFGM2019-32-02) specifies that to function with Patrick AFB’s existing Energy Management Control Systems (EMCS), the Building Level Network Controller (BLNC) must be capable of being backed-up by the existing SmartStruxure Enterprise Server, which provides an Enterprise Level back-up of the entire base wide Building Automation System (BAS).
3. The only BLNC product compatible with the existing enterprise server (SmartStruxure Enterprise Server) in accordance with Engineer Technical Letter (ETL 11-1): Utility Monitoring and control System (UMCS) Front End and Integration (UFC 3-470-01):
Civil Engineer Control Systems Cybersecurity (AFGM2019-32-02) is the Schneider/
SXWASPXXX1000.
4. Impact: If this J&A is not approved, USACE will not be in compliance with Engineer Technical Letter (ETL 11-1): Utility Monitoring and control System (UMCS) Front End and Integration (UFC 3-470-01): Civil Engineer Control Systems Cybersecurity (AFGM2019-32-02). Furthermore, without this brand name BLNC the new facility will not properly interface with the base wide BAS.
5. Alternatives: According to the ETL 11-1, there is no alternative product that meets the need of this project.
6) Efforts to Obtain Competition: As discussed in paragraph 5 above, Patrick SFB requires all renovation and new projects to be completed In accordance with Engineer Technical Letter (ETL 11-1): Utility Monitoring and control System (UMCS) Front End and Integration (UFC 3- 470-01): Civil Engineer Control Systems Cybersecurity (AFGM2019-32-02). Thus, the only suitable BLNC is the Schneider/ SXWASPXXX1000.
7) Actions to Increase Competition: No action shall be taken to increase competition on this brand name portion of the procurement as the Schneider BLNC is the only compatible product. However, the solicitation for the construction work of the Personnel Recovery HC- 130J Flight Simulator project will be competed as a Full and Open Procurement.
8) Market Research: Market Research on the brand name portion of the procurement was not conducted for the reasons cited above. The BLNC system must be manufactured by Schneider in order to be operable at Patrick SFB. The solicitation for the construction work of the Personnel Recovery HC-130J Flight Simulator project will be competed as a Full and Open Procurement.
9) Interested Sources: In accordance with FAR 5.102(a)(6) and FAR 6.302-1(c)(1)(ii)(c), the justification shall be posted with the solicitation, redacted as necessary.
10) Other Factors: None.
11) Technical Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
