About this file

This is Amendment 0004 to solicitation W912PB25R3000 for Logistics Supplies and Services Support, issued by the RCO Bavaria office in Grafenwoehr, Germany. The amendment provides answers to questions from 4 vendors regarding the solicitation requirements, with additional questions to be addressed in a future Amendment 0005.

Key clarifications include: this is a Requirements type contract with no minimum order guarantee and Firm Fixed Pricing; proposal instructions are contained in the addenda under 52.212-1 rather than traditional Sections L&M; the contractor must include program management and administrative costs in overall pricing; workload estimates are provided in the ELIN sheet; background check requirements follow Army Europe Regulations 190-16 and 604-1; English proficiency standards require ability to read, write and speak English; contractor must provide all cleaning supplies and consumables; bus service requires drivers and ranges from 5-55 passengers; and services span locations throughout Bavaria with maximum round trip distances up to 900km. The amendment also clarifies that certain items like fuel for government equipment will be provided by the government while contractors must fuel their own vehicles and equipment. Installation access procedures, quality control requirements, and operating hours including 24/7 support during exercises are also detailed.

SUMMARY OF CHANGES

The Purpose of this Amendment 0004 is to:

a. To answer questions from 4 vendors in the format presented to us. *Please note, this is not all inclusive of all questions and there will be a 5th Amendment as we work through the rest of the questions. All other terms and conditions stay the same.

START OF QUESTIONS:

1. From our reading of the Solicitation, the contract will be based on task orders (though not an IDIQ). However, there is no minimum order specified – and no ELINS designated for program management and administration of this contract. With no minimum order specified, the contractor is at risk. PWS states several requirements for administration and contract management, and yet there is no provision for a PMO within the CLIN and ELIN structure. Where do we put the cost of PMO and admin? Deliverable A023 (PWS 1.10.1.2)

This is a Requirements type contract, there is no minimum order. This is also a Firm Fixed Price Contract. This is not a cost type contract. You need to include these costs in the overall prices

2. There are no sections L and M in the solicitation nor in the conformed amendment.

Typically, Section L provides instructions and guidelines for how to prepare a proposal, outlining formatting requirements, page limits, and submission details while Section M provides the evaluation criteria. While some of this data is extant, most of the typical Section L data is missing in this solicitation. We have no guidance on the expectations for the technical and management proposal sections. Will it be provided at a later date?

Will guidance on proposal format be provided elsewhere?

It is required that a potential vendor read the entire solicitation. In this solicitation there are instructions in the addenda under 52.212-1, Instructions to Offerors and evaluation criteria in the full text copy of 52.212-2, Evaluation. Additionally, this an SF1449, and there are no such sections.

3. Is this a presolicitation or an actual solicitation? Information is confusing – www.sam.gov shows that the Solicitation was issued on 20 Dec, Presolicitation on 21 Dec, then Solicitation (Updated) on 26 Dec. Much standard solicitation information is missing or hard to find. Why was the presolicitation released on 21 Dec, after the solicitation?

The presolicitation is not an actual solicitation. The pre-sol was released in Oct not after the

Solicitation.

4. Are there an estimated number of task orders to be issued on this contract in the base year? Is there a schedule for issuing task orders?

No, there no estimate.

5. The government has provided no workload data. Without such data, the incumbent possesses an insurmountable advantage and this RFP is mostly non-competitive in nature. In addition, without an expected task order schedule, the included ELINs could easily exceed the 6M Euro limitation per task order depending on how they are combined. Is the government going to provide workload data, standard task order schedule, and/or some guidance regarding expected operations in the base and option years?

This is a requirements type contract and the offer need to be based on the estimates of the ELIN sheet.

6. Is this LSS requirement currently fully funded?

No. This is a Requirements Type Contract. Funded Task Orders are provided off this contract.

7. Due to the absence of workload data, the lack of expected task order schedule, the late scheduling of the site visit (7 Jan 2025 – almost 3 weeks after RFP issue), the holiday period in Germany, and missing Section L and M data within the issued RFP, we respectfully request that the solicitation due date be extended to no earlier than 17 Feb 2025. As it stands, the extant RFP is practically non-competitive for any bidder other than the incumbent.

This is a Requirements type contract, there is no minimum order. This is also a Firm Fixed Price Contract. This is not a cost type contract. You need to include these costs in the overall Prices.

PWS Page 2

1. Quality Control Plan (QCP):

PWS Section 1.5.1:

What criteria will the Government use to determine if the QCP is acceptable beyond the listed components?

Please read PWS section 1.5.1.2 Are there specific penalties if the Contractor fails to meet the QCP submission timelines (e.g., Deliverables A001, A002)?

At a minimum, this would be a Corrective Action Request (CAR)

2. Operating Hours:

PWS Section 1.5.6.3:

How will deviations in contractor support hours during emergencies or unexpected Government facility closures be handled financially or operationally?

As written in 1.5.6.3.1, Contractor Schedule The scope of the work requires the contractor to use flexible employment and scheduling techniques to provide logistical support. The requirements are such that normal business hours are not applicable. During exercises, the training environment shall require 24-hour-a-day, 7-days-a-week contractor support services. Hours of work begin on the first day of the scheduled rotation.

3. Training Holidays:

PWS Section 1.5.7:

Will additional costs incurred due to rescheduling during training holidays be reimbursable?

This is a FFP contract and the contractor is expected to work during military training holidays and regular holidays as written in the PWS, as per the task orders.

4. Installation Access:

PWS Section 1.6.3:

If delays in installation access arise due to regulatory processing, will the Government provide schedule relief or compensate for lost time?

No

5. Background Checks:

PWS Section 1.6.4:

What are the exact requirements for background checks for subcontractor employees?

Army in Europe (AE) Regulation 190-16 (AE Regulation 190-16)

Installation Access Control or (AE) Regulation 604-1 There are comparable documents in submitting for base access. However, for applications requesting base access the application 190-16 has the same request of supporting documents as the 604-1B, such as police background check, translation of police background check, (both documents must have a notary stamp), foreign ID Card and/or passport. The only difference between 190-16 and 604-1B is that 604-1B’s police clearance certificate doesn’t need a translation with a notary stamp. If the contractors/sub-contractors do not have a residence in Germany, then they do not need to fill out AE 604-1.

If the Contractor lives in Germany (has a residence), then they are required to fill out AE 604-1B with correct information and have the supporting documentation prescribed in AE 604-1. The appointed government official must then submit all documents to the USAREUR-AF Local National Screening Program (LNSP) data base. The only required documents for LNSP submissions are listed below.

1. AE Form 604-1B

2. GCC (Police Clearance Certificate)

3. Photo Identification

4. Proof of residence if applicant is a non-German Citizen

(Anmeldebestaetigung/Rayhaus Registration). The move-in date ("Einzug") on the Rathaus registration must match the date written on the AE Form 604-1B or the LNSP request will be returned.

While LNSP applications are processing, ( please keep in mind the LNSP data base must identify the applicant as *processing* ) then the Contractor can request a 90 day ID pass from the IACS office in which I can submit for them.

Once the LNSP data base has validated the AE 604-1B and supporting documents, the government sponsor may then request a Contractor ID Pass on AE Form 190- 16 for base access through DBIDS from the IACS office. After the ID Pass has been approved from IACS, the base access is only valid during the Contract Period of Performance.

6. Key Personnel:

PWS Section 1.10:

What is the standard for proficiency in English?

Must be able to read, write, and speak English in order to communicate with Government employees.

Are there specific qualifications required for other non-key personnel beyond what is listed for key personnel?

There are no non-key personnel.

7. OCIs and Conflict Resolution:

PWS Section 1.18:

Will the Government provide guidelines for acceptable OCI mitigation plans, or is it at the sole discretion of the Contracting Officer?

As written in this section, the, “The Contractor’s OCI Mitigation Plan will be determined to be acceptable solely at the discretion of the Contracting Officer.”

8. Safety:

PWS Section 1.20:

If there is a conflict between German and U.S Safety Standards, which takes precedence? This question also goes for any other regulations that may have conflicts, how are they typically resolved?

Whichever standard is more strict takes precedence.

9. Safety Standards:

PWS Section 1.20.2:

Are subcontractors required to develop their own Accident Prevention

Plans (APP), or can they rely on the Prime contractor's plan?

The prime contractor is responsible for the subcontractor

10. Environmental Compliance:

PWS Section 1.21:

How will disputes over contamination cleanup responsibility or costs be resolved?

Case by Case

11. Required Training

PWS Section 1.22:

Who will bear the cost for the required trainings and certifications?

These trainings are online and not cost associated.

12. Government Property Accountability:

PWS Section 3.4:

Are there predefined thresholds for incidental damage where penalties or deductions will apply?

No.

13. Material Procurement:

PWS Section 4.3:

If the contractor uses Government supply sources (e.g., GSA), will the

Government provide guidance on approved procurement timelines?

The supplies need to be available as requested through each Task Order.

14. Vehicles and Equipment:

PWS Section 4.4:

Are there specifications for what constitutes "unsafe" dependant on host nation regulations? Or the COR?

Organic safety standards pertaining to the individual vehicle or equipment are expected to be adhered to. For example, Mechanical incompetencies that linger and are not fixed in a timely manner jeopardize safety and need to be removed from operation when the issue is recognized.

Regular maintenance and upkeep of vehicles and equipment are expected.

It states that “The Contractor is responsible for all fuel required to fulfill the requirements of this contract.” There is some conflict with page 35, Section

5.7.4 Refuelling: where it states, “Fuel shall be provided by the Government.”

This section refers to contractor furnished items. The contractor is responsible for fueling his own vehicles

15. Final Inspections:

PWS Section 5.2.5:

If discrepancies are found during final inspections, will there be an opportunity to resolve issues without penalties?

Yes.

16. Scheduled Maintenance:

PWS Section 5.2.7:

Are there predefined standards for suitable replacements during unscheduled maintenance events exceeding 24 hours?

A suitable replacement of similar capacity that can continue without interfering with the objective/mission is determined by the contractor.

17. Bulk Water Distribution:

PWS Section 5.4.3:

How will compliance with Army Medical Publications (e.g., TB MED

530, TB MED 577) be monitored and verified by the Government?

The COR will conduct inspections as detailed in the Quality Assurance

Surveillance Plan.

18. Field Dining Operations:

PWS Section 5.5.2:

Will the contractor be reimbursed for costs incurred due to

Government-maintained kitchen equipment that is non-functional or unavailable?

There should be no costs incurred as Government Equipment is maintained and repaired by Government personnel.

19. Employee Uniforms:

PWS Section 5.5.2.2.3:

Will the Government provide sample standards for uniforms?

Per PWS paragraph 5.5.2.2.3 Employee shall wear a clean and complete uniform when working in accordance with TB MED 530 and TRI Service Food Code. The Contractor shall provide employee uniforms, nametags, and any other specialty clothing (gloves, hair restraints, beard nets, aprons, etc). All uniforms shall be in good condition, with no holes, tears, or heavy stains.

Nametags shall be always worn on the exterior clothing in a conspicuous location. Uniforms shall be freshly laundered and well fitting. Employees shall not be adorned with facial piercing, jewelry chains on the uniform and shall not wear earrings. The uniforms shall not contain commercial advertising, except for the Contractors name.

20. Performance Standards for Field Equipment:

PWS Section 5.6.1:

If equipment replacements cannot be sourced within the specified 4-hour window due to supply chain constraints, will penalties be applied?

Possibly. Depends if mission was negatively impacted.

21. Contractor Provided Maintenance Tents

PWS Section 5.6.9 and 5.6.10:

Can you provide the document codes for the relevant regulations regarding tents setup, maintenance and layout?

Q1. Ref. Attachment+2+-+Exhibit+Line+Item+Sheet Regarding the pricing for the distribution of Class III, IV, and V materials, could you kindly clarify what the term "each" refers to as the unit of measure in this context? Specifically, we are seeking to understand the definition when the exact nature of the materials to be handled is not yet specified.

Class III, IV and V have a unit of measure of either “per day” or “per half day” due to task being billed in such a way according to the loading, travel and unloading of the requested item.

Q2. Ref. Attachment+2+-+Exhibit+Line+Item+Sheet Forklift with Operator: Could you confirm the expected daily usage (in hours) for the forklift with the operator?

This is task order and exercise dependent.

Q3. Ref. Attachment+2+-+Exhibit+Line+Item+Sheet Cleaning Services: Are we expected to provide consumable materials such as toilet paper, hand paper, and soap as part of the cleaning services?

Yes. Refill and restock.

Q4. Ref. Attachment+2+-+Exhibit+Line+Item+Sheet Shuttle Bus Services: Could you clarify whether the shuttle bus is expected to include an operator/driver, or if it is just a rental of the vehicle?

The contractor will include the driver.

Q5. Ref. Attachment+2+-+Exhibit+Line+Item+Sheet We seek clarification on the pricing approach for line items 5-14, where the unit of measure is listed as "each." Could you provide additional guidance on how "each" is defined in this context to ensure our pricing aligns with the expectations and requirements?

Each unit is per item in the description. A training unit may request a certain amount of an item, that number would be placed into the Quantity column to annotate how many the contractor is distributing.

1. ELIN A001 to A020 – Distribution of Government Assets

a. The unit of measurement is listed as "each.", does that mean each per. Day, each pr. PoP?

Each per item, per PoP.

b. Should all tents be delivered at once, or over multiple stages?

Tents need to be operational as of the POP date. How it is delivered is the contractor responsibility.

c. What is the duration for each line item?

Duration will vary based on Task Order. Do not fill this block out. This is for the Task Orders.

d. Do you require pricing for moving the estimated quantity in one instance, or will the assets be moved in different quantities upon request?

The quantities are estimates and actuals will vary based on the task orders.

e. If the latter, could you clarify the minimum amount to be moved in each instance for a more accurate estimation?

There is no minimum.

f. Location: can you please advise the current location of these government assets (purposes of estimating the transportation times / costs), also, if the assets are at ground level.

They are located on each base

g. Is the contractor responsible for wiring, connection, installation and maintenance (incl. Fuel supply) for the generators?

Yes.

h. Is there any truck access to the loading site? and is there any Material handling equipment that can be utilized? or it has to be contractor provided?

A preponderance of loading sites in the training area are expeditionary areas (wooden areas and open fields). Areas in the camps are mostly open fields with some concrete pads. There are limited on and off-loading docks for trucks. Vendors must bring their own MHE.

2. ELIN A021-AA035 and A037-A051 – Bulk Potable Water Distribution

a. Can you confirm that the pricing is to distribute up to the maximum estimated amount requested?

This is only an estimate.

b. Does "unit price per day" mean multiple deliveries will occur in one day, or does a single delivery count as one day of service?

“Unit price per day” means single delivery.

c. What is the unit of measurement for ELIN A021-A035 Per day as stated in the ELIN sheet

d. Do the facilities have access to the fresh water pipeline/city water distribution system?

Most camps do have access to city water, some camps don’t.

e. Is there a certified supplier for portable water?

You may mean potable water. Per PWS paragraph 5.4.3.1. BULK Water is only provided from an approved potable water source on the installation.

f. What is the capacity of the Fixed Water Storage Container This information is not relevant to pricing

3. ELIN A052 and A036 – Bulk Potable Water Distribution

a. What is the minimum volume (CM) to be moved in one trip?

The minimum would be 35 gallons. Contractors must be prepared for an increase in bulk water distribution during POP which is based on personnel consumption once identified.

b. Does the estimated quantity represent the total volume to be moved during the performance period?

The estimated quantity is the estimate per year.

c. What is the capacity of the tank?

The tanks are Water Buffalos and Water Hippos as described in the PWS 5.4.3.4

d. Please clarify the purpose of the tank. Is the intention that Contractor fill the tank with water, and then distribute water from the tank to the participants?

The contractors will refill bulk freshwater tanks to provide freshwater water to participants.

4. ELIN A053-A084 – Distribution and Helicopter Fueling

a. Does the estimate align with the number of participants? The provided figures seem inconsistent with a per-day pricing structure.

Estimates aligns with the number of participants the training event is supporting. Disregard

A068 and A084 as they have been revised in Amendment 0003

b. As the bulk water, what is the relation between the number of participants and the quantity of liters per participant?

Estimates aligns with the number of participants the training event is supporting.

c. Can you please clarify how the fuel is stored?

Bulk fuel is stored at both GTA and HTA via DLA-E harden structure and concrete FARP pads.

e. ELIN A068 – Distribution of Government Assets: Class IV

This ELIN is now RESERVED in the new ELIN sheet

f. ELIN A085-A095 – Class IV Material and Class V Ammunition

a. What are the minimum and maximum quantities required for distribution?

Minimum 1, Maximum (Est.) 38

b. The request for distribution per day or half-day seems unusual—can you provide further clarification?

Class IV and Class V is billed in such a way according to load, travel and unloading time.

c. Please provide more details on the cargo weight / dimensions per distribution Size will vary depending on requirement.

d. Will the USG provide the necessary permits to transport the ammunition? or is it the contractor's responsibility to obtain such permits?

The Government will provide the training for the permits

e. What class of ammunition is being transported. (Some classes will need escort service) This is provided to awardee

f. If an escort service is required, will the Government provide this?

Yes

g. ELIN A093-A130 – Field Dining Facility and Food Service

a. Should we base our proposed price on the maximum number of participants pr. Line item?

Yes.

b. For the estimated quantity per day, does this imply providing food service for three meals daily?

Yes, 3 meals daily and perhaps a mid-night (late night) meal, as written in 5.5.1.1

c. Please provide the meals standard requirements, as the menu is not the responsibility of the contractor to plan. Please specify the need for alternative meal options (e.g vegetarian, halal etc.)

This is not relevant to the pricing because the Government orders the meals.

d. Will each site have their own kitchen facility at the contractors disposal?

No. Some sites require food to be prepared at a dining facility in one camp and then transported to another field feeding tent.

e. Is it mandatory that food is produced on site, or can it be delivered in boxes from an external kitchen?

Prepared on site.

f. On the site visit, it was stated that meals occasionally will have to be transported between the kitchen and the training areas.

i. Who is responsible for this transport The Contractor

ii. How frequently do you expect deliveries to be necessary?

Depends on the training schedule of the individual unit.

iii. How many pax do you expect will need to dine at training sites?
