Award will be made as a whole to one bidder.

NOTE 1: The Contractor shall note that the area, shown as the borrow area, on the contract drawings is also designated as a disposal area for hopper dredges.

NOTE 2: It is the Government’s intent, under this contract, to dredge approximately 12,000,000 cubic yards of material (if option work is exercised) from the hopper dredge disposal area (HDDA) and place it into the wetland creation areas, as shown on the contract drawings. Circumstances may arise such that the Contractor may be required to coordinate this work with hopper dredges working in Southwest Pass of the Mississippi River. If such coordination is required, the Contractor may be directed to move dredging operations within the borrow area to an area which will cause the least impact to both dredging and disposal operations. In addition, should the Contractor elect to place material within the West Bay area, close coordination will be required with the Corps of Engineers, US Coast Guard, River Pilots and Vessel Traffic Service (VTS) in order to assure safe operations and minimal impacts to navigation.

NOTE 3: The unit “JOB” as used in this Bidding Schedule is synonymous with the term “Lump Sum” used elsewhere within these plans and specifications.

NOTE 4: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE

UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY

00010-4 ED 18-017

ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE

INELIGIBLE FOR AWARD.

NOTE 5: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).

NOTE 6: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442 after Notice of Award. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within 24 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 7: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the government to exercise the options. Also, due to unforeseen circumstances, (i.e., Mississippi River stages and hopper dredging requirements for Southwest Pass) the Contractor shall note that the Government may exercise, by written notice, all or part of Item 0005 – 'Dredging - OW ', and/or all or part of Item 0006 – 'Bird Nesting Prevention and Avoidance Measures - OW '. The exercise of any option in part does not obligate the government to the full extent of the option.

NOTE 8: OPTIONAL WORK ITEMS: The Government may require the delivery of the numbered line item(s), identified in the schedule as Optional Work items, in the quantity (total or part quantity) and price stated in the schedule. The Contracting Officer may exercise all or part of the Optional Work by written notice to the Contractor. Bidders shall bid on all items including the Optional Work item (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid. If the Government activates the Optional Item, the activation will occur while the Contractor’s plant is within the limits of the base dredging work.

NOTE 9: TIME ADJUSTMENT IN THE EVENT OF OPTIONAL WORK. In the event that Optional Work Item 0005 Dredging – OW is exercised under the terms of this contract, the time required for completion of the contract will be increased by 185 calendar days beyond the original duration of 270 calendar days established for the Basic Contract Work set forth in the Special Contract Requirements paragraph entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK”. For partial award of Optional Work Item 0005 Dredging – OW, the 185 calendar day allowance will be prorated accordingly. Optional Work Item 0006 Bird Nesting Prevention and Avoidance Measures – OW requires work to be performed concurrent with Optional Work Item 0005 Dredging – OW. The successful bidder is advised that the contract time required for Optional Work Item 0006 Bird Nesting Prevention and Avoidance Measures

– OW is included in the performance period allowed for completion of Optional Work Item 0005 Dredging - OW, thus the time required for completion of Optional Work will not be increased.
