About this file

This document contains a justification and approval for using a brand name item in a construction contract. The U.S. Army Corps of Engineers Louisville District will include brand name specifications for a Predator Elite Integration Security Platform manufactured by LINX Defense, LLC in a design-bid-build solicitation for a construction contract. The proprietary equipment includes magnetic switches, motion detectors, glass break sensors, tamper switches, card readers, alarms, electrified locks and power supplies. The estimated cost for the equipment is approximately $XXX,XXX. The justification cites that LINX Defense is the sole manufacturer and that use of any non-LINX Defense parts would compromise the existing system's functionality at the National Air and Space Intelligence Center facilities at Wright-Patterson Air Force Base, where system integration is required. No alternatives were considered viable. The market research conducted included posting a notice of intent to sole source with no other sources expressing interest.

The related federal contract opportunity is a solicitation from the U.S. Army Corps of Engineers Louisville District for the construction of an addition to the NASIC Intelligence Production Center at Wright-Patterson AFB. The projected $100-250 million contract has a 900-day performance period. The solicitation will be issued in two staggers and use a trade-off best value evaluation. The solicitation is available at beta.sam.gov and offers are due in January 2020. U.S. citizenship and Joint Certification Program certification are required to access secure solicitation materials.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.

2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name item, Predator Elite Integration Security Platform, in the firm fixed price construction contract for the Intelligence Production Complex phase III project at Wright-Patterson Air Force Base, Ohio. The government will not purchase the Predator Elite Integration Security Platform equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract is planned to be awarded under a full and open solicitation, using FY19 MILCON funding.

3. Description of Supplies/Services: The proprietary Predator Elite Integration Security Platform equipment will include balanced magnetic switches, motion detectors, glass break sensors, tamper switches, card readers (with/without keypads), local audible alarms, electrified mortise locks, and power supplies; which are manufactured by LINX Defense, LLC, Canton, Ohio. The estimated total cost for the equipment is approximately XXXXXX.

4. Authority Cited: 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).

5. Reason for Authority Cited:

a) Background: The National Air and Space Intelligence Center (NASIC) facilities at Wright-Patterson Air Force Base will connect to existing facilities.

This project will be designed to tie-in to existing building systems so that there is one (1) system protecting the facility.

The existing NASIC facility is currently housed in several buildings (10853, 10822, and 10856) that have been combined into one contiguous facility.

Together these buildings comprise one of the largest SCIF buildings in the Department of Defense. The existing facility is a two-story building that has been renovated/added onto over its existence. It houses analyst workstations, electronics laboratories, and supporting infrastructure. Each time the facility size was increased by an addition, systems such as fire alarm, fire suppression and intrusion detection had to be coordinated to ensure the facility and the users were protected by code-compliant systems.

Due to the classified nature of the work products provided by NASIC, the building has an access control and intrusion detection system. This system must report to the NASIC security office and base security forces. The system includes alarm panels, balanced mechanical switches, door locks/strikes, glass break sensors, motion sensors, card readers for doors (both with and without keypads), and all related infrastructure to power the system. The system is coordinated with proprietary software connecting all of the various system components.

The existing NASIC facilities IDS/access control system is a Predator Elite system; which is a proprietary system. The scope of the Intelligence Production Complex phase III project requires the integration of the IDS/access control system with the IDS/access control system on the existing NAICS facilities.

NASIC is part of the DoD intelligence community. Entities within the intelligence community use a security badging system known as “Blue Badge”. Continuity of the IDS is vital due to the secure nature of these facilities. In addition, this system will allow NASIC personnel to access other “Blue Badge” secure Government facilities housing other intelligence community partners. No other system can provide the required functionality.

b) Justification: LINX Defense, LLC is the sole manufacturer of the Predator Elite Integrated Security Platform, as well as the sole manufacturer for the balanced mechanical switches, door locks/strikes, glass break sensors, motion sensors, card readers for doors (both with and without keypads), and all related infrastructure to power the system.

The IDS/access control system panel, balanced mechanical switches, door locks/strikes, glass break sensors, motion sensors, card readers for doors (both with and without keypads), and all related infrastructure to power the system are comprised of proprietary software and hardware; which is the intellectual property of LINX Defense.

c) Impact: The use of any parts from any other manufacturer would be incompatible with the existing LINX Defense system. The LINX Defense system uses proprietary software and the utilization of parts from other manufacturers will result in communication errors within the LINX Defense system, making it inoperable.

d) Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c). A total replacement cost of the Intrusion Detection System is estimated to be $19,668,100. This cost was not considered in the project planning for construction funding. A total replacement would require additional time and effort to re-program the project and obtain Congressional approval.

6. Efforts to Obtain Competition: Technical capabilities of various manufacturers were reviewed for compatibility to the current IDS/access control system; however the utilization of different equipment would not ensure a single system that coordinates/communicates with local and installation security offices.

A Notice of Intent to Sole Source was posted on 22 JAN 2020 to the beta.sam.gov website. To date, no other sources have written to express interest.

7. Actions to Increase Competition: Apart from the complete replacement of the current IDS/access control system in its entirety, competition will be limited. This is a finite requirement with no anticipated future needs, and therefore there are no actions to increase future competition.

8. Market Research: A Notice of Intent to Sole Source was posted on the beta.sam.gov website. To date, no other sources have written to express interest.

A technical review and evaluation was conducted of the Intrusion Detection system requirements for the NASIC facilities by Wright-Patterson Security Forces, with assistance by NASIC Security personnel. As discussed in paragraph 6 above, only the Vindicator system/equipment will ensure seamless compatibility with the existing Intrusion Detection System.
