**The unit "JOB" as used in this Bidding Schedule is synonymous with the term "Lump Sum" used elsewhere within these plans and specifications.

Award will be made as a whole to one bidder.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED

TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE

DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR

AWARD.

00010-7 ED 18-035

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 4: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;

http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx

NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTION WORK Items by written notice to the Contractor. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.

NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s).

NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF

OPTIONAL WORK. In the event that OPTIONAL WORK items are exercised under the terms of the contract, the time required for completion of the contract will not be adjusted but shall be performed concurrent with the original contract duration of 634 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND

COMPLETION OF WORK (FAR 52-211-10 – APR 1984)”.

SECTION 00130 – PROPOSAL EVALUATION CRITERIA

PART 1 GENERAL

1.1 SCOPE

This solicitation is a Request for Proposals (RFP). Proposals will be evaluated by a Source Selection Evaluation Board (SSEB) comprised of representatives of the New Orleans District Corps of Engineers. Proposals will be evaluated in accordance with the Best Value with Trade Off Source Selection Method.

The Government intends to evaluate proposals and award a contract without discussions. Therefore, offerors shall submit their best terms from a cost or price and technical standpoint as offerors may not be afforded an opportunity to revise their proposals.

1.2 SOURCE SELECTION USING THE TRADE-OFF PROCESS

The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical merit/quality and allows the Government to accept other than the lowest priced offer or other than the highest technically rated offer. The award decision will be based on a comparative assessment of proposals against all source selection criteria in the solicitation.

1.3 EVALUATION FACTORS

a) TECHNICAL NON-COST FACTORS:

1. Past Performance

2. Technical Approach

3. Key Personnel and Project Management Plan (PMP)

4. Small Business Commitment Document (SBCD)

b) COST FACTOR:

5. Price

1.4 RELATIVE IMPORTANCE OF PRICE TO THE TECHNICAL EVALUATION

FACTORS

The Government is concerned with striking the most advantageous balance between Technical Merit (i.e., quality and timeliness) and cost to the Government (i.e., price).

Where competing technical proposals are determined to be substantially equal, price could become the controlling factor.

00130-3

1.4.1 Evaluation Criteria

The Government will evaluate each of the four (4) non-cost factors and rate the proposals. Non- cost factors are not all equal in importance. The following terminology is used to describe the relative importance of each non-cost factor:

(1) SIGNIFICANTLY MORE IMPORTANT. This factor is of greater value than other factors. It is approximately twice as much as the next valued factor.

(2) SIGNIFICANTLY LESS IMPORTANT. This factor is approximately one-half (1/2) the value of the factor rated ahead of it.

(3) APPROXIMATELY EQUAL. The value is nearly the same as another factor;

any difference is slight and unimportant.

Factors 1 and 2 are approximately equal in importance and are significantly more important when compared to Factor 3. Factor 4 is significantly less important than Factors 1, 2, and 3. Factors 1, 2, 3, and 4, when combined, are significantly more important than Factor 5, cost or price.

Factor 5, which is Price, may become more significant in contributing to the source selection decision if competing proposals offer approximately equal Past Performance and Technical Approaches and due consideration is given to Key Personnel and Project Management Plan and Small Business Commitment Document (SBCD).

1.4.2 Evaluation Approach

All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB). The overarching evaluation approach for all factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the Offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in accordance with the proposal submission section of the RFP.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the Offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

00130-4

1.5 DEFINITIONS:

1. Adverse Past Performance is defined as past performance information that supports a less than satisfactory rating

2. Best Value is the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement.

3. Clarifications are limited exchanges between the Government and Offerors that may occur when award without discussions is contemplated.

4. Communications are exchanges, between the Government and Offerors, after receipt of proposals, leading to establishment of the competitive range.

5. Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

6. Discussions are negotiations conducted in a competitive acquisition.

Discussions take place after establishment of the competitive range.

7. Due Diligence (Industry) - The process followed by prospective contractors to fully understand the government requirement in order to submit a complete, responsive proposal to the Government which will result in a successful acquisition. Methods may include such activities as conducting site visits, attending industry days, one-on-one sessions with the acquisition teams, pre-proposal conferences and responding to draft requests for proposals.

8. Due Diligence (Government) - The process followed by the Government acquisition team to ensure all prospective contractors are as informed of the Government requirement and method of acquisition as possible in order to receive a reasonable number of competitive proposals from industry. Methods may include such activities as providing for site visits, conducting industry days, one-on-one sessions with interested vendors, pre-proposal conferences and sending draft requests for proposals to industry.

9. Evaluation Findings are the written observations/judgments regarding the individual merits of the proposal against the solicitation requirements.

10. Evaluation Notice (EN) is the PCO’s written notification to the Offeror for purposes of clarifications, communications, or in support of discussions.

11. Large Business means businesses determined other than Small Business based upon industry size standards/NAICs codes. Includes: Large businesses, State and Local Government and non-profit companies. May also include: public utilities, educational institutions, and foreign-owned firms.

00130-5

12. Minor or Clerical Error is a minor informality or irregularity that is merely a matter of form and not of substance or a clerical error apparent on its face in the proposal.

13. Performance Confidence Assessment is an evaluation of the likelihood (or Government’s confidence) that the Offeror will successfully perform the solicitation’s requirements; the evaluation is based upon recent, relevant past performance information.

14. Quality, as it pertains to past performance information, is a measure of how well the contractor performed on recent/relevant contracts.

15. Rating is the adjective/color descriptor assigned by the evaluators’ to the non-Cost/Price Factors and corresponding Subfactors. It represents their conclusions as to the quality of the proposal, supported by narrative write-ups identifying the associated strengths, weaknesses, deficiencies, risks, and uncertainties. The strengths, weaknesses, etc., are the findings that support the rating adjective/color.

16. Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred.

Recency is generally expressed as a time period during which past performance references are considered relevant.

17. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

18. Requirements Documents are all aspects of the RFP that convey the needs of the Government to Offerors, including the SOO, SOW, PWS, technical requirement documents, and system requirement documents.

19. Requiring Office is the entity (for example, a program management office or other organizational entity) responsible for translating user requirements into the requirements documents within the RFP that communicate those requirements to Offerors.

20. Risk, as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, increased cost or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance. (For firm-fixed-price contracts, the reference

00130-6 to increased cost may be removed from the risk definition.)

21. Source Selection is the process used in competitive, negotiated contracting to select the proposal that offers the best value to the Government.

22. Source Selection Authority (SSA) is the official designated to make the source selection decision.

23. Significant Strength is an aspect of an Offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

24. Source Selection Team (SST) is a team that is tailored to the unique acquisition, tasked with carrying out a source selection. Composition of the team generally consists of the SSA, PCO (if different from the SSA), Source Selection Advisory Council, SSEB, Advisors, Cost/Price Experts, Legal Counsel, Small Business Specialists, and other subject-matter experts.

25. Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

26. Source Selection Decision Document (SSDD) is the document that reflects the SSA's independent, integrated, comparative assessment and decision.

27. Source Selection Evaluation Board (SSEB) is a group of Government and, if needed, approved non-Government personnel, representing the various functional disciplines relevant to the acquisition.

28. Source Selection Plan (SSP) is a plan that describes how the source selection will be organized, how proposals will be evaluated and analyzed, and how source(s) will be selected.

29. Strength is an aspect of an Offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

30. Terms and Conditions Concerns are issues related to any of the contract provisions in the solicitation.

31. Tradeoff Process is the process which permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal.

32. Uncertainty is any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g. more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).

00130-7

33. Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001

1.7 NON-COST EVALUATION FACTORS & SUBMITTAL REQUIREMENTS

1.7.1 FACTOR 1. Past Performance - rated as follows:

An Offeror’s past performance will be evaluated to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection. Common aspects of relevancy include similarity of service/support, complexity, dollar value, contract type, and degree of subcontracting/teaming.

OFFEROR’S EXTENT OF PAST PERFORMANCE RELEVANCY SHALL BE

DESCRIBED USING THE ADJECTIVAL RATINGS AS FOLLOWS:

Table 1a. PAST PERFORMANCE RELEVANCY RATINGS Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

OFFEROR’S EXTENT OF PERFORMANCE QUALITY SHALL BE ASSESSED AS

FOLLOWS:

The quality of the Offeror’s recent/relevant past performance efforts will be evaluated. An Offeror’s past performance will also be evaluated to determine how

00130-8 well the Offeror performed on past contracts. Past Performance Quality will be rated in conjunction with the Past Performance Confidence assement rating scale based on the offeror’s overall record of recency and quality of performance.

Documented results from Past Performance Questionnaires, interviews, CPARS, CCASS, and other sources form the support and basis for this assessment.

The Offeror’s strengths, weaknesses, deficiencies, and uncertainties relative to how well the Offeror performed will be assessed using the information provided and gathered as described below.

OFFEROR’S PERFORMANCE CONFIDENCE ASSESSMENT SHALL BE

RATED AS FOLLOWS. THIS RATING CONSIDERS THE ASSESSED

RELEVANCY AND QUALITY OF PAST PERFORMANCE PRESENTED:

Table 1b. PERFORMANCE CONFIDENCE ASSESSMENT RATINGS Rating Description Substantial Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Limited Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

No Confidence

Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

Offerors will be evaluated on the quality of similar work performed within the last TEN

(10) YEARS using the evidence provided by the Offeror and other sources. Offerors shall submit at least FOUR (4) but no more than SIX (6) past projects for this factor.

Offerors are cautioned to take extreme care in selecting projects for review that are both relevant and accurately reflect the Offeror’s past performance capabilities.

Please note that if the Offeror chooses to provide more than SIX (6) projects, the Government will evaluate only the first SIX (6) projects submitted under this evaluation factor. Any additional projects submitted beyond the SIX (6) allowed will NOT be evaluated. Offerors submitting more than SIX (6) projects risk the Government selecting the first SIX (6) projects which may or may not be the Offeror’s most relevant past performance projects in response to this evaluation factor. Each project will be rated individually as well as collectively for an overall performance confidence assessment rating. The success of work performed on similar requirements as a prime or significant subcontractor will be evaluated.

00130-9

Offerors shall include relevant past performance history that demonstrates experience in providing:

Construction of water diversion channels and canals, inclusive of concrete slope pavement or heavy rip-rap scour material;

Working along busy highways & high traffic areas; Installation of traffic control and coordination mechanisms.

Construction of concrete Railroad and Highway Bridges;

Installation of drilled shafts and concrete piles and familiarity with the local area and the unique conditions of the soils in the Southeast Louisiana region;

Roadway Reconstruction and Asphaltic paving;

Design and installation of retaining walls and temporary structures;

The ability to develop safe and effective demolition methodologies.

Work in close proximity to existing active utilities (overhead transmission and underground pipelines).

Coordination with utility companies.

The emphasis should be on the capability and performance of construction, and should include project delivery within schedule, ability to adapt to changing requirements and conditions, and by providing specific examples of challenges faced and solutions proposed and executed. The Offeror shall include the percentage of the final contract amount that was self-performed work along with a description of that self-performed work.

The information evaluated may include parent or affiliated companies. If past performance information provided is from a parent or affiliated company, the proposal must contain a letter from the parent or affiliated company identifying which of their resources will be available to the Offeror for the proposed work. The letter must also identify what role the parent or affiliated company will have in performance of the proposed work.

Relevant past performance of a parent or affiliate will be evaluated on the same basis as relevant past performance of an individual Offeror, provided that sufficient information is supplied to establish the parent or affiliate's role in the contract work as well as the resources available for such work.

An Offeror relying on the past performance record of a parent or affiliate will not be penalized for that fact. However, such Offeror’s proposal must demonstrate there is a reasonable basis for such reliance; otherwise there will be no basis for crediting the Offeror with the past performance of the parent or affiliate.

The Past Performance Questionnaire (PPQ) included within Section 00130, (Attachment

1) is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 1, Past Performance. Ensure correct phone numbers and email addresses are provided for the client’s point of contact.

Completed PPQs should be submitted with your proposal. If the Offeror is unable to

00130-10 obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). It is the Offerors’ responsibility to follow-up with clients/references to ensure timely submittal of questionnaires prior to the proposal closing date. As a courtesy, questionnaires shall also be submitted directly to the Government’s point of contact via email at Rachel.A.Woods@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.

However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also, include performance recognition documents received within the last 10 years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through Construction Contract Administration Support System (CCASS) including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership,…
