ADDENDUM TO 52.212-2

Addendum to 52.212-2 Evaluation – Commercial Items

BASIS FOR AWARD

1. This acquisition will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items, and FAR

13.5, Test Program for Certain Commercial Items, and as supplemented by agency procedures utilizing the Lowest

Price Technically Acceptable source selection process. This is a source selection in which best value is expected to result from selection of the technically acceptable offer with the lowest evaluated fair and reasonable price. Award will be made to the lowest priced offer that receives an acceptable rating in the solicitation evaluation factors

“Technical” and “Past Performance”. Award will be on an “all or none” basis. Offerors are instructed that:

The non-price factors will be evaluated on an “acceptable/unacceptable” basis

The non-price factors are evaluated for acceptability and NOT ranked

Offers are NOT compared to each other

Tradeoffs are NOT permitted

The offerors must provide all required information or the offer will be considered non-responsive

2. In order to be eligible for an award, an offer shall be rated “ACCEPTABLE” on both non-price factors

(Technical and Past Performance).

3. Once the contracting officer and the Technical Evaluation Board (TEB) have identified the offers that are technically acceptable, the contracting officer will make the award decision only on the basis of the lowest fair and reasonable price.

4. The U.S. Government intends to evaluate offers and award a contract without discussions; however, the U.S.

Government reserves the right to hold discussions. It should be noted that there is no obligation on the part of the mailto:francesca.candia.ln@mail.mil http://fedgov.dnb.com/webform

Government to make an award to any offeror in response to this solicitation.

5. Offerors may be asked to clarify some issues regarding the non-price factors to enhance U.S. Government understanding of them. Such clarifications shall NOT be used to cure offer deficiencies or material omissions, enter into discussions, and/or otherwise revise the offer.

6. The TEB will evaluate the three (3) non-price factors listed below. The award will be made to the offeror with the lowest price offer that is rated “acceptable” on all the non-price factors and sub-factors.

- TECHNICAL - Certifications

- TECHNICAL: Experience

- PAST PERFORMANCE

This requirement is for the inspection and testing of the fire prevention and protection system for USAG

Italy (Vicenza) and Poggio Renatico, Italy. It does not include maintenance/repair services. A separate requirement will be competed for the maintenance and repair services. The offeror (individual, subcontractor, or part of a Pool of Firms (Consorzio) that is awarded the contract for the inspection and testing shall not be awarded the contract for the maintenance/repair services.

FACTORS TO BE EVALUATED

1. The term “Offeror” means:

a. An individual firm;

b. The Pool of Firms (Consorzio) / ATI and the firm proposed by the Pool of Firms (Consorzio) / ATI to perform the work.

2. The evaluation factors for this solicitation are:

- Technical and Certifications

- TECHNICAL - Experience

- PAST PERFORMANCE

- PRICE

A detailed explanation of the basis for the evaluation is set forth in this section.

EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB). The technical sub-factors will be rated on an acceptable / unacceptable basis using the following ratings:

Rating Description

Acceptable Offer meets the requirements of the solicitation

Unacceptable Offer does not meet the requirements of the solicitation.

FACTOR I: TECHNICAL AND CERTIFICATIONS

Evaluation: In order to be determined acceptable in this evaluation factor, the offeror must provide all of the following:

1. Provide for each technician (technicians shall be employed directly by the Offeror, not by a subcontractor) that will be performing testing/inspection services under this contract, copy of one or more educational certificates issued by institutions or associations authorized on the Italian territory (i.e.: M.A.I.A; UMAN;

VIGILI DEL FUOCO);

2. Provide evidence of the following for the technical supervisor in the company: each company shall have one technical supervisor that is enrolled in the “Albo professionisti anticendio” with the proper qualification, as per Decreto 05/08/2011.

3. Provide current certifications of the company's qualification as per DM 37/08 “Lettera G”, and a quality system certification in accordance with UNI EN ISO 9001:2008 norms.

4. Provide a written description of the web-based database that they intend to use and share with the COR, in accordance with paragraphs 2.4.6 and 2.4.7 of the PWS. This database can be both in the English and Italian language. To be considered acceptable, the web-based database must be user-friendly (easy to access, password protected, with logical flow and flexible report options) and must provide at the minimum, the same information as in Technical Exhibit D.

FACTOR II – TECHNICAL - EXPERIENCE

Evaluation: The Government will evaluate this factor to determine if the offeror has demonstrated experience on previous projects relevant to the requirement of this solicitation. The TEB will determine if the projects listed are similar in size, scope, and complexity to the requirements described in the PWS and if they are within the last three

(3) years from the date of the offer or 90% complete at the date of the offer. If offering as a Pool of Firms

(Consorzio/ATI), the Government will evaluate the proposed team’s recent, relevant experience. Failure of the offeror to demonstrate recent, relevant experience for itself/Pool of Firms (Consorzio/ATI) will result in an

“Unacceptable” rating for the factor.

FACTOR III – PAST PERFORMANCE

Evaluation: Past performance will be evaluated to determine if the offeror and any major subcontractors have performed favorably for previous contracts of a similar size and complexity as the services required in this solicitation. The Government will evaluate an offeror’s past performance to determine if past performance evaluations and all other past performance information reviewed by the Government (see below) reflect a trend of satisfactory performance. The offeror’s past performance record must be determined to be acceptable or neutral in order to be considered for award. Offeror(s) must demonstrate successful past performance of the offeror and any major subcontractors or partnerships as evidenced by information gathered concerning no more than three (3) contracts and subcontracts completed or ongoing within three (3) years from the solicitation release date as identified in Page 1, Block 6 of this solicitation, which are similar in size and complexity to the services requested in this Request for Proposals. Offeror(s) must submit the information as per Attachment 2 (Past Performance

Questionnaire) for each of the contracts provided. If there are subcontractors or partnerships, they will be evaluated in the same manner as the Prime. Past performance will be rated on an acceptable/unacceptable basis using the following ratings:

Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is known (see note below).

Unacceptable

Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR

15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

1. The Government may consider past performance information from other sources such as: the offeror's former customers, business associates, federal, state, and local government agencies; the Past Performance

Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; interviews with Program Managers and Contracting Officers.

2. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.

FACTOR IV– PRICE

The contract will be a Firm Fixed Price. The Government will evaluate price reasonableness for this requirement.

The price factor will be evaluated separately from the non-price factors.

1. A price reasonableness approach will be utilized by the Government to determine that the proposed prices offered are fair and reasonable and that a “buy-in” or unbalanced pricing between CLINs or option periods is not occurring.

2. The base period and all option years shall be included in the price calculation. Should the Government determine proposed prices are unrealistically low (an indication of “buy-in”), this will be considered a performance risk.

3. As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause

52.217-8) by adding six (6) months of the offeror's final option period price to the offeror's total price. An assessment of the reasonableness of each proposed price will be made. The Contracting Officer will perform a price analysis of each proposal. Offerors are required to price the base and option periods. Offerors shall not submit a price for the potential six (6) month extension of services period. The Government may choose to exercise the extension of services at the end of any performance period (base or option periods).

4. In evaluating price reasonableness, other than cost and pricing data shall be utilized.

(End of Addendum to 52.212-2)
