23. REGULATORY REQUIREMENTS

In addition to the detailed requirements included in the provisions of this contract and the requirements as defined within USACE EM 385-1-1, the Contractor shall comply with all pertinent federal, state, and local laws, ordinances, criteria, rules, and regulations. Submit matters of interpretation of standards to the appropriate administrative agency for resolution before starting work. Where the requirements of this specification, applicable laws, criteria, ordinances, regulations and referenced documents vary, the most stringent requirements shall apply.

24. PERMIT CONDITIONS

South Pass Disposal Areas - Pass A Loutre Wildlife Management Area (PALWLMA).

A Right-of-Entry (ROE) has been obtained from the Louisiana Department of Wildlife and Fisheries (LDWF) for ingress and egress, as well as to perform maintenance dredging, disposal and related activities within the Pass A Loutre Wildlife Management Area (PALWLMA). Compliance with the following conditions will be required:

(1) If the Contractor should elect to use disposal sites on the PALWLMA, the COR shall provide the LDWF with a detailed plan outlining dredging schedules, disposal sites proposed to be used, types of equipment needed, schedules of equipment use, and schedules of project implementation at least two weeks in advance of any activities on PALWMA. In addition, USACE shall provide the LDWF with copies of all pre-project and post project data (elevation/bathymetry information, acreage of marsh created, cut/fill material quantities, etc.). All correspondence shall be sent to Vaughan McDonald at vmcdonald@wlf.la.gov and Todd Baker at todd.baker@la.gov.

(2) Following the above mentioned two week notification period, a preconstruction meeting shall be held with LDWF and include the USACE project inspector (COR), the dredging contractor, and any other USACE decision makers for this project. Meeting coordination shall be through LDWF contact Vaughan McDonald at vmcdonald@wlf.la.gov or Todd Baker at todd.baker@la.gov.

(3) Any and all construction activities on PALWMA including but not limited to dredging areas, access corridors, flotation channel excavations, pipeline corridors, dike construction, buffer areas, fill elevations, etc. shall be performed as depicted on the contract drawings. If any activities extend beyond or outside the locations depicted in the drawings, the USACE shall immediately notify LDWF via email to Vaughan McDonald at vmcdonald@wlf.la.gov. LDWF and USACE will then meet to discuss how to address the work that is outside of the scope of work detailed in the drawings. Any additional work proposed on PALWMA must be approved by LDWF.

01100-18 ED 18-017

(4) LDWF prefers not to restrict public access on PALWMA. Therefore, the LDWF must approve any requests for closures of waterways in writing. A request for closures of waterways shall be submitted to LDWF staff at least two weeks in advance of the need of the closure(s).

(5) The USACE, its contractors, agents, employees and representatives must follow the rules and regulations of PALWMA. These regulations prohibit the use airboats at any time and mud-boat use after 2:00 pm from September 1 through January 31. LDWF will issue separate conditional permits upon request to allow the use of airboats and/or mud-boats in direct support of this project. LDWF will condition these permits to limit disturbance to waterfowl and to recreational users of the PALWMA during peak periods, particularly during the months of September, November, December, and January. A request for an airboat/mudboat permit should be made at least one week prior to the need of the vessel, but should be made with as much advanced notice as possible to allow adequate time for permit processing. Requests should be made via e-mail to Vaughan McDonald at vaughan.mcdonald@la.gov.

(6) USACE must coordinate with LDWF regarding the overnight mooring of quarter barges, equipment barges, tugboats, crewboats, etc. and the staging of floating discharge pipe on PALWMA. LDWF reserves the reasonable right to select the locations for mooring and staging of this type of equipment. LDWF also requires all floating structures to be illuminated with flashing hazard lights during night time hours. All submerged pipelines and emergent pipelines in open water must also be marked with lighting to alert boaters of the potential hazards.

(7) Colonial nesting seabirds and wading birds (including, but not limited to, terns, gulls, black skimmers, egrets, herons, and pelicans) should be avoided to reduce the risk of injuring birds. The nesting activity period generally extends from February 15 through September 15. A visual inspection of the project area for nesting birds will be made prior to startup of work by qualified personnel from the USACE and LDWF. Presence of nesting wading birds and/or seabirds must be immediately reported to LDWF by the project inspector. This action will trigger an additional coordination between LDWF and USACE to perform such activities necessary to identify the nesting birds and initiate any necessary project modification(s) that would avoid disturbance to these birds and their nests. If nests of these birds are present on the work area, a “no-work” distance restriction of 650 feet for terns, gulls, and black skimmers, 1,000 feet for colonial nesting and wading birds, and 2,000 feet for brown pelicans must be implemented.

Further coordination by USACE with the U.S. Fish and Wildlife Service may result in a further reduction of “no-work distance restrictions” depending on the species of birds found nesting at the work site.

(8) A copy of these Right of Entry conditions shall be kept on the job site at all times during this project.

01100-19 ED 18-017

(9) Regular progress meetings between USACE and LDWF staff will be held on site during construction of the project. Additional meetings may be required by LDWF if problems arise.

(10) All equipment used in connection with the project must be removed upon project completion.

(11) Upon completion of the project, a final inspection and/or post-project meeting may be required by LDWF. The meeting would be comprised of PALWMA staff, the contractor, and a representative from USACE to ensure that all stipulations have been adhered to.

(12) In the event the above stipulations are not met, LDWF shall notify the USACE in writing of the infraction. The USACE will have two weeks to rectify the infraction or develop a mitigation plan suitable to LDWF. If no resolution is reached LDWF may cancel this Right of Entry.

(13) The USACE Contractor shall use reasonable care to avoid damage to PALWMA while conducting maintenance dredging operations. The United States has waived sovereign immunity for negligence in the Federal Tort Claims Act, 28 U.S.C. 1346, 2671-2680, and the Department of the Army acknowledges that in the event its employees are negligent, liability may attach for such negligence under the Federal Tort Claims Act. At LDWF’s discretion, the USACE and its Contractor may be asked to repair, or restore to the pre-project condition, any canals, ditches, levees, signs, pilings, or other structures on the PALWMA which are damaged due to the negligence of USACE or its contractors during dredging activities. USACE may be asked to have dredged to their pre-project condition, any waterways (bayous, passes, cuts, canals, trenasses, etc.) that are filled in as a result of the negligence of USACE or its Contractors in the dredging operations. USACE reserves the right to either undertake the performance of any repairs, restoration, or dredging requested by LDWF; or to dispute USACE’s liability for any alleged damages to PALWMA; or to enter into a settlement agreement with LDWF. In no event shall the costs of the repairs, restoration, or dredging, or the financial amount of the settlement, exceed the fair market value of the fee title to the damaged real property at the time immediately preceding the damage. USACE’s liability under this paragraph is subject to availability of appropriations to make any such repairs, restoration, dredging, or payment, and nothing contained in this agreement shall be construed to imply that Congress will appropriate sufficient funds to meet any deficiencies at a later date.

Project Map (2 of 2)

Section 1: Purpose:

This CEPD effort was originally done in order to bring the Mississippi River Ship Channel, Gulf to Baton Rouge, project into compliance with the requirements outlined in EM 1110-2-6056, Standards and Procedures for Referencing Project Elevation Grades to Nationwide Vertical Datums. This engineering manual was released in response to the study performed by the “Interagency Performance Evaluation Taskforce” (IPET) and the resulting Lessons Learned, in order to address datum and project control issues.

This report was updated in 2015 in order to update the datum relationships in the Southwest Pass project area, incorporating published updates to the geodetic and tidal datums. This is described in more detail in Section 2.

As a result of this effort there are several project benchmarks that have been identified as project control, and the appropriate tidal / hydraulic references have been updated. This effort was comprised of several Survey Section (ED-SS) jobs, as referenced below:

Survey Job No Job Title 10-009S Mississippi River Area 1 – survey 10-042S Mississippi River Area 2 – survey 10-043C Mississippi River Area 3/4 – survey 10-133C CEPD Tidal Calculations 10-170S Survey of Mean Low Gulf staff gages 13-083C Mississippi River Gages, CEPD 14-035G CEPD Control Update

Section 2: Tidal / Hydraulic Datum Summary

Each USACE gage listed on Tables 1-3 were surveyed from an existing or newly established benchmark that is included in the National Spatial Reference System (NSRS) database. Gage corrections were determined that can be applied to the raw gage readings to adjust to the North American Vertical Datum of 1988 (NAVD88). Two additional benchmarks were also included in the gage surveys, in order to have three benchmarks associated with every gage. Future gage inspections will use all three benchmarks in order to verify the primary gage benchmark has not been disturbed.

Mean Lower Low Water (MLLW) – NAVD88 relationships have been determined at two tide stations published by the National Oceanic and Atmospheric Administration (NOAA):

Pilottown (Station 8760721), and Pilots Station East (Station 8760922). These stations are located near USACE gages 01525 and 01670, respectively, so these relationships will be referenced at the USACE gages. These MLLW – NAVD88 relationships are referenced to the 2007-2011 modified tidal datum epoch.

The Mean Low Gulf (MLG) – NAVD88 relationships have been determined based on surveys of staff gages that were previously set to MLG. Documentation of the MLG determinations can be found with ED-SS job 14-035G.

Due to regional subsidence and global sea-level rise, the elevations of the referenced benchmarks and the tidal datum values at the referenced gages (as well as the datum relationships) are time-dependant and subject to change. Therefore, the information contained in this report shall be updated on a regular basis and/or as new information becomes available.

Table 1 provides the datum relationships at the gages that are currently used by Operations Division to maintain the SOUTHWEST PASS project area. All gages were set to NAVD88 (2009.55) in 2015, except for USACE gage 01625 which is referenced to NAVD88 (OPUS 2014) using GEOID12A.

Use of the above benchmarks for all USACE MVN funded survey field work and in all plans and specifications shall be in accordance with: USACE MVN Engineering Division Datum Policy Memo #3, “Requirements for Use of Benchmarks for USACE Projects,” dated March 23, 2009;

the USACE New Orleans District Guide for Minimum Survey Standards for performing Topographic, Hydrographic, and Static GPS Control Surveys, Edition 2, dated September 2009 (ref: http://www.mvn.usace.army.mil/ed/edss/surveyingguidelines.asp); and a Survey Plan approved by the MVN District Datum Coordinator.

Section 4: Summary of Findings and Recommendations

This CEPD effort was performed in order to bring the “Mississippi River Ship Channel, Gulf to Baton Rouge” project into compliance with the requirements outlined in EM 1110-2-6065, Standards and Procedures for Referencing Project Elevation Grades to Nationwide Vertical Datums. This engineering manual requires that “coastal navigation project depths are defined relative to Mean Lower Low Water (MLLW) datum, and are being maintained to this datum and the latest tidal epoch as defined by the Department of Commerce.” The datum relationships defined in this report must be used to relate the currently maintained / reported Mean Low Gulf (MLG) depths to MLLW depths. This is only applicable south of river mile zero (Head of Passes), where the project is considered tidally influenced. The Low Water Reference Plane (LWRP 2007) shall be referenced above Head of Passes.

All project documents should be updated to show these datum relationships in order to relate MLG to MLLW, and measures should be taken in the future to start directly reporting with respect to MLLW. Providing this datum relationship will allow users to relate this data to the NOAA charts.

For the SW Pass portion of this project a MLLW-MLG calibration value has been defined as:

0.0’ MLLW = 3.5’ MLG

This calibration value will be considered absolute, and will not be redefined for SW Pass. Use of this relationship will be a no-impact change to dredging practices, as this has been determined using the current relationship to MLG. However, the relationship between MLLW and NAVD88 will need to be periodically updated to incorporate the future sea level rise and local subsidence, and the MLG gage correction values will be updated accordingly using this calibration value.

Dredging design templates and other associated project documents should be updated to include the datum relationships, and the MLLW depth can then be referenced on all future work.

Referring back to Figure 1 (page 7), if the project is currently maintained to a depth of 45’ MLG this would now be described as 48.5’ MLLW. Project documents that must be updated to reflect the MLLW values are:

Dredging templates Plans and specifications Operations and Maintenance manuals Channel Condition survey data posted on web page

The currently used MLG values can be referenced (as a legacy datum) during the period of transition, and can be phased out once the reported MLLW values are properly utilized.

The MLLW / NAVD88 datum relationships defined in this report are time dependant and will have to be regularly verified / updated. The CEPD Guidance indicates that the periodic reassessments of controlling elevations and datum relationships should be performed at least every five years. In order to accomplish this, the budgets for FY19 and FY20 must include funding for this effort. These reassessments will not change the MLLW / MLG calibration value, only the MLLW / NAVD88 relationships that will be used to define MLLW along Southwest Pass.

Any questions/comments relating to this material should be directed to Josh Hardy, MVN District Datum Coordinator (Joshua.T.Hardy@usace.army.mil, 504-862-1852).
