UPPER RIVER LAND REPAIR

QUESTIONS AND ANSWERS:
1.) Will materials for project be tax exempt?
CT RESPONSE for #1 :
The Awarded Contractor can request Tax Exempt Forms after the contract is awarded.
2.) Do we have to pay sales tax on rental equipment?

3.) Under section 15, sub section 1.0, the RFP states: "The Contractor shall provide for the necessary maintenance, including repair, labor, and replacement parts and materials required for continuous operation of Contractor and Government furnished equipment. No separate payment for equipment maintenance will be made and all Contractor costs shall be included in work for which payments are provided for."
Furthermore under section 15, subsection 2.1, The RFP states: The Contractor shall provide an adequate storage facility/container at the Rivers Project Warehouse Compound to house all Government Furnished equipment to protect and keep Government furnished equipment free from damage and the elements. The Contractor shall be responsible for replacement of all materials and equipment damaged during storage, handling, and operations at no additional cost to the Government.
For approximately 24 months the Government Furnished Materials and Equipment (GFME) in subsection 2.4, 2.4.1, 2.4.2 and 2.4.3 have been installed in the designated location within the Wood River Levee District IOP. These items are exposed to the elements and are not in a stored possession of the Government. What is the responsibility to the contractor for a reasonable inclusive payment under subsection 1.0 and maintaining the GFME under subsection 2.1 under these circumstances? It is estimated that some replacements will have to be purchased and several hours of maintenance will have to be performed on these items to bring them back into compliance with subsections 2.1 and
4.2.1.1, which states: "Once directed by the Contracting Officer’s Representative, the Contractor shall remove all Standpipe Assemblies in the following order:
1. Remove standpipe assemblies completely from the relief well pipe.
2. Clean and disinfect standpipe assemblies and inspect for damages.
3. All Government Furnished Property shall be restored, repaired, or replaced to original condition.
4. All Government Furnished Property shall be turned over to the Contracting Officer's
Representative at the Rivers Project Office Warehouse Compound where the contract shall properly store all standpipe assemblies in a suitable storage container provided by the Contractor.
5. Re-assemble relief well housings lids to as good as or better condition prior to disassembly."
CT RESPONSE for #3:
During the RFP process for issuance of a task order for the Wood River IOP operation, the Government and the Contractor shall conduct an initial inspection to determine the current condition of all GFME property. The inspection shall determine what GFME is in good working condition that can be properly used and what GFME needs to be decommissioned and ultimately replaced. Both the Government and the Contractor shall agree on all findings during the inspection process.
Upon completion of inspection of what GFME is in good working condition and what GFME is to be replaced, the Government will modify the RFP to include replacement of GFME determined to be unsuitable for operations. Payment for new GFME shall be made under the corresponding line items in which each new GFME relates.
Once unusable GFME is replaced and a task order for Wood River IOP has been issued, a ENG 4900 property transfer form for all Wood River IOP GFME will be issued to the Contractor and GFME will then become the Contractor’s responsibility until returned back to the Government utilizing the ENG 4900 form.
4.) Under section 15, subsection 3.3, the RFP states: "The Contractor shall also supply one, 5 foot length of 2 inch diameter metal pipe for each relief well, to be connected to the end of each 300 foot length of hose." In order to obtain the amount of 2" rubber hose needed to meet the 72 hour installation requirements under section 15, subsection 4.4.1 WRLDD IOP Air lift Pumping Mobilization, is the contractor required to purchase and store the hose prior to issuance of a task order or will the Government, after the awarded contract, issue a task order to cover both the cost of the items needed and the storage of the items under section 15 to meet the 72 hour installation requirement?
CT RESPONSEfor #4:
As per the specifications indicate, upon notification to mobilize, the Contractor is required to provide all items, materials, equipment, and incidentals needed at that time so that Air- Lift Pumping Operations can commence immediately once notification from the Contracting Officer is received. All costs associated with those items, equipment, materials, and incidentals needed should be included in the mobilization price.
5.) Under section 15, subsection 5.10, the RFP states: "The Contracting Officer will compute measurement for WRLDD IOP Storage Container per job for the procurement, delivery and placement of a storage container to house all Government furnished WRLDD IOP property.
Storage container be utilized for storage of all standpipe assemblies as well as all air manifolds."
How is this measurement computed? At what time does the Contractor receive GFE thru the EF4900 per subsection 2.2 and for what duration is the Contractor required to store the GFE?
CT RESPONSE for #5:
Measurement for a storage container will be computed as a lump sum/job price for the purchase, delivery and placement of the container at a location designated by the Government. Upon completion and once payment is made to the Contractor, the Government shall then take full ownership of container at that time, as indicated in paragraph 4.8.1, WRLDD IOP Storage Container, “Upon installation the container shall be transferred to government property.”.
The Contractor will receive the GFE thru the ENG 4900 form once a task order has been issued to perform Wood River IOP Operations. During the performance period of that task order the Contractor will be responsible for all GFE. Upon completion of performance and once notified by the Government to remove all GFE from operation, Contractor shall comply with subsection 4.2.1.1 and store GFE inside the storage container in an organized fashion, unless Contractor is directed otherwise by the Contracting Officer. At that point, coordination of storage of GFE shall take place between Contractor and Government. The Contractor and Government will inventory all GFE and contractor will transfer back to the Government via ENG 4900. The contractor will be relieved of all responsibility of GFE until new task order is issued for Wood River IOP Operations.
6.) Since section 15, sub sections 4.1.1.a and 4.1.1.b are in an installed state, are you relieving the Contractor of the requirements of 4.1.1.2, 4.1.1.3 and 4.1.1.4 until the subsection 4.2.1.1 Standpipe Assembly Removal has been completed? If not, what items should be included under the first task order to perform this work?
CT RESPONSE for #6:
Yes, unless new or replaced standpipe assemblies are installed. At that time, requirements stated under 4.1.1.2, 4.1.1.3, and 4.1.1.4 shall be conducted by the contractor.
7.) Has the District Industrial Hygienist tested any of the sites that will be covered under section 15 for any contamination? It is know that human waste is discharged into the water that surrounds the relief wells by the adjacent wastewater treatment plant during flood stage and that all employees working on this project are required by EM-385-1-1 to have Hepatitis A, B and C vaccinations. Any information from the Hygienist would be helpful in determining any additional PPE or procedural cost before bidding.
CT RESPONSE for # 7:
It is unknown at this time if the District Industrial Hygienist has tested the area for contamination. Recommend referring to the EM-385-1-1, Section 3, 03.A.05, 03.A.05(a), 03.A.05(b), and 03.A.05(c) for reference to Blood-Borne Pathogen Programs and Section 01.F Emergency Operations to include Appendix B, Emergency Operations which should be part of your companies Safety Plan and Accident Prevention Plan.
