- Quantity will be updated

Question 2 - The quantity shown on the bidding schedule for CLIN 0020 “CMP Culvert 60” Dia.” doesn’t correspond to the details and configuration shown on Dwg. C-08. Please provide us with the desired length of each of the (9) 60” Dia. Culverts and correct the quantity for this

CLIN.

Question 3 - The quantity shown on the bidding schedule for CLIN 0021 “CMP Culvert 72” Dia.” doesn’t correspond to the details and configuration shown on Dwg. C-08. Please provide us with the desired length of each of the (5) 72” Dia. Culverts and correct the quantity for this

CLIN.

Question 4 - The quantity shown on the bidding schedule for CLIN 0022 “Stone_R-90” doesn’t correspond to the details and configuration shown on Dwg. C-08. Please verify that the quantity shown is correct or adjust as necessary.

Question 5 - Section 33 40 01.00 12, Paragraph 3.1.3 requires the Contractor to remove unstable soil incapable of supporting the pipe and replace the material with sand or crushed stone, then compact. Since the Contractor has no way of determining the depth to which unstable soil will be removed, please add a CLIN for No. 610 Limestone Bedding.

- Sand used to backfill excavation will be paid for under Bid Item 0009, “Sand Fill”. No additional CLINs will be added.

Question 6 - On Dwg. C-01, the detail for the “Temporary Access Road” shows the road ending short of the new levee. On Dwg. C-07, Detail D-1, it states “Contractor to Continue Temporary Access Road”. Will the quantity of Sand Fill and Embankment Compacted Fill needed to connect the temporary access road with the levee be measured and paid for in the Optional Work CLIN’S 0017 and 0018?

- No. The extension of the temporary access road is temporary work and will not be covered by the referenced CLINs. Contractors means and methods will determine extents of the road to complete the work shown in the plans and specifications.

Question 7 - On Dwg. C-06, Turf Establishment is shown only for the Stage 3 - Design Section.

Given the 90-week hold period between Stage 2 and Stage 3 construction, will the Contactor be required to establish permanent turf by seeding, fertilizing and mulching after the completion of Stage 2 or is temporary seeding sufficient?

- The contractor will be required to establish permanent turf upon completion of Stage 3.

Contractor shall prepare the stage 2 embankment in accordance with "Foundation Preparation" paragraph prior to placing fill.

Question 8 - The settlement gage detail shown on Dwg. C-10 shows a riser pipe welded to the plate. This typically causes issues at the jobsite with levee construction, especially when placed near the centerline of the levee. As levee fill for this project is relatively shallow, plates can be easily located utilizing GPS coordinates and probed for final elevations without the use of risers.

Can the riser pipes be changed to optional?

- No.

Question 9 - Section 31 11 00.00 12, Paragraph 3.4.1 allows the Contractor to disposed of debris from clearing and grubbing by either burning or removal from site. Given the close proximity of the project to the Port of South Louisiana Executive Regional Airport, will the Contractor be allowed to have open burning?

- See specification Section 31 11 00.00 12, Paragraph 3.4.2 (Burning). A burning permit may be required. Paragraph 3.4.2 states Contractor is responsible for obtaining all necessary permits prior to burning operations.

Question 10 - Section 31 24 00.00 12, Paragraph 1.3.2 states that “Measurement of settlement for Stage 2 shall be during construction of Phase 2. Stage 2 settlement shall immediately end after the measurement of each settlement plate in accordance with paragraph Settlement of Foundation. The same requirements for Stage 2 apply to Stage 3 as it relates to settlement”.

If settlement that occurs from the end of Stage 2 to the beginning of Stage 3 construction (or during the 90-week hold period) is not measured for payment, will the Contractor be allowed to conduct new original levee cross-sections for payment purposes prior to commencing with Stage 3 construction?

- The settlement that occurs during the hold period between stages 2 and 3 will be paid for under Stage 3 construction. The plans require the Contractor to bring the section back to Stage 2 dimensions prior to placing Stage 3 fill.

Question 11 - Section 01100, Paragraph 4 “Inspector’s Field Office” states that the Contractor is required to furnish an office trailer for the use of the Government employees throughout the contract period. Will the office trailer with all necessary utilities be required for the full 90-week hold period between Stage 2 and Stage 3 construction when no work is being performed on the project?

- Yes.

Question 12 - Section 01100, Paragraph 4 “Inspector’s Field Office” states that the Government and Contractor’s field offices shall be placed within the project right-of-way or limits of construction. Since there are inadequate utilities at the site of construction, can the buildings be located off of the project limits, but, at an approved location within a reasonable distance from the project?

- Yes. Note that there are adequate utilities for trailers at the entrance to Road D from Airport Road as shown on drawing C-11.

Question 13 - Please confirm that in Section 01100, Paragraph 14b “Floodwall Alignment Layout” is not applicable to this project.

- The paragraph is not applicable to this contract and will be removed.

Question 14 - During the 90-week hold period between Stage 2 and Stage 3 construction when no work is being performed on the project, will the Contractor be required to complete and submit through RMS Quality Control Reports for each calendar day?

- If no work is being performed, no RMS Quality Control Report is required.

Question 15 - Contractors will likely demobilize from the project site upon completion of Stage 2 construction and re-mobilize to begin Stage 3 construction. Please consider adding a second Mobilization and Demobilization CLIN to the bidding schedule to cover this.

- No additional CLINs will be added.

Question 16 - The Office of the Under Secretary of Defense has recently issued two memorandums, “Guidance on Inflation and Economic Price Adjustments” and “Managing the Effects of Inflation with Existing Contracts”, concerning Economic Price Adjustment (EPA) clauses. Considering the continued volatility in the economic and labor markets and the duration of this contract (1,370 calendar days), would the Government consider including an EPA clause in this contract? The addition of this clause is crucial in establishing a fair unit price for CLIN

0010 “Surfacing Berm Road” since limestone suppliers are now including a “Force Majeure” clause and rarely hold their prices beyond one year.

- No.

Question 17 - Based on engineering analysis performed for this project, what is the anticipated depth of settlement that will occur for the Stage 2 Design Section during the 90-week hold period?

- Between 2.5 and 3 feet.

Question 18 - Please provide bidders with estimated quantities on items of work for which bids are being solicited on a job basis.

- Bypass Canal Excavation -OW is approximately 9,200 CY

- Drainage Canal Excavation is approximately 105,000 CY

- Clearing and grubbing area is approximately 45.6 ac.

Question 19 - Please confirm that the Estimated Quantities for CLINs 0004, 0005, 0010, 0020, and 0022 are correct.

- Clin 0004 is correct, 0005 will be updated, 0010 is correct, 0020 will be updated and 0022 will be updated.

Question 20 - DWG C-09, Detail K-1 shows the levee transition from the Limit of Full Levee Section to the existing ground. Detail K-1 depicts a 1V:3H slope from the top of the new levee to the berm, while DWGs C-01 and C-04 depict a 1V:10H slope. Which is correct. Please advise.

- Profiles will be updated to show 1:3 instead of 1:10.

Question 21 - Please forward us a copy of the Government estimated quantities for CLINs that are bidding on a JOB basis.

- Refer to response to question 18.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED

TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE

DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR

AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor. If implemented the Government will exercise the OPTIONAL WORK, no later than 60 days after Notice to Proceed (NTP). Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.

NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s).

** If an option is to be exercised at the time of contract award FAR17.208 shall be used in place of FAR 52.217-5.

NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF

OPTIONAL WORK. In the event that OPTIONAL WORK items are exercised under the terms of the contract, the time required for completion of the contract shall be 60 calendar days in addition to the original contract duration of 1,370 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF

WORK (FAR 52-211-10 – APR 1984)”.

EVALUATION OF SUBLINE ITEMS (Dec 2019 - AFARS 5152.211-9000).

Item Nos. 0009 and 0012 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its subline items.

(End of Clause)

VARIATIONS IN ESTIMATED QUANTITIES - SUBLINE ITEMS (Dec 2019) - AFARS 5152.211-9001).

This variation in estimated quantities clause is applicable only to item Nos. 0009 and 0012.

(a) Variation from the estimated quantity in the actual work performed under any second or subsequent subline item or elimination of all work under such a second or subsequent subline item will not be the basis for an adjustment in contract unit price.

(b) Where the actual quantity of work performed for item Nos. 0009 and 0012 is less than 85% of the quantity of the first subline item listed under such item, the contractor will be paid at the contract unit price for that subline item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause at Federal Acquisition Regulation (FAR)

52.211-18, VARIATION IN ESTIMATED QUANTITY.

(c) If the actual quantity of work performed under item Nos. 0009 and 0012 exceeds 115% or is less than 85% of the total estimated quantity of the subline item under that item and/or if the quantity of the work performed under the second subline item or any subsequent subline item under item Nos. NONE exceeds 115% or is less than 85% of the estimated quantity of any such subline item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, VARIATION IN ESTIMATED

QUANTITY.
