AMENDMENT 0002

QUESTIONS & ANSWERS

Question 1. Will Option Work be awarded at the same time as Base Work? If not, please describe the anticipated timeline for the award of Optional work.

Response 1. Due to available funding, we will not know if optional work will be awarded until awardable bid amounts are known. Some optional work could be awarded at the time of the base work award and/or some optional work could be awarded during the contract timeframe if additional funds are received.

Question 2. A VEQ (Variation of Estimated Quantities) clause is typically included in Government dredging contracts to limit quantity variation risk in contractor pricing. It appears that the above-reference contract does not contain the standard Variation in Estimated Quantity clause, as described in FAR 52.211-18. Will the Government include the FAR 52.211-18 Variation in Estimated Quantity clause (FAR 52.211-18) in this contract?

Response 2. The referenced FAR 52-.11-18 was erroneously left out of the contract and will be included by amendment.

Question 3. A copy of the Construction Control Manual has been included in the specifications and contains details regarding the sampling of soils, sampling and testing of concrete, welding inspection, etc. Based on the scope of this project, which sections of the Construction Control Manual should the Contractor anticipate in pricing?

Response 3. The Construction Control Manual is a standard enclosure for every New Orleans District contract. Other than the collection of “Channel Bottom Grab Samples” as described in Section 02 21 10.00 12 SURVEYS AND CHANNEL BOTTOM GRAB SAMPLING, no sampling or testing of materials is required under this solicitation.

Question 4. Section 02 21 10.00 states that “the Contractor shall not proceed with any dredging work until the Contracting Officer verifies the final borrow area limits and furnishes this information to the Contractor.” Please describe the potential variation in borrow area limits that should be considered prior to bid submission.

Response 4. The overall borrow area limits will not be changed from that shown on the drawings. It is the intent of this contract to provide an efficient hopper dredge disposal configuration during and upon completion of the HDDA dredging, and to remove material to a bottom elevation of -43.5 feet MLLW where possible. However, based on shoaling patterns within the HDDA, existing dredge face cuts at the time of survey, HDDA access needs, and available funding; the order of work, initial assignment, and required dredge cuts may be adjusted within the overall limits.

Question 5. A Suspension of Work clause (52.242-14) can be found within Section 00700, in the Clauses Incorporated by Reference.

a. Does the Government anticipated the Work to be performed continuously, or should the Contractors included suspension periods within pricing?

b. Will the Government remove the reference to the Suspension of Work (52.242-14) clause?

Response 5. The Government anticipates the work to be performed continuously. The suspension of work clause will remain in the solicitation.

Question 6. Section 00010-4, Note 9, allows 270 calendar days to complete the Base Work and 185 calendar days to complete the Optional Work, while the Base Work and the Optional Work contain dredging scopes of up to 6,000,000 cubic yards. Will the Government increase the Optional Work contractual duration from 185 calendar days to 270 calendar days due to the similarity in dredging quantity for each phase (Base & Optional) of work?

Response 6. The base work duration is larger to accommodate mobilization, establishment of dredge pipeline, etc. The contract durations of 270 calendar days (Base Work) and 185 calendar days (Optional Work) will remain unchanged.

Question 7. Will the Government consider delaying the bid opening date by two weeks to allow time to answer submitted queries and time for het Contractor to incorporate answers into pricing?

Response 7. The bid opening date for this solicitation will not be delayed.

52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
